Council met at 7:30 P.M.
Present-Mayor Welu, Council-
men Dove, Kintzinger, Kolb,
Schueller. City Manager Schiltz.
Mayor Welu stated that this is
the regular monthly meeting of the
City Council, also the first meet-
ing of the fiscal year, for the pur-
pose of acting upon such business
as may properly come before the
meeting.
Councilman Kolb moved that
Councilman Charles E. Dove be
elected Mayor for the ensuing fis-
cal year, Seconded by Councilman
Schueller. Carried by the following
vote:
Yeas-Mayor Welu, Councilmen
Kintzinger, Kolb, Schueller.
Nays-None.
Councilman Dove not voting.
City Clerk Frommelt swore in the
new Mayor and Mayor Dove took
the Mayor's chair.
RESOLUTION N0. 1.51
A Resolution providing for the
appointment of a City Manager,
City Clerk, City Solicitor, Assistant
City Solicitor and Police Judge of
the City of Dubuque; prescribing
their salaries and fixing their
bonds.
Be It Resolved by the City Coun-
cil of the City of Dubuque that the
following officers be appointed sub-
ject, however, to the right of the
Council to declare such offices
vacant or remove the officers
therefrom at the pleasure of the
Council with or without cause, and
to be paid the compensation pro-
vided for in the budget and that
they each provide the following
bond at their expense: City Man-
ager, L, J. Schiltz, bond~5,000.00;
City Clerk, Leo F. Frommelt, bond

Whereas, a detailed distribution
of proposed expenditures of the
City of Dubuque for the fiscal
year beginning January 1, 1957,
and ending December 31, 1957, has
been duly prepared by the City
Manager and submitted to this
Council for approval; and
Whereas, this Council has exam-
ined the detailed distribution of
the propo~d expenditures, where-
in estimates of the expenses of the
departments and purposes are
shown, including the estimates for
which all levies heretofore made,
receipts from moneys and credits
and miscellaneous sources are to
be used, and said distribution
shows all of the proposed expendi•
tares for the ensuing fiscal year;
Now, Therefore, Be It Resolved
by the City Council of the City of
Dubuque that said detailed distri-
bution of proposed expenditures

of the expenses of such funds and purposes in the soma

Section 3. Surplus. Any surplus not apecitically al-
located for a definite purpose in the budget shall be and
l the same is hereby appropriated and set apart to be
applied as contingencies arise or may be used for such
proper purposes as the Council may determine upon. Any
surplus not specifically distributed in the budget and
remaining in funds created by the levy of special tales
~ shall be and the same is hereby appropriated for any
proper purpose incident to such funds. Nothing herein
I. contained shall authorize the transfer of funds realized
from special tales to a fund ar purpose for which any
special tae levy has been made, except only with the
approval of the State Comptroller.
Section 4, Delinquent Taa Collections. Delinquent
prior years' tax collections shall be allocated to the
' respect[ve funds moat logically including the purpose
for which the tax was levied when and as the same are
~ received by the City Treasurer.
Section 5. Distribution. That the distribution and
~ division of the within appropriat[ona shall be made in
accordance with the detailed distribution adapted by the
I City Council on January 7, 1957, which detailed distri-
bution is made a part of this ordinance by reference
thereto and shall be so considered in connection with the
eapenditures of said appropriations.
II Section 6. This ordinance shall be in force and
effect from and after its final passage, adoption and
approval by the City Council and publication ae pro-
vided by law, and the appropriations herein provided
shall be available when transferred to their respective
funds.

To the Honorable Mayor
and City Council,
Dubuque, Iowa
Gentlemen:
Your honorable body requested
that recommendations regarding
restricted parking in the vicinity
of 22nd and Central Avenue be re-
viewed.
During the period from Novem-
ber 24th to December 4th, checks
were made of available parking
within one block distance from
22nd and Central Avenue. The sur-
vey as attached, shows that the
minimum number of spaces avail-
able was ten and the maximum was
twenty-one,
Various persons who signed the
petition requesting restricted park-
ing were interviewed and only one
of six felt the restricted parking
would help.
Because of the fairly good turn-
over in parking, the spaces avail-
able and the problem of enforce-
ment, it is recommended that the
petition be again denied.

