Mayor Welu read the call and stated that this is the regular monthly meeting of the City Coun• cil for the purpose of acting upon such business as may properly '. come before the meeting. May 26, 1958 To the Honorable Mayor and City Council ' Dubuque, Iowa Gentlemen: Section 16.1,11 of Ordinance 33.49 should be changed before practical enforcement is possible. This section now reads that parking is prohibited opposite the entrance to a garage or drive- ~i way on any roadway less than 20 feet in width. Access to garages or driveways in alleys are restricted in those areas where the alleys are thirty feet in width. It is believed that this ordinance should be rewritten so that at least 20 feet of available roadway space is left for the entrance or exit from the driveway or garage. It is recommended that this sec- tion of the Ordinance be repealed and another section be substituted stating that it is illegal to park op- posite the entrance to a garage or driveway on any street or alley when less than 20 feet of the avail- able width of said street or alley shall remain for ingress and egress to and from said garage or drive- way. May 26, 1956 To the Honorable Mayor and City Council Dubuque, Iowa. Gentlemen: At the present tune there is a hazardous and conges- tive situation that exists on West 1st Street between Iowa and Main Street. This condition is caused by trucks which are backed into the loading dock at Western Grocery Company. When these trucks are backed into the loading dock there is only a very narrow space left between the front end of the truck and parked vehicles on the north side of the street. Such a condition effectively restricts the traveled portion of the street to one lane of traffic. It is believed that phis situation can be corrected by removing the parking from the north side of West 1st Street between Main and Iowa Streets. It is therefore recommended that parking be prohibited between Main and Iowa Streets on the north side of West 1st Street and that "No Parking This Side" be erected in this area. May 26,1958 To the Honorable Mayor and City Council Dubuque, Iowa. Gentlemen: The City Council re- quested that an investigation be made of the conditions of Alpine and Langworthy because of the sight distances at the corner and the accident rate during the past few years. Vehicles traversing the intersec- tion of Alpine and Langworthy are presented with a particularly haz- ardous condition because of the extremely poor visibility at this s 236 Regular Session, June 2, 195$ corner. All four corners have IargE trees growing at or near the curk line and there are high terrace, interferring with the visibility on two corners. While the accident rate is not too frequent, the accidents that do occur have resulted in very heavy damage to the vehicles and oc- casional injury to the occupants. It is believed that the value of Alpine Street as a connecting street from Dodge to the University area could be greatly increased and made much safer if the vehicles traveling east and west on Lang- worthy were required to stop be- fore entering Alpine Street. It is recommended that stop signs be erected at the northeast and southwest corners of Langworthy at Alpine Street in such a manner as to require vehicles traveling east and west on Langworthy to stop before entering Alpine Street. May 26, 1958 To the Honorable Mayor and City Council Dubuque, Iowa. Gentlemen: The petition of George Engel and others request- ing atraffic light at the corner of Rhomberg and Windsor was re- ferred to the City Manager for investigation and report. I have had this investigated by the Police Traffic Department and without a doubt, this intersection suffers from congestion at certain periods during the day, This is especially true during the normal rush hours and again on week-ends and when large numbers of pleas- ure riders and sight-seeing motor- ists are on the street. The accident picture at this in- tersection has not been bad over the past three years. There have been approximately three accidents per year with a total of two or three injuries for the entire three year period. This year there has been three accidents at this inter- section which may or may not have been prevented by the installation of electric traffic controllers. In two of the cases there was aright- of-way violation by the motorist attempting to enter Rhomberg Av- enue from Windsor Avenue. The third case involved a motorist who admitted that he had been speed- ing on Rhomberg just before he was involved in a collision with a young boy on a bicycle. This ac- cident, while attracting a lot of attention, was actually a very minor accident. The situation at this intersection is not much different than the situation existing at more than a score of intersections in the City during peak hours of travel. It is not believed that the installation of traffic controls at this intersec- tion would relieve the situation to any measurable extent. Sight distances at the intersec- tion can be improved through the removal of some of the signs and sign posts in the area and through the repositioning of others. It is believed that this type of improve- ment should be undertaken before there is any further consideration of the installation of electric traffic controllers. It is therefore recommended that the petition to install traffic lights be denied, however that a study and recommendations for improv- ing sight distances and reducing speed at this intersection be made by the Traffic Department and that the Highway Commission be con- sulted regarding the traffic count and the installation of any traffic control devices at this intersection. Gentlemen; The petition of Wil- liam and Ethel Jenni relative to the condition of their property af- ter asewer was constructed was referred to the City Manager and City Attorney for investigation and report. Upon investigation it was found that there is