Gentlemen:
The petition of Farmers Supply
Company and others requesting re-
lief from parking in the vicinity be-
tween 9th and 10th Streets from
Central Avenue to White Street
was referred to the City Manager
and Police Department far inves-
tigation and report.
At the present time parking on
9th and 10th Streets is usually by
long time packers. The nature of
the Farmers Supply Company bus-
iness requires a turn over of park•
ing. In order that we can properly
enforce parking in this area, I rec-
ommend that parking meters be
installed on the south side of 10th
Street from Central to White
Street.

Gentlemen;
The letter of complaint from A.
J. Kisting as to access to his ga-
rage in the alley between Belmont
and Alta Vista was referred to the
City Manager for investigation and
report.
Upon investigating the condi-
tions as they exist in this alley
over a period of two weeks, there
was only one car parked in the al•
ley and this car was not parked in
front of Mr. Kisting's garage.
All the garbage and waste cans
that are the property of Mr. Hanley
meet the requirements of the or•
dinance governing garbage cans
and he has been notified to keep
them on his property except on the
days of collection.
I recommend that no change be
made in the conditions of this
area and. that "No Parking" signs
are not warranted.

The block between 15th and 16th
on Sycamore Street is being used
as a service station for the services
of large trticks and also for loading
and unloading of merchandise, Be•
cause of the nature of .this busi-
ness parking in this .block is not
practical, It, is recommended that
"No Parking At Any Time" signs
be placed on the West side of Syca-
more Street between 15th and
16th Streets.

of the Klauer-Julien Hotel Compa•
uy requesting a review of the loca-
tion of the truck route through the
City, namely on 2nd Street, was re-
ferred to the City Manager for irn
vestigation and report.
I have had this petition investi-
gated and find that routing of
trucks'over any other street would
tend to increase traffic congestion
at intersections that are not con-
trolled by traffic lights and also
be unsafe far use of truck traffic.
West 2nd Street is very desirable
as a truck route because of its
physical characteristics, lack of
congestion and the small number
of pedestrians and amount of ve-
hicle traffic. The traffic light at
2nd and Locust Streets aids in the
safety operation of trucks at this
intersection, The wide intersection
of West 2nd and Bluff Streets al-
lows trucks to turn into Bluff
Street without using the entire
width of the street,
Other streets in this area have
been proposed as truck routes but
their physical characteristics make
consideration of thee. use imprac•
ticah
It is recommended that no
change be made in the alternate
truck route that now exists.

Mr. E. Marshall Thomas ad-
dressed the Council in behalf of
the Klauer Julien Hotel Co, rela-
tive to re-routing trucks on streets
away from the hotel. It seems that
the biggest problem was at night
and the noise from the trucks
caused considerable inconvenience
and nuisance to guests at the
hotel..
Councilman Welu moved that
the recommendation of the City
Manager be approved and that
local trucking. concerns be con-
tacted and suggest that they take
alternate routes until the paving is
completed at the south end of the
City thereby giving the hotel tem-
porary relief, Seconded by Coum

Gentlemen;
The petition and letter from the
City of East Dubuque requesting
consideration of a mutual aid fire
protection plan between the two
communities was referred to the
City Manager and Fire Chief for
investigation and report.
Ordinance 3-50 that authorizes
the use of fire apparatus specifies
that this protection is only granted
to places located in Dubuque Coun-
ty. It stipulates the amount that
is paid by owners of property out-
side the aty limits requesting fire
protection. I feel that any agree-
ment should follow this ordinance.
In an opinion by Mr. Nelson, the
police power of the State of Iowa
does not extend in the State of
Illinois and consequently any fire•
man in the City of Dubuque en-
gaged in the activities of a fireman
in Illinois would not have the pro•
tection of police power, and would
have the status of a volunteer. He
would be exposed to a claim for
damages for acts committed nec-
essarily incident to fighting a fire
or proceednng to or from afire.
It would seem necessary for the
States of Illinois .and Iowa. to en•
act proper legislation authorizing
the entering into of any such com-
pact before the .City of Dubuque
proceeds with any agreement with
the City of East Dubuque...

