The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant was not in attendance.
Associate Planner Kyle Kritz reviewed the staff report, reviewing the location of the
property, surrounding development, and existing use of the property for agricultural
land. He noted that the Preliminary Plat is reviewed jointly by the County and City of
Dubuque as it's within two miles of the corporate limits. He said the property would be
accessed from Kennedy Road along a private street and discussed the street
configuration.
Staff Member Kritz said that the applicant has provided water and sewer easements for
potential future extension of City utilities to the site. He said that they are asking to
waive the street standard to 22 feet of paved surface on a 50-foot right-of-way. He
discussed the sustainable tools point system, noting that the subdivision will comply
with solar lot configuration, reduced paving width, and enhanced stormwater
management techniques to achieve the subdivision requirements. He recommended
Lots 1, 13, 14, 16, and 17 not be allowed access to Kennedy Road. He recommended
approval of the preliminary plat subject to waiving the street width.
There were no public comments.
The Zoning Advisory Commission discussed the request, and whether an access
easement should be platted to the north of the subject property. Staff noted this
requirement would not be required if the subdivision was located in the city limits.

Recommendation
By a vote of 4 to 1, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Ridge Estates subject to waiving street width standards for Forest Glen Court and
Timber Court. The submitted preliminary plat is in all other respects compliant with the
Unified Development Code.
Conformance with Comprehensive Plan: This subdivision meets the Comprehensive
Plan Land Use Element Goal 1.2, 1.5, 1.8, 4.3, and 10.2.

Impact of Request on:
Utilities: The proposed Timber Ridge Estates Subdivision will utilize individual
septic systems for each building lot and will have shared wells within the
subdivision for water service.
Traffic Patterns: Access to the proposed subdivision will be off of Kennedy Road.
Based on 2013 IDOT vehicle counts, there were 1,780 average daily trips on this
portion of Kennedy Road.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided there is compliance with the Dubuque County Erosion and Sediment
Control Manual.
Adjacent Properties: Staff anticipates the most noticeable impacts to adjacent
properties will be a change in the visual nature of this property with a change from
open space to residential housing, and an increase in vehicle trips on Kennedy
Road. Staff estimates that the 17 new building lots, when fully built out with single-
family homes, will generate approximately 170 average daily trips.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted preliminary plat of Timber Ridge Estates is located on the
north side of Kennedy Road immediately west of Brittany Woods Subdivision. The
proposed subdivision will include 17 new single-family building lots and the construction
of two private streets. The subject subdivision is jointly reviewed by both the City and
County of Dubuque as it is within two miles of the city of Dubuque's corporate limits.
The preliminary plat of Timber Ridge Estates encompasses 19 acres. Access to this
proposed subdivision will be from a new private street to be named Forest Glen Court.
In addition, another street to be named Timber Court will create a T intersection and
extend westward terminating in a cul-de-sac. The applicant's engineer has provided
documentation that the proposed intersection of Forest Glen Court and Kennedy Road
will comply with SUDAS standards for sight visibility.
The proposed private streets within Timber Ridge Estates will be built with 22 foot of
paving. Forest Glen Court will have a 66-foot right-of-way easement. Timber Court will
have a reduced right-of-way easement width of 50 feet. The County is looking at
amending their subdivision code to allow narrower right-of-way easements for short cul-
de-sac streets.

Planning Services Department has reviewed the proposed preliminary plat for
compliance with the City's sustainability requirements. The submitted preliminary plat of
Timber Ridge Estates, LLC proposed the following sustainable subdivision development
tools.
Proposed Sustainable Development Tools:
1) The two proposed private roadways will be built to 22-foot wide reducing
storm water runoff— 5 points
2) Solar lots — 30 points.
3) Compliance with Dubuque County stormwater management ordinance —
10 points.
TOTAL: 45 points
Planning staff is willing to allow the 10 points for compliance with the County Ordinance
on a conditional basis. The submitted final plat and improvement plans will need to
specifically address Best Management Practices that will warrant 10 points. The
County Ordinance requires that the first 1.25 inches of rain be infiltrated on site. This
requirement is more stringent than current City requirements.
There has also been a restriction placed on the plat that there be no direct access from
Lots 1, 13, 14, 15, 16, and 17 to Kennedy Road. Section 11-14(B) of the Unified
Development Code specifically prohibits double frontage lots.
The developer of the proposed subdivision is required to sign a pre-annexation
agreement with the City. This agreement stipulates that when the City proposes to
annex the property, the property owners, existing and/or future, will agree to the
annexation. In return, the City portion of property taxes will be discounted on a sliding
scale for 10 years. The proposed subdivision also provides sufficient easements to
extend water and sewer into the subdivision without the need of acquiring individual
easements from each property owner in the future.
Planning staff recommends the Zoning Advisory Commission approve the submitted
preliminary plat of Timber Ridge Estates subject to waiving the street width standard for
Forest Glen Court and Timber Court.