no serious reasonable objection to the condition of the property as left by the contractor, Mr. Jenni was paid $4500.00 by the City of Dubuque for any damages received in the construction of this sewer. Regarding the specific complaint about piling earth and rock in the middle of the creek around the manhole, this area was left in an uneven condition, however, is not serious. The City will arrange to have the contractor smooth this area off in order to partially cor- rect this compaint. Very truly yours, L. J. Gentlemen: The communication of Ed. J. Her- ron, State Fire Marshal, relative to the appointment of a qualified member of the Fire Department to serve as Assistant Inspector was referred to the City Manager ho report to the City Council, The Fire Chief of the City of Dubuilue is responsible for the ef- ficient operation of our Fire De- partment. He is the one to whom complaints are directed and he is ~Che person to whom I look for the efficient operation of the depart- ment. The efficient inspection of all buildings by our Fire Depart- menthas resulted in a very marked reduction of fire hazards and fire lasses. These inspections have been carried out under the direc• Lion of the Fire Chief. I therefore recommend ~tha~t Fire Chief, Tom Hickson, be appointed as Assistant Fire Marshal or As• sistant State Inspector and that all reports, inspections 'and responsi- bility for this be cleared through his office. Gentlemen; The objection of Walter and Lu- cille Kaiser relative to the cron• dition of their property after the sewer was constructed was refer- red to the City Council to view the grounds. Upon viewing the grounds by the City Council, it was found that there is a condition at this loc~~ tian that should receive some at- tention. It was the decision of the Coun- cil that the storm sewer be ex- tended approximately 50 feet and empty directly into the storm water ditch and that the area where hhe water flows over ,the ground at the .present time be filled with suitable dirt so that the garden can be replanted. In regard to the complaint of the well, it is felt that the City had no responsibility in regard to this because of its condition prior to the time of construction. Gentlemen: The petition of Vic Helling and others requesting oiling of an al• ley between Rosedale and Clarke Drive leading from St. Ambrose to North Grandview was referred to the City Manager for investiga- tion and report. It has been the policy of the City in •the past not to place as- phalt seal coat on any alleys in residential areas unless there is a washing condition and the oil• ing would conserve -the surface ma- terial, This alley is somewhat in that position and previously has been sealed. During the construc- tion of North Grandview Avenue, the approach to the alley was re• graded and has never been re• sealed. This request will be taken care of, however, if the residents of this alley, owning adjoining property, request a permanent .type surface, the construction should be ap- proved and assessed against the ad- joining property. Gentlemen: The petition of Dick Henschel and others requesting ,the exten• sion of water mains to the Kelly Lane area was referred to the City Manager and Water Department for investigation and report. I am attaching a complete re- port of ,the Water Department on this proposed extension and I con- cur in the findings of this report that it is impossible for the City to provide funds far the extension during 1959 and provided that suf- ficient revenue is farthconung in the future, this extension is planned for 1962, The cost to construct this exten- sion is estimated to be $105,000.00 with very little potential of future income over the area from Fre• monk Avenue to Kelly Lane. The petition also suggests that a separate water system be built 'for this area. This is very im- practical and should not be con• ~idered under any conditions. If the developers of this area wish to build, it is their respon- sibility ~to provide their own water and sewer services until :the City is able to furnish them on a sound economical basis. Gentlemen: I have examined the claim of Mrs. Norman Dearborn, 1425 Adair Street, for damages sus- tained to her automobile when it struck a defective curb on the east side of Auburn Street April 21, 1958. Gentlemen: In February, 1955, the City Council adopted an ordi• nonce setting the rates for the use of water that would provide in- come to pay for bonds issued for the construction of new wells, hard- ness reduction and iron removal plant. The income from these rates was to also provide sufficient funds for main extensions in the amount of $45,000.00 per year plus capital improvements such as elevated tank in Park Hill $75,000.00, repair of West 3rd Street reservoir $60; 000.00, construction of distribution main in City Island $285,000.00 and the Asbury Road elevated tank $180,000.00. Operating and main- tenance expenses were figured us- ing the rates for labor and cost of materials then in effect. Since 1955 because of new sub- divisions and industrial develop- ments, it was necessary to expand twice the amount anticipated. Had this not been done there would not be water in the new industrial area and new subdivisions would not have been started. While those in new subdivisions pay for water mains, it covers only half the total cost including fire hydrants and larger size mains. Cost of materials such as chemi- cals used for the treatment plant have cost more than originally esti• mated by our consulting engineers and labor costs have also increased the same as in private business. Because of the increase in operat- ing expenses, main extensions and capital improvements, the surplus that is normally used for the new extensions and capital improve- ments has been used. In order to carry out the work prepared in the 1959 Water Department budget and subsequent years for main exten- sions and major