The offer of Carl B. Haught for
the purchase of Lots 3, 4 and 5 in
Kringle's Subdivision was referred
to the City Council to view the
grounds.
Upon viewing the grounds it was
the decision of the Council that
they would agree to sell the prop-
erty provided all special assess-
meets are paid for, such as sealer
and water connections to the lots
plus a minimum of $150.00.
I recommend that the decision
of the Council be confirmed and
that proper proceedings be pre-
pared.

Gentlemen:
I have had a request for the in-
stallation of a street light at the
intersection of Ghappel Court and
Kleine Street. This request was in-
vestigated by the Electrical In-
spector and because of its peculiar
location, a light would be desir-
able,
I recommend tl-,at a light be in•
stalled at the intersection of Chap-
pel Court and Kleine Street.
I have also had the lighting con-
dition on Shiras Avenue from Lin•
Coln to the city limits investigated,
This area has been built up con
siderably since the time the lights
were originally installed and. there

is alarge volume of traffic using
this stroet going to and from Eagle
Point Park,
1 recommend that the lights oh
this street be changed so that
the spacing of the lights Will be of
an interval which would neeessi•
tote the installation of five addi•
tianal street lights.

lights that has been approved by
the Iflectrieal Inspector and the
lighting engineers of Interstate
Power.

Gentlemen:

requests aro made for salary ad-
justments; It is difficult to deter-
mine an equitable basis for com•
paring salaries of various city em•
ployees with each other and also
private industry and other mu•
nicipalities, It is desirable to have
a position classification plan and
a pay plan that can be used as
a guide in making decisions re-
garding advancement in salaries.
I have investigated with compa•
nies providing this type of service
and feel that it would be in the
best interests of the City to have
a classification and pay. plan pre•
pared for the City of Dubuque.
I recommend that the City Coun•
cil authorize the City Manager to
enter into an agreement with the
Public Administration Service to
perform this work at a cost of ap•
proximately $3,000.00,

the Planning & Zoning Commission
recommends approval of said peti-
tion by City Council, providing
proper restrictions be placed in
the deed to prevent said Dubuque
Laundry & Dry Cleaners or other
owners from ever placing perma-
nent structure on same which
might necessitate eventual loading
and unloading on the 9th St, right-
of-way. The use for off-St; loading
involves no objections. Possibly
some sort of a lease. deal would
serve to hold to the City futtue
control of occupancy and use of
this area,

Gentlemen:
I have investigated the claim of
Mrs, Sadie Albert, 1812 Central
Avenue, for damages. sustained
when she fell in a defect at Eight-
eenth. and Central Avenue April
2nd,, 1957. and find that the defect,
as claimed, existed and that .the
claimant sustained_a laceration of
the internal lateral ligaments of
the right knee, which incapacitated
her from working for a substantial
period of time,
I also find that in addition to her
lass of time, and pain and suffer-
ing, claimant has incurred medical
expense in connection with the
injury.
I have discussed the matter with
claimant and she has agreed to ac-

I recommend that this settlement
be approved and the Auditor in-

Gentlemen:
1 have examined the elainl of
Mrs. Eva Chapman for damages
sustained in a fall on the ice
March 23, 1957 and find that Mrs.
Chapman fell as alleged and sus-
tained a fracture of tke right fe-
mur which required hgspitalization
for 12 days and wearing a cast for
8 weeks.
I have discussed the matter with
the Chapmans and they have
agreed to accept in full settlement
$310.50 which represents their
medical and hospital expense,
I recommend that this settle-
ment be approved and the auditor
be instructed to issue a warrant
payable to Eva Chapman and
Charles Chapman, husband and
wife, in the amount of $310.50 and
deliver the same upon receipt of
a properly executed release,

Luksetich addressed the Council

quisition and maintenance of a
building for a Iistorical Museum.
They seemed to be of the opinion
that the acquiring of a suitable
building for a museum would not
be as great a problem as the maim
tenance of same, They were ad-
vised that there is no provision in
the Code for support of a museum
other than if it is in a library. The
legal obstacle would be upgn con•
ditign of maintenance.

BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF DU-
BUQUE:
Section 1, That Agnes R. Dugan, as
owner of
Southerly 41 feet of Lot 1 of the
Subdivision of Lots 45 and 46 and the
Southerly 41 feet of the Westerly 45
feet of Lot 47 in Julia L. Langwor-
thy's Addition in the City of Du-
buque, Iowa, acoording to the re-
corded Plat thereof.
be and she is hereby granted per-
mission to construct a retaining wall
in Solon Street abutting said prop-
erty, six feet from the north curb
line subject to the following terms
and conditions:
(a) That said wall be constructed
under the supervision of the City
Manager;
(b) That the permission herein
granted is revocable by the City
Council whenever it shall be deter-
mined that the public interest re-
quires;
(c) That, in the event the permis-
sion herein granted is revolted, the
permittee for herself, her successors
or assigns agrees to remove acid wall
at her expense, within a reasonable
time and in the event of her failure
so to do the City may remove the
same and assess the cost of such re-
moval against the first above de-
scribed property.
Section 2. That this Ordinance shall
be in full force and effect upon its
passage and publicat[on as provided
by law and the acceptance of the
terms and conditions in writing by
permittee.

Whereas the contract heretofore'
entered into by the City of Du-
buque, Iowa, for the improvement
hereinafter described has been
completed and the City Manager
has certified the completion there-
of to the City Council and the City
Council has ascertained the cost
thereof and has determined that
$21,029,50 Dollars of the cost
thereof shall be assessed against
the property subject to assessment
therefor; and

vice Co,, addressed the Council as
to what could be expected in the '.
line of gas rate reduction, He stat- ~
ed that the company had a sub•'
stantial deficit in 1954, im 1955 the
deficit was considerably less and
in 1956 they experienced a return
of 4VZ % to 5%, The profit that
the company realized in 1956 has
been put back into the City for
mains and services. Costs have
gone up considerably and it is
possible that they may have to
raise the rates if the supplier to
them is allowed to raise his. They
are however considering a reduc•
tion in step 2 of Schedule 1. Any
reduction of schedule 1 must be
picked up in schedule 2, He would
much prefer to outline proposals
with the City's consulting firm of
Laramore and Douglas. and then
come back to the Council with a
more definite proposal at a later
date.
Mr, Charles E, Coffey of Deb-
orah Drive, addressed the Council
as to his claim, as the result of
water over-flow on to his property
and was wondering if there could
be some action taken by the Coun-
cil in conjunction with the build-
ers, relative to the present condi-
tion of the catch basins in the
street.

annual budget for the fiscal year
beginning January 1, 1958, and
ending December 31, 1958, based
on tho estimated income aad; ex•
penses of the various departments
of the City of Dubuque.

This budget has been prepared
after considering the requests. of
the various boards and commis-
sions and city departments in re-
gard to their overall expenditures
for the year 1958, In submitting
the budget for 1958, I would like
to call your attention to several
increases in expenditures that
ahould be considered by you in ap•
proving the overall budget.
First, the budget has been pre-
pared considering a reduction in
the work week. from 44 hours to
40 hours, This reduction is in line
with the trend that has been in ef-
fect for several years, in fact, Du-
buque is one of only 17 cities out
of 121 in the United States in the
50 to 100 thousand population class
that work over 40 hours per week,
In the State of Iowa there is only
one other city of over 50 thousand
population that works more than
40 hours per week. This reduction
in hours will in turn mean an in-
crease in personnel to perform the
same amount of work.
In the General Fund the increase
in the askingS is $31,947.00, This
is due to fund's that will be needed
in the next two years in anticipa-
tion of constructing a new city
garage. Some of these funds will
also be used for an adjustment in
salary due to the decrease in
hours.
The Street Fund expenditures
have. been increased. first in the
amount of $10,000,00 for the pur-
chase of equipment that will be
needed to spray trees upon the
streets that would be affected by
bhe forthcoming dutch elm disease.
This $10,000.00 appropriatio nthis
year will have to be supplemented
by an additional $20,000.00 appro•
priatfon the following years in or-
der just to protect the trees on
the streets. The Paric Board will
also have to increase their appro•
priation far this control work on
bhe trees and' for the work that will
be necessary to do in the park
areas.
There is also an item of $50,000.-
00 which is an increase of $40,000,00
over the present budget for the
preliminary engineering work to
be done on the construction fo a
14th Street overpass. and a Feng-
ler Street overpass. Both of these
projects will be necessary to con.
nect the new industrial island and
the Peosta Highway to existing
street systems and in order to pro-
vide access without being cut off
by railroad traffic,
The expenditures in the Public
Safety Fund are those of the Po•
lice Court, Fire Department and
Police Department, These amounts
in the budget of course are higher
than any other due to the number
of employees in these two depart-
ments, The State Legislature re-
duced the number of hours of work
for firemen from 743/4 hours in Du•
buque to 68 hours per week. This
will necessitate the employment of
additional firemen in order to
perform the same type of service
that is now being carried on by
the Fire Department.
For many years the Nationa4
Safety Council has recommended
additional policemen in order to
adequately serve a city the. size
of Dubuque. The number of police
officers that they have recom-
mended we feel have been out of
line with our needs, however, it
is recommended that the budget
include funds to provide eight ard'-
ditional policemen for 1958, The
total amount of additional money
needed in the Public Safety Fund
to accomplish these two purposes
and also to provide a police court
office amounts to approximately
$73,000:00,
I recommend that before Jan•
nary 1, 1958, a study be made to
determine whether or not it would
be practical to employ public safe-
ty officers that would act as police-
men and serve as auxiliary fire-
men rather than appoint men to
each department, There are many
cities in the United States that
have such a plan in effect and' bhey
are working quite satisfactorily.
I would however, recommend•that
a study be made and that the Po-
lice Chief and Fire Chief be in-
cluded to make this study. The
main purpose of this study would
be to determine whether the same
amount of efficiency could be ob•
tained and also the amount of
money it would save the taxpay-
ers of Dubuque by having this. type
of a service,

