The application, memorandum and related materials are attached for your review. Discussion Associate Planner Kyle Kritz reviewed the staff report, noting that the current language in the Unified Development Code basically requires the Zoning Advisory Commission, Zoning Board of Adjustment, and Long Range Planning Advisory Commission to hold monthly meetings, even if there are no agenda items for them to review. The proposed language allows the chairperson or a majority of the members to call for a meeting or cancel a meeting. There were no public comments. The Zoning Advisory Commission discussed the request, and decided to approve the amendment as submitted. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Kritz, Associate Planner?e•'?.7c- SUBJECT: Amendment to City Code to change the meeting requirement for the Long Range Planning Advisory Commission, the Zoning Board of Adjustment, and the Zoning Advisory Commission DATE: August 25, 2016 INTRODUCTION The City Code establishes meeting requirements for the Long Range Planning Advisory Commission, the Zoning Board of Adjustment and the Zoning Advisory Commission. DISCUSSION Currently, the City Code requires that the Board and the two Commissions meet on a monthly basis. Periodically, there may not be any agenda items for the Board or Commission to review and this change would allow the chairperson of each Board or Commission to cancel a meeting when there are no agenda items to review. The proposed amendment also eliminates an existing section for calling special meetings. With the new language, it is unnecessary to have a separate procedure for calling a special meeting as the procedure will be the same as the regular monthly meeting. Without the proposed amendment, the Board or Commission would need to meet monthly regardless if there were any agenda items. The Legal Department has reviewed the proposed amendment and has no objection to the revised wording. Section 16- 9-1 of the City of Dubu- que Code of Ordinan- ces is amended to read as follows: 16-9-1: ZONING ADVI- SORY COMMISSION: J. Meetings: 1. Meetings: Meetings may be called by the chairperson or at the written request of a majority of the com- missioners. 2. Open Meetings: All meetings must be called and held in con- formance with the Io-, wa open meetings law. 3. Attendance: a. In the event a com- missioner has been ab- sent for three (3) or more consecutive meetings of the com- mission without being excused by the chair-; person, such absence will be grounds for the commission to recom- mend to the city coun- cil that the position be declared vacant and a replacement ;appoint ed. b. Attendance must be entered upon the'I. minutes of all meet-`' ings. 4. Minutes: A copy of the minutes of all regu- lar and special meet- ings of the commission must be filed with the city. council within ten (10) working days after each meeting, or by `! the '.next regularly scheduled city council meeting, whichever is i later. 5. Quorum: Four (4) commissioners consti- tute a quorum for the transaction of busi- ness. The affirmative vote of a majority of the ' commissioners present and voting is necessary except at least four (4) affirma- tive votes shall be re- quired e quired' in the case of: a) text amendment to the zoning ordinance; b),a substantial zoning `reclassification; c) ap- .proval, denial, or amendment of a 3plan- ned district ;applica, tion;; d) adoption of any plan or report; :.or e) amendment of a com- prehensive plan.
