Claim Response Kipper, Carla D.BARRY A. LINDAHL, E~Q. CORPORATION COUNSEl, CITY OF DUBUQUE MEMO TO: Mayor Terrance M. Duggan and Members of the City Council DATE: April 8, 2002 RE: Claim Against the City By Carla D. Kipper Claimant Date of Claim Date of Loss Nature of Claim Carla D. Kipper 03/22/02 03/06/02 Vehicle Damage This is a claim in which the claimant states that her vehicle was damaged when she drove over a manhole missing the cover at the intersection of Queen and E. 22nd Streets. According to the report of John Klostermann, Street/Sewer Maintenance Supervisor, Operations and Maintenance was notified on March 5, 2002 by Police Dispatch that a car had driven into an open manhole. When the crew arrived, they noticed that the ring which holds the lid had cracked, allowing the lid to come off. The old ring was removed and a new ring and lid were installed. Mr. Klostermann reports that written records indicate there has not been a recent problem with this lid. However, there has been a problem with this lid in the past. Therefore, it is the recommendation of Mr. Klostermann that the claim be approved in the amount of $85.44. The Legal Department concurs with his recommendation. Our written records show that we have not had a recent problem with this lid. However, the sewer maintenance crews believed that we had a problem with this lid in the past.
