City Engineer Gus Psihoyos is recommending acceptance of the public improvement
construction contract for the Heeb Street Retaining Wall Reconstruction Project, as
completed by McDermott Excavating, in the final contract amount of$160,442.34, which
is a 2.6% decrease from the original contract amount of$164,778.00. The decrease
was due to actual field measurements.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the public improvement
construction contract for the Heeb Street Retaining Wall Reconstruction Project.
BACKGROUND
The Heeb Street Retaining Wall is located at the intersection of Clarke Drive and Heeb
Street. This is an existing City-owned limestone retaining wall that was showing signs of
distress. The wall height varies from 6 feet to 15 feet, with a wall length of 82 feet. The
wall supports Heeb Street (a 25-foot wide street) which has an 8-inch sanitary sewer
main in close proximity to the wall.
The City Engineering Department monitored the wall for movement between 2012 —
2013. For precaution the City placed temporary concrete barriers (summer of 2012) on
Heeb Street to protect pedestrians and vehicles.
DISCUSSION
The Heeb Street Retaining Wall Reconstruction Project was completed by McDermott
Excavating, of Dubuque, Iowa, in the final contract amount of $160,442.34 which is a
2.6 % decrease from the original contract amount of $164,778.00. The decrease was
due to actual field measurements.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of $160,442.34 to McDermott Excavating, for the Heeb Street
Retaining Wall Reconstruction Project.

RESOLUTION NO. 354-16
ACCEPTING THE HEEB STREET RETAINING WALL RECONSTRUCTION
PROJECT AND AUTHORIZING THE PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the Heeb Street Retaining Wall
Reconstruction (the Project) has been completed by the Contractor, McDermott
Excavating (Contractor), the City Engineer has examined the work and recommends
that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $160,442.34;
WHEREAS, the Contractor has previously been paid $152,420.22, leaving a
balance of $8,022.12; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the
Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $8,022.12 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that
he has inspected the Heeb Street Retaining Wall Reconstruction Project, and that said
Project has been performed in compliance with the terms of the Public Improvement
Contract, and that the total cost of the completed work is $184,508.69.
