Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing existing signage on the Kehl Diabetes Center, the change in use of the building for an urgent care facility, and the need to provide adequate signage to direct people to the facility. Staff reviewed the staff report, noting that the sign regulations for the Finley Hospital ID Institutional District were developed by hospital officials in the past. Staff noted the current amendment allows additional signage similar to existing signage in the area. Staff reviewed location and distance to surrounding residential properties. There were no public comments. The Zoning Advisory Commission discussed the request, asking the applicant about the scale of the proposed signage compared to the building fagade that they will be attached. The Commission concluded the proposal for additional sign area was reasonable. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. The Kehl building is a 28 foot high, two-story structure with approximately 3,800 square feet of area per floor. The building is setback approximately 70 feet from University Avenue with paved off-street parking located on both sides of the structure. DISCUSSION Currently, the Finley Hospital ID Institutional District sign regulations permit the Kehl Building to have one, 4 foot high, 40 square foot monument style freestanding sign and two, 20 square feet each wall-mounted signs. The applicant is proposing to amend the ID district sign regulations to permit one, 10 foot high, 80 square foot monument style freestanding sign and two, 50 square feet each, wall-mounted signs. The signs would be located in approximately the same place on the building and lot as the existing signs. The sign reconfiguration is being done, in part, to address the signage needs of a new Unity Point Health Urgent Care facility that will be a second tenant in the building and have a separate entrance. The two wall-mounted signs proposed will be located on the front and rear entrances of the building and the monument sign will be located along University Avenue. The subject property is located within a medical campus, next to a retail drug store and across University Avenue from Allison-Henderson Park. The proposed signs will not be out of scale with the building or with the site and should have little impact on adjacent properties. That Title 16 of the City of Dubuque Code of Ordinances, Unified Development Code, be amended by providing for the approval of an amended campus development plan for the Finley Hospital ID Institutional District, a copy of which is on file with the City of Dubuque Planning Services Department. Section 2. Institutional District Regulations. A. Use Regulations The following regulations shall apply to all uses made of land in the above- described ID Institutional District: 1. Principal permitted uses shall be limited to: a. Hospitals b. Outpatient care facilities. c. Office for administrative personnel or other institutional employees or affiliates. d. Classrooms, laboratories, lecture halls, auditoriums and similar places of institutional assembly. Ordinance No. 50-16 Page 2 e. Off-street parking and loading. f. Facilities and operations for the diagnosis, care, and treatment of human health disorders, including examinations in operating rooms, physical therapy or x-ray facilities, psychiatric treatment, convalescent care, and similar hospital -related uses. This provision shall include separate doctors' clinics, drug stores, and other medical facilities not owned or operated by the principal institution and included in the conceptual development plan. 2. Accessory Uses. The following uses shall be permitted as accessory uses in the above-described ID Institutional District. a. Restaurants and cafeterias, flower shops, gift shops, and candy, cigar, or magazine stands, but only when operated or located entirely within a principal building. b. As an accessory use to a medical institution, and allocated entirely within a principal building, facilities for the compounding, dispensing, or sale of drugs or medicines, prosthetic devices, lotions and preparations, dental care supplies, eyewear, bandages or dressings, and similar medical or health-related supplies. c. Group daycare center. d. All uses customarily incidental to the principal permitted uses in conjunction with which such accessory use is operated or maintained, but not to include commercial uses outside the principal building. B. Lot and Bulk Regulations Development of land in the ID Institutional District shall be regulated as follows: All buildings, structures, and activities shall be located in substantial conformance with the attached amended Campus Development Plan. C. Performance Standards The development and maintenance of uses in this ID Institutional District shall be established in conformance with Section 5-22 of the Unified Development Code and the following standards: Ordinance No. 50-16 Page 3 1. The storm water control shall be designed and built in accordance with City Regulations subject to review and approval by the City of Dubuque Engineering Department. 2. That appropriate erosion and sediment control will be installed prior to commencement of any land disturbing activity related to the subject project, including all required state and city permits related to erosion control. 3. New outdoor lighting shall utilize 72 -degree cut-off luminaries. 4. Landscaping shall be provided in compliance with Article 13 of the Unified Development Code. 5. All utilities, including telephone and cable television, shall be installed underground. 6. Final site plans shall be submitted in accordance with Articles 12 and 13 of the Unified Development Code. D. Parking Requirements The off-street parking requirements for the principal permitted uses for the herein described ID Institutional District shall be regulated as follows. 