Bituminous Concrete Surfacing
Project No, 1.
Whereas the contract heretofore
entered into by the City of Du-
buque, Iowa, for the improvement
hereinafter described has been
completed and the City Manager
has certified the completion there-
of to the City Council and the City
Council has ascertained the cost
thereof and has determined that
$70,206.76 Dollars of the cost there-
of shall be assessed against the
property subject to assessment
therefor; and
Whereas public notice, as pro-
vided by law, has been published
by the City Clerk stating the in•
tention of the City Council to is-
sue bonds for the purpose of pro-
viding for the payment of the as_
sessed cost of said improvement
and a public hearing has been
held, pursuant to such notice and
all objections made thereto have
been considered and determined;
Now Therefore Be It Resolved
by the City Council of the City of
Dubuque:
1. That to provide for the pay-

3. Said bonds shad bear interest
at the rate of 5 per cent per an-
num, payable semi-annually in ac-
cordance with coupons thereto at-

City of Dubuque liable in any way,
except far the application of said
special assessment funds.
5. Said bonds shall provide that
they may be payable at any time

Street Improvement Bond
( The City of Dubuque in the
State of Iowa promises to pay as
hereinafter mentioned to the bear-
er hereof, on the first day of
or at any
time before that date, at the op-
tion of the City of Dubuque, the
sum of Five Hundred dollars with
interest thereon at the rate of 5
per cent per annum, payable semi-
annually, on the presentation and
surrender of the interest coupons
hereto attached. Both principal
and interest of this band are pay-
able at the office of the City Treas-
urer in the City of Dubuque, in the
State of Iowa. This bond is issued
by the City of Dubuque under and
by virtue of Chapter 396 of the
1954 Code of Iowa, as amended,
and the Resolution of said City
duly passed on the 7th day of Jan.
nary, 1957, being Resolution No.
6.57.
This Bond is one of a series of
141 bonds, 140 for $500.00 num-
bered from 1010 to 1149 inclusive,
and one for $206.76 numbered 1150,
all of like tenor and date, and is-
sued for the purpose of paying the
cost of the city of Dubuque 1956
Bitumious Concrete Surfacing
Project No. 1 as described in said
Resolution, in said City, which cost
is payable by the abutting and ad-
jacent property along said im-
provements and is made by law a
lien on all of said property. It is
payable only out of the Special
Assessment Fund No. 1194 created
by the collection of said special
tax, and said fund can be used for
no other purpose.
It is hereby certified and recited
that all the acts, cronditions and
things required to be done, pre•
cedent to and in issuing this series
of bonds, have been done, hap-
pened, and performed, in regular
and due form, as required by law
and said Resolution, and for the
assessment, colllection and pay-
ment hereon of said special tax,
the full faith and diligence of said
City of Dubuque are hereby irrevo-
cably pledged.
In Testimony Whereof the City
of Dubuque by its Council has
caused this band to be signed by
its Mayor and countersigned by its
City Clerk and the Seal of said
City to be thereto affixed, this 7th
day of February, 1957.

Whereas the contract heretofore
entered into by the City of Du-
buque, Iowa, for the Improvement
hereinafter described has been
completed and the City Manager
has certifie3 the completion there-
of to the City Council and the City
Council has ascertained the cost
thereof and has determined that
$43,660.99 Dollars of the cost there-
of shall be assessed against the
property subject to assessment
therefor; and

ed by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
for the purpose of providing for the
payment of the assessed cost of
said improvement and a public
hearing has been held, pursuant to
such notice and all objections made