improvements, ad- ditional income will have to be pro- vided. The additional funds can be pro- vided by increasing water rates or a combination of water rates, hy- drant rentals and payment of water furnished to city departments with- out cost. H the combination is used it must be remembered that the city tax rate will be increased to take care of the costs to each city de- partment and for hydrant rental. I am attaching a report of the Water Superintendent giving in- formation on the income seven dif- ferent rates will provide. This re- port also gives the comparative rates of other cities in Iowa that have water treatment plants and shows the comparison of the rates if the rates are raised on an equal level. Also the report shows in detail the yearly revenue, expense and supplies and the estimated rev- enues and expenses from 1958 to 1965. This portion of the report j shows in detail the major improve- ments proposed and their costs. In order to provide these improve- ments and the normal main exten• sions, the necessary revenue must be provided by a rate adjustment. Shown on page three of the data on rates for cities in Iowa that pro- vide water softening the per capita revenue average in the nine cities 244 Regular Session, June 2, 1958 is 11.60 per year while in Dubuque the per capita revenue is 8.47. I recommend that the City Coun- cil study these reports so that you may be more familiar with the con- tents and then meet with the of- ficials concerned to be more fully informed in whatever phase you may have questions. The rate change should be decided at the July meeting so that they can be effective September 1st. In order to provide the revenue needed to keep ahead of the order- ly development of the City it will be necessary to increase revenues about $120,000,00 per year. Gentlemen: The verbal objection of Desmond Sullivan as to the in• stallation of a concrete sidewalk on West 10th Street from Main Street to the alley first west of Main Street was referred to the Council to view the grounds. Upon viewing the grounds it was the decision of the Council that this sidewalk should be replaced because of its condition in the downtown area. It was also determined that the City should repair the sidewalk at the crosswalk on Main Street and replace the curb at the same tune. Gentlemen: The communication of the Civil Defense Director re• questing the use of Police and Fire Department sirens for alerting of any disaster was referred to the City Manager for investigation and report. Upon conferring with the Police Chief and Fire Chief it is my opinion that this cooperation could not be given. In case of any dis- aster the Police and Fire Depart- ments would be busy assisting in either the putting out of fires or directing of traffic and they would not be in a position to traverse the streets using their sirens to alert the people. It was found by previous exper- ience that the sounding of police and fire sirens had little effect on the people except those within a short radius of the fire and police stations. The use of sirens on emer- gency vehicles serve the purpose of notifying people that an emer• gency vehicle is traveling in the street and to give them the right of way. )f in the case of a natural dis- aster, these vehicles will be pro- ceeding to the scene of a fire or ac• cident these sirens would be in op• eration and would then also alert people to the disaster. Evidently Mr. Brown is suffering from some heart ail- ment and by not allowing him to make Che connection in Delhi Street it seems to be aggravating his condition. Mr. Brown could con- nect from W. Fifth Street but it is same one hundred and seventy-five feet away which would entail con- siderable mare expense. Another alternative would be to connect and come through the meter next door. The Brown's were told that by this method they would not re- ceive enough water pressure. Building Commissioner Bandy addressed the Council by stating that he was led to believe that water was in at the curb. Also the property does not exist as a sepa- rate lot. Our Chief of Police has attended these meetings each year since 1952 except the year 1957. I feel that the attendance at these meetings are of a great bene- fit to the individual attending and also they bring back to the City many new ideas that can be useful and in all cases the cost of at- tending these meetings has been repaid many times. When North Central was purchas- ing gas at the city border states from Northern Natural they were subject to increases in the cost of gas at this station if approved by the Federal Power Commission, or even if increased rates were col- lected under bond. I find that in the establishment of Kaufmann Avenue in the Plat of L. H. Langworthy's Addition, the City was granted an easement only, the title being reserved to the dedi- cator. It appears that the line shown as "existing street line" has been the line of Kaufmann Avenue for over fifty years for the pur- poses of street improvements, I am therefore of the opinion that the City is estopped to assert its ease- ment over the portion of the lots lying between "existing street line" and "original street line" appearing on the plats. These plats were recorded with- out Council approval or conforming to the Subdivision Ordinance. On June 26th, Mayor Welu, City Engineer Cullen and myself con- ferred with the Hennessey Brothers in regard to performing this work in the City of Dubuque. We were assured that all labor other than their foreman and equipment oper- ators would be hired through Du- buque sources. We were also as- sured that any outstanding damage claims against the Hennessey Brothers for work that was per- formed during the last year would be handled in the proper manner and it is not their intention to de- liberately damage anyones prop- erty and if it is damaged, the in- surance that they carry will cover any legitimate damage claims.