In the Sanitation Fund it is rec-
ommended that ad~d'intional appro•
priation be made to start the
work on the 14th Street and B
Branch sewers that are in need
of being covered. Ths work would
coordinate in the extension of 14th
Street east of the proposed viaduct
and to connect up to the new Peos-
ta Highway. Additionl funds are al•
so needed in this fund due to the
decrease in the number of work
hours per week.
Umder Municipal Enterprise
Fund which includes the Library
Board, the Dock Commission and
the Airport Commission, there is
just a small amount asked for an
increase in these budgets. This is
due to the decrease in the number
of work hours per week. The Dock
Commission has an item in their
budget of $4,000.00 to pay for one-
half the cost of rehabilitation of
the old Shot Tower Building. The
balance of these funds would be
contributed by general solicitation.

The Airport Commission has suf-
ficient funds on hand in order
that they can construct a new
hangar to house larger type
planes, This hangar will cost in
the neighborhood of $80,000.00. It
is my feeling that after this year
the expenditures of the Airport
Commission can be curtailed quite
extensively because of the condi-
tion of our airport, I feel that it
will not be necessary to make any
great capital improvements upon
the airport as it is in excellent
shape until such a time as in-
creased traffic warrants such an
additional expenditure,
'Phe expenditures of the Recrea-
tion Fund which includes those of
the Park Board and Recreation
Commission show a small increase
due to the decrease in the work
hours per week. The Recreation
Commission contemplates the im-
provement of rest rooms facilities
at the ball park and also the con-
struction of a sun bathing area at
the Municipal Swimming Pool at
Eagle Point.
An Additional expenditure of
$2,000.00 in the Utility Fund is for
the installation of additional street
lights in 1958.
In the Trust and Agency Fund
which includes all expenditures for
pensions including police, fire,
state and old age, social security
payments, shows an increase of
$15,000.00. This is due to the in-
crease percentage that is required
under the social security program
and also that the police and fire
benefits that were increased by
the last Iowa Legislature. These
pension funds must be kept on an
actuarially sound basis and this
we have attempted to do through
the last several years.
The Debt Service Fund shows
an increase of $5500.00. This is due
to the schedule of bond retirement
which includes this amount of ad•
ditional bonds to be retired over
those of 1957.
The total amount of mosey that
will be necessary to provide the
same level of services that we
have in the past and also to give
city employees the same pay and
benefits that are derived by work-
ers in other types of employment,
it will be necessary to raise an ad-
ditional $128,733.79 in tax monies
during the year 1958,.
The tax rate for 1938 will be
worked out on the basis of the
new valuations that were assessed
by the City Assessor fur values of
1957 on all property within the City.
These values are considerably
higher bhan those of 1950, anr~ wiPl
as a result, necessarily. mean a
decrease in the amount of millage
that is levied against each piece
of property. With the normal in-
crease in valuations due to new
construction, there will be a slight
increase in the amount of money
that will have to be raised from
taxation.

BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF DUBU-
QUE:
Section 1. That H. E. Thompson and
Florence P. Thompson, husband and
wife, be and they are hereby granted
(8") vitrified tale pipe sanitary sewer
in Fremont Avenue, from the existing
manhole, located in front of Lot L of
Lot 7 of Sisters Addition on the west
the right to construct an eight inch
side of Fremont Avenue along Fre-
mont Avenue for a distance of 182
feet northerly to Lot 6 of Sisters Ad-
dition. upon tho following terms and
conditions:
(a) That grantees agree to con-
struct said sewer within one year
from the date of the adoption of this
Ordinance and to pay the entire cost
thereof, including the cost of restor-
ing the surface of the street;

rtructed in accordance with plans
approved by the StateDepartment of
Flealth and the City Manager and
ender the supervision and direction of
the City Manager and Clty Engineer;
(c) That grantees will enter into a

wnfch contract, among other things,
will contain a clauae requiring the
contractor to obtain all necessary per-
mits required by the City of Dubuque,
or any other governmental agency, a
clause obligating the contractor and
his bondsmen to keep said sewer in
good repair for a period of not less
than two years from the date of the
acceptance of the work, and a clauae
requiring the contractor to Yurni@h a
surety bond with the City of Dubu-
buque named as one of the obligees,
guaranteeing the faithful performance
of said contract;
(d) That upon completion of said
sewer and the acceptance of the same
by the City Council said sewer shall
became a public sewer under the
exclusive charge and control of the
City of Dubuque, and its free use
as such shall not be interferQd with
by grantees or their successors or
assigns;
Sec#ion 2. That the autho;•ity grant-
ed herein shall terminate on Septem-
ber 1st, 1957 unless the terms and
conditions of this Ordinance are ac-
cepted in uniting by the grantee prior
tq that date;
Section 3. This Ordinance shall be
in full force and effect from and
after its final passage, adoption and
publication as provided by law,

buque and the North Central Pub-
lic Service Company. This Agree-
ment releases the easement for a
gas main along Chaney Road north
of Kaufmann Avenue,
This easement was obtained prior
to the time when a street existed
at this location and provides that
in case it would ever be necessary
to remove or change the elevation
of the main, the City would reim-
burse the North Central Public Ser-
vice Company for this expense.

party" and North Central Public

ferred to as "second party," Wit-
nesseth:
Whereas, second party is the
owner of a franchise from first par-
ty to maintain gas mains in the
public streets of the City of Du-
buque, Iowa and
Whereas, under the provisions of
Paragraph 11 of said Franchise Or-
dinance, second party is required,
inter olio, to relocate its gas mains
in the event of change of street
grade; and

owner of an easement in Lot 2 of
the Subdivision of Mineral Lots
371, 371A and 374 in the City of
Dubuque, Dubuque County, Iowa,
for gas mains and pipes with re•
spect to which the provisions of
said Paragraph 11 are not applic-
able; and
Whereas, a portion of said Lot 2
of the Subdivision of Mineral Lots
371, 371A and 374 in the City of
Dubuque, Dubuque County, Iowa,
has been conveyed to the first par-
ty and established as a public street
known as Chaney Road; and
Whereas, second party's gas main
in what is now Chaney Road has
been lowered to the grade of said
street; and
Whereas, the second party was
requested to release and vacate that
portion of its said easement which
now lies in Chaney Road, and as an
inducement thereto the City of Du-'
buque, Iowa, agreed to protect sec-
ond party from the expense of re•'
locating said gas main on account
of any future change of grade of
sold street; and
Whereas, second party has, at the
time of the execution of this agree• ~'~
ment, released and vacated that
portion of said easement which
now lies in Chaney Road;
Now Therefore, in consideration
of the premises and of the vacation ',
of said portion of said easement by
second party, First party agrees to
reimburse second party for any ex-
pense of relocating its pipes or
manic in Chaney Road from Kauf-
mpnn Avenue to Kane Street made
necessary by any subsequent
change in grade in said portion of

the tabulation of the bids received.
Action on the awarding of this
contract was postponed at the meet-
ing of July 1st, 1957, so that time
could be had to negotiate with the
abutting property owners. This hav-
ing been done it was agreed by the
Milwaukee Railroad Company that
they would do Item 8 Track Cross-
ings with their own forces,
I, therefore, recommend that the
contract be awarded to Schueller &
Company, of Dubuque, Iowa, who