1. The number, size and layout of off-street parking shall be in substantial compliance with the amended campus plan. 2. Any significant expansion or reduction in the number of off-street parking spaces must be reviewed by Planning Services staff for compliance with the adopted Institutional District regulations. E. Siqn Regulations 1. Signage permitted in this ID Institutional District shall be as follows: a) Eleven freestanding signs with a maximum of 50 square feet per sign. b) One freestanding sign with a maximum of 100 square feet per sign. c) Twenty-five wall -mounted signs with a maximum of 50 square feet per sign. d) Four wall -mounted signs with a maximum of 100 square feet per sign. • Ordinance No. 50-16 Page 4 e) One wall -mounted sign with a maximum of 200 square feet. f) Directional signs, as needed, with a maximum sign area of 10 square feet and 10 feet in height. g) That all other sign regulations not herein identified shall conform to Section 16-15 of the Unified Development Code. 2. Signage allowed for the Kehl Diabetes Center building: a) Two (2) 50 square feet wall signs. b) One (1) 80 square foot monument sign 11 feet in height. F. Additional Standards That all previously approved campus development plans are hereby amended to allow for the attached campus development plan. G. Transfer of Ownership Transfer of ownership of property in this ID Institutional District requires rezoning of the property to an appropriate zoning district. H. Modifications Any modifications of this Ordinance must be approved by the City Council in accordance with zoning reclassification proceedings of Article 9 of the Unified Development Code. Section 3. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 4. That Title 16 of the City of Dubu- que Code of Ordinan- ces, Unified Develop- ment Code, be amend- ' ed by providing for the approval of an amend- ed -campus "develop;' , ment plan for the Fin - 'ley Hospital ID Institu- tional District, a copy of which is on file with the City of Dubuque Planning Services De -J partment. Section 2. Institutional District Regulations. A. Use Regulations The following regula- tions shall apply to all uses made of land in the above-described ID Institutional District: 1. Principal permitted uses shall be limited to: a. Hospitals b. Outpatient care fa -'I cilities. c. Office for adminis- trative personnel or other institutional em- ployees or affiliates. d. Classrooms, labora- tories, lecture halls, auditoriums and simi- lar places of institu- tional assembly. e. Off-street parking and loading. , f. Facilities and opera- tions for the diagnosis, care, and treatment of human health disor- ders, including exami- nations in operating rooms, physical thera- py or x-ray facilities, psychiatric treatment, convalescent care, and similar hospital -related uses. This provision shall include separate doctors' clinics, drug stores, and other medi- cal facilities not owned or operated by the principal ' institution' and included in the conceptual develop- ment plan. 2. Accessory, IJses. 1, The following uses shall be permitted as accessory uses in the above-described ID In- stitutional District. a. Restaurants and cafeterias, • flower shops, gift shops, and it candy, cigar, or maga zine stands, but only,', when operated or lo- cated entirely within a principal building. b. As an accessory use to a medical insti- I tution, and allocated entirely within a princi- pal building, facilities for the compounding, dispensing, or sale of drugs or medicines, prosthetic devices, lo- tions and preparations, dental care supplies, eyewear, bandages or dressings, and similar medical or health- related All suppliesusescu.stomari- c. Group daycare cen- ter d. ly incidental to the principal, permitted uses in conjunction with which such acces- sory use is operated or maintained, but not to include commercial uses outside the princi- pal building. B. Lot and Bulk Reg- ulations Development of land in the ID Institutional District shall be regu- lated as follows: All `:buildings,: struc- tures, and activities shall be located in sub- stantial conformance with the attached amended Campus De velopment Plan. C. Performance Standards The development and maintenance of uses in this ID,:Institutional Dis- trict shall is-trictshall be establish; ed in `conformance with Section 5-22 of the Unified Development Code and the following standards: 1. The storm water control shall be de- signed and built in ac- cordance , with City Regulations subject to review and approval by the City of Dubuque Engineering Depart- ment. 2. That appropriate erosion and sediment control will be installed prior to commence- ment of any land dis- turbing activity related to the subject project, including all required state and city permits' related to"erosion -con- trot 3. New outdoor light- ing shall utilize 72- degree cut-off lumina- ries. 4. Landscaping shall, be provided in compli- ance with Article 13 of the Unified Develop- ment Code. evelop-ment'Code. 5. All utilities, includ- ing telephone and ca- ble television, shall be installed underground. 6. Final site plans shall be submitted in agco,Sdanco ,wi AJiti- cles 12 and 13 of the Unified Development Code. D. Parking Require- ments The off-street parking requirements for the principal permitted, uses for the herein de- scribed ID Institutional District shall be regu- lated as follows. ( 1. The number, size and layout of off-street parking shall be in sub- stantial compliance with the amended campus plan. 2. Any, significant ex-, pansion or reduction in the number ' of off- street parking spaces must be reviewed by Planning Services staff for compliance with the adopted Institu- tional District regula- tions. E. Sign Regulations 1. Signage permitted in this ID Institutional', District shall be as fol- lows: a) Eleven freestand- ing signs with a maxi- mum of 50 square feet per sign. b) One freestanding sign with a maximum of 100 square feet per sign. c) Twenty-five wall- mounted signs with a maximum of 50 square feet per sign. d) Four wall -mounted signs with a rriaximum of 100 square feet per sign. e) One wall -mounted sign with a maximum of 200 square feet. f) Directional signs, as needed, with a maxi- mum sign area of 10 square feet and 10 feet in height. g) That all other sign regulations not herein identified shall con- form to Section 16-15 of the Unified Develop- ment Code. 2. Signage allowed for the Kehl Diabetes Cen- ter building: a) Two (2) 50 square feet wall signs. b) One (1) 80 square foot monument sign 11 feet in height. F. Additional Stand- ards That all previously ap- proved campus devel- opment plans are here- by amended to allow for the attached cam- pus development plan. G. Transfer of Own- ership' Transfer of ownership of property in this ID Institutional District re- quires rezoning of the property to an, appro- priate zoning district. H. Modifications Any modifications of this Ordinance must be approved by the City Council in accordance with zoning reclassifi- cation proceedingS eclassifi-cation-proceedings of -- Article 9 of the Unified Development Code. Section 3. The forego- ing amendment has heretofore been re- viewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 4.