issued by the City of Dubuque un-
der and by virtue of Chapter 396
of the 1954 Code of Iowa, as
amended, and the Resolution of
said City duly passed on the 7th
day of January, 1957, being Reso-
lution No. 8.57,
This Bond is one of a series
of 88 bonds, 87 for $500.00 num-
bered 922 to 1008 inclusive, and
one for $160.99 numbered 1009, all
of like tenor and date, and issued
for the purpose of paying the cost
of the City of Dubuque 1956 Con-
crete Curb & Gutter Project No. 1
as described in said Resolution, in
said City, which cost is payable by
the abutting and adjacent prop-
erty along said improvements and
is made by law a lien on all of said
property. It is payable only out of
the Special Assessment Fund No.
1193 created by the collection of
said special tax, and said fund can
be used for no other purpose.
It is hereby certified and recited
that all the acts, conditions and
things required to be done, prece•
dent to and in issuing this series
of bonds, have been done, hap•
pened, and performed, in regular
and due form, as required by law
and said Resolution, and for the
assessment, collection and payment
hereon of said special tax, the full
faith and diligence of said City of
Dubuque are hereby irrevocably
pledged.

caused this bond to be signed by
its Mayor and countersigned by its
City Clerk and the Seal of said

thorized and granted the right and
authority to construct a concrete step
abutting the property known as 55
East Ninth Street;
Section 2. That such step shall be
constructed in accordance with Dlans

under the supervision and direction
of the City Manager and also in ac-
cordance with all applicable State and
Federal Laws and regulations and tha

RESOLUTION to fix a date for
the initiation of proceedings for the
issuance of $330,000 Water Revenue
Bonds, Series 1956, of the City of
Dubuque, Iowa.
WHEREAS the City of Dubuque,
in Dubuque County, Iowa, did here-
tofore establish a municipal water-
works in and' for said City which
has been continuously operated by
said City for many years, and the
management and control of said
utility is vested in the City Council
of said City and no board of trus-
tees exists for this purpose; and
WHEREAS it is necessary and
desirable that improvements and
extensions to said municipal water-
works be constructed, the cos t
whereof is estimated to be not less
than $330,000, for which purpose it
will be necessary that said City is-
sue its revenue bonds payable from
and secured by the net earnings of
said municipal waterworks as au-
thorized and permitted by Sections
397.10 et seq. of the Code of Iowa,
such bands to rank on a parity
with $100,000 Water Revenue
Bonds, 1952 Series, of said City
heretofore issued under date of
December 1, 1952, and on a parity
with $1,500,000 Water Revenue
Bonds, 1955 Series, of said City
heretofore issued under date of
May 1, 1955, as authorized and per-
mitted by the proceedings author-
izing the issuance of said outstand-
ing bonds; and

are initiated for the issuance of the
additional bonds now proposed to
be issued it is necessary to fix a
date of meeting of this City Coun-
cil at which it is proposed to take
action for this purpose and to give
notice thereof as required by Chap-
ter 23 of the Code of Iowa;
NOW, THEREFORE, Be It Re-
solved by the City Council of the
City of Dubuque, Iowa, as follows:
Section 1. That this City Council
meet on the 4th day of February,
1957, at the City Hall, Dubuque,
Iowa, at 7:30 o'clock p.m., at which
time and place proceedings will
be instituted and action taken for
the issuance of Water Revenue
Bonds, Series 1956, of said City in
the Principal amount of $330,000 for
the purpose of paying the cost of
constructing improvements and' ex-
tensions to the municipal water-
works of said City.
Section 2, That the City Clerk is
hereby directed to give notice of
the proposed action for the issu-
ance of said bonds, setting forth
the amount and purpose thereof,
the time when and the place where
said meeting will be held, by pub-
lication at least once not less than
ten (10) days before said meeting
in the "Telegraph Herald", a news-
paper published and of general cir-