Gentlemen;
Mrs. June Bull, operator of the
Golden Eagle Tavern at 779 Iowa
Street, operates under Beer Per-
mit No. 122 issued on January 1,
1957. During the time January 1,
1957, and July 3, 1957, the Police
Department has had several com•
plaints about this tavern operat-
ing their juke box very loud and
permitting dancing contrary to
city ordinance. The operator was
warned to discontinue this pray
lice.
On July 3, 1957, police officers
were investigating another com•
plaint of this tavern and they ob•
.served several minors drinking
beer in the Cavern. The officers
filed a charge of violating Section
19 of Ordinances 935 which is
selling beer to minors, As a result
of this charge, Mrs. June Bull was
found guilty in Police Court on
July 19th and fined $100,00 in cost.
At the present time this case has
been appealed to the District
Court.
In view of the above informa-
tion and the complaints that we
have received on the operation of
this tavern, and upon the recom-
mendation of the Police Chief, I
recommend that the City Council
revoke the beer permit of Mrs.
June. Bull.

structed asanitary sewer from
Asbury Street to Lindale Street
on a location that Mr. Clarence
Arlan dedicated as Evergreen.
Drive.
Special Session, July 25,1957
An Agreement was reached with
Mr. Arlen that as each lot was con-
nected to this sanitary sewer, a
charge of $1.78 per foot would be
made. Mr. Arlen has since sold this
property and the present owners
are selling lots, and in order that
the people buying these lots will
be informed of this charge, I rec-
ommend that the attached resolu-
tion be approved.
The cost of $1.78 per foot is less
than the city's cost of constructing
this section of the sewer and no
portion of this cost was assessed
to any of the benefited property.

things, that Arlen would pay a
connection charge in the event
he should subsequently connect
house laterals to said sewer; and
Whereas, the City Manager has
reported to the City Council that
the cost of installing said sewer
when apportioned to the property
fronting thereon is $1.78 per front
foot; and
Whereas, the City Council has
determined that it is in the best
public interest that a connection
charge be exacted as a condition
to connecting house laterals to
said sewer;

nor Loveless, expressing his per-
sonal thanks tb Mayor Dove for
calling a traffic safety inventory
meeting, presented and read.

telegram and moved that same be

Mr. Phil Streit of the National
Safety Council addressedthe Coun-
cil relative to the traffic situation,
showing by a graphic chart, how
the City Safety Program has not
kept pace with a so-called average
city, as compared tb a year ago.
The traffic picture as painted by
Mr, Streit showed a net loss of
about a million and a quarter dol-
lars during the past two years as
the result of traffic accidents. This
heavy loss was due to the rise
in traffic accidents in the City.
The report showed 222 persons in-
jured in accidents during the year
1956. This would be 37 persons
above the average of 185 for the
preceding three years, Although
only two death were recorded in
1956 Mr. Streit pointed out that
this is not a sound measure of the
traffic situation in the City. Mr.
Streit was noticeably critical of
the traffic supervision of the City,
mentioning the fact that the ris-
ing trend in accidents has not been
matched by a corresponding in-
crease in traffic officers. He rec-
ommended that 35 officers be add-
ed to the present farce of 49, five
of the additional officers should
be assigned to traffic duty. He
further recommended that an of-
ficial be appointed to coordinate a
traffic engineering program. He
did commend the Council on the
adequate parking facilities as
they now exist in the City. He
further recommend more co-ordi-
nation of traffic signals also mare

violation convictions with penal-
ties even down to the conviction
of pedestrian violators. Mr. Streit
complimented all those concerned
with the low loss of only $27,000
from crime that was recorded in
the City during the past two years.
The school safety phase of the
traffic program should recruit a
qualified person who would be re-
sponsible far the task of supervis-
ing safety education both in the
public and parochial schools. Driv-
er education courses should be
made a part of the school curricu-
lum.
Mr. Arthur Trausch, vice presi-
dent of the Dubuque Automobile
Club presented the Council with 9
pedestrian safety award, for the
year 1956.