RESOLUTION NO. 13.51
RESOLUTION directing the ad-
vertisement and sale of $330,000
Water Revenue Bonds, Series 1956.
WHEREAS it is necessary and
for the best interest of the City of
Dubuque, Iowa, that $330,000 Water
Revenue Bonds, Series 1956, con-
templated to be issued by the City
be offered for sale at this time;
NOW, THEREFORE, Be It Re-
solved by the City Council of the
City of Dubuque, Iowa, as follows;
Section 1. That bonds hereinafter
described, of the City of Dubuque,
be offered for sale pursuant to pub-
lished advertisement, name 1 y,
$330,000 Water Revenue Bonds, Se-
ries 1956, dated December 1, 1956,
bearing interest payable semian-
nually on June 1 and December 1
of each year and maturing serially
and in numerical order on Decem-
ber 1 of each of the respective
years as follows: $10,000 in each of
the years 1960 to 1962, inclusive;
$15,000 in each of the years 1963 to
1966, inclusive, and $30,000 in each
of the years 1967 to 1974, inclusive,
with the bonds maturing in the
years 1966 to 1974, inclusive, being
re~d'eemable prior to maturity at the
option of the City in whole, or from
time to time in part in inverse nu-
merical order, on December 1,
1965, or on any interest payment
date thereafter, on terms of par
and accrued interest.
Section 2. That the City Clerk be
and he is hereby authorized and
directed to publish notice of the
sale of said bonds for two or more
successive weeks in the "Telegraph
Herald", a newspaper of general
circulation in Dubuque County,
printed and published in City of
Dubuque, Iowa, such notice to be
in the customary form and to state
that bids will be received and act-
ed upon by this Council at a meet-
ing to be held at 7:30 o'clock p.m.,
on February 4th, 1957.
Section 3. That the Clerk is fur-
ther authorized to prepare and re-
lease such further information as
he may deem advisable in order to
afford due publicity to the sale of
said bonds.
Section 4. That all resolutions or
parts of resolutions in conflict
herewith be and the same are here-
by repealed.

NOTICE OF SALE OF BONDS
Sealed bids will be received at
the office of the City Clerk in the
City Hall, Dubuque, Iowa, until
7;30 o'clock p.m., on February 4th,
1957, for the purchase of $330,000
Water Revenue Bonds, Series 1956,
of said City, at which time they
will be presented to the Council of
said City at its meeting to be then
held in the City Hall in said City
and, after the receipt of open bids,
the bonds will be sold to the high-
est bidder for cash. Said bonds will
be dated December 1,1956, bear in-
terest payable semiannually on
June 1 and December 1 of each
year and mature serially and in
numerical order on December 1 of
each of the respective years as fol-
lows: $10,000 in each of the years
1960 to 1962, inclusive; $15,000 in
each of the years 1963 to 1966, in-
elusive, and $30,000 in each of the
years 1967 to 1974, inclusive, with
the bonds maturing in the years
1966 to 1974, inclusive, being er-
deemable prior to maturity at the
option of the City in whole, or
from time to time In part in in-
verse numerical order, on Decem-
ber 1, 1965, or on any interest pay-
ment date thereafter, on terms of
par and accrued interest. Bidders
must specify a single coupon inter-
est rate for the bonds and, all oth-
er conditions being equal, prefer-
ence will be given to the bid of par
and accrued interest or better spe-
cifying the lower coupon interest
rate.
These bonds, when issued, will
not constitute general obligations of
said City nor will they be payable

in any manner by taxation, but will
rank on a parity with $1,600,000
principal amount of presently out-
standing Water Revenue Bonds of
said City and any additional bonds
as,may be hereafter issued and
outstanding from time to time un-
der the conditions and restrictions
set forth in the proceedings for said
presently outstanding bonds, all of
which will be payable solely and
only from the net revenues of the
municipal waterworks plant a n d
system of said City.
The City will furnish the approv
ing opinion of Messrs. Chapman
and Cutler, Lawyers, Chicago, 111i-
nois, the purchaser to furnish the
printed bonds, and all bids may be
so conditioned. Bidders must fur-
nish certified check on a state or
national bank for two per cent (2
per cent) of the principal amount
of the bonds, as guarantee of good
faith, this amount to be forfeited
by the successful bidder should he
fail to take up and pay for the
bonds when ready. The right is re-
served to reject any or all bids,
