Douglas, representing a special
committee of the Dubuque Cham-
ber of Commerce read the follow
ing communication.
August 5, 1957.
As a special committee of the
Dubuque Chamber of Commerce we
first want to express our apprecia-
tion to the City Council and City
Officials for the conscientious and
foresighted job that they have done
during a very crucial time in the
history of our city. Many projects
of vital importance to the future
of the city have been completed
and others initiated. Such a pro•
gram for the future costs money
and we know that this increases
the costs of City government. The
proposed 1958 budget far the City
of Dubuque is increased $450,569
or 12% with the tax asking up
$128,000 or 6.6%, It is staggering
to consider that the combined bud•
get increases of the three taxing
bodies total over one million dol-
lars far 1958 with total tax askings
up $715,820.
As you know, this committee af-
ter reviewing the Dubuque County
budget protested that budget on
two counts; first, the inequities of
the appraisal values between city
and county and, second, the 31%
increase in monies proposed to be
raised by taxes for county opera-
tions, We intend to carry this mat-
ter to the State for review.
The committee has reviewed the
proposed City budget and has con-
cluded that it will not protest the
budget as presented. However, we
request that .the City Council and
City Manager consider the follow-
ing points:
1, It is requested that the City
Council do everything possible
to bring city and county prop-
erty onto the same appraisal
base. We would suggest that a
formal request be submitted to
the Board of Supervisors by the
City Council asking that the
county property be reappraised
on the same basis as the city
appraisal,
2. We know that the City Council
is anxious to attract new in•
dustry to Dubuque and to in-
terest our present industries in
expanding in Dubuque. This,
along with the general public
welfare, necessitates a close
control on rising taxes, We hope
that the City Manager will con-
tinue to analyze every depart-
mental budget thoroughly be-
fore inclusion into budget totals
and to review the expenditures
under these budgets regularly.
In conclusion, we want to ex•
press our appreciation to the City
Manager for providing detailed in•
formation on the 1958 budget and
explaining items of increase. We
know that the combination of ef-
ficient and forward looking govern-
ment with interested and partici-
pating citizens will make real pro-
gress passible for Dubuque..
Special Committee of the
Dubuque Chamber of Commerce
Mr. George J. Hohmann of Loras
Blvd, addressed the Council object-
ing to the recent appraisal made
on City Property.
Tony Helling of 2390 Green
Street addressed the Council stat-
ing that if the new State law re-
duces the number of working hours
for the members of the ,fire de-
partment, thereby creating an in-
crease in expenditure in the public
safety fund, approximately $73,000,
how about the police department.
Mr. James Flynn of 806 Lowell
Street addressed the council, stat-
ing that he was told when the real
estate values were re-appraised
even though the values would be
increased the taxes would remain
about the same.
Mr. Dick Henschel of 690 Sulli-
van Street addressed the Council
by stating that if the taxes are
raised it would mean that rents
here in the City would be increased
from five to ten percent. He also
made inquiry about paying for
sewage rental when the plant is
not in operation as yet.
Gene Wright, attorney, repre-
senting the Dubuque Real Estate
Board stated that the Board re-
ceived many complaints from ten-
ants. He declared many residents
feel a breach of trust exists as to
the amount of taxes to be paid in
1958. Many citizens were led to be•

IIeve that the millage rate would be
around 65 after the property values
were re-appraised. With the new
budget however the mill rate would
be about 71. He suggested that the
Council review the budget item by
item and publish same. If there
is any way the situation can be
corrected it should be done,
Mr. Peter J. Takos of 1500 S.
Grandview Ave. addressed the
Council declaring that the time
has come to tighten up.
Mr. Les Hartley of 1960 Ungs
Street addressed the Council con-
curring in the remarks made by
Attorney Eugene Wright.
Charles Allen of 122 Princeton
Place, a comparative new comer
to the City, stated that his taxes
have practically tripled since he
came here.
Wayne Norman suggested that a
formal request be submitted to the
County Board of Supervisors by the
Council asking that the County
property be re-appraised on the
same basis as the City,
After considerable discussion on
the subject of the budget Council-
man Schueller moved that final ac-
tion on the budget be postponed
for another week to August 12,
1957 at 7:30 o'clock P.M. Daylight
Saving Time in the Council Cham-
ber at the City Hall. Seconded by

Gentlemen: On January 10, 1957
Mrs. Dorothy Rausch filed her
claim against the City for damages
sustained in a fall in a claimed
defect in Elm Street,
Upon investigation I find that
Mrs. Rausch sustained multiple
fractures of the right humerus,
causing her to incur medical ex-
pense in the amount of $140, and
suffer loss of wages in excess of
$900; together with the attendant
pain and suffering and permanent
disability,
I have had discussions with the
attorneys for claimant and they
have agreed to accept the sum of
$1,000 in full settlement.
I recommend that this settle-
ment be approved and the Auditor
instructed to issue a warrant in
the amount of $1,000, payable to
Dorothy Rausch and Edward Failor,
her attorney and to deliver the
same upon receipts of a properly
executed release, which release
should be joined in by Mr, Arnold
Rausch, the claimant's husband,

Gentlemen:
At the Council meeting held July
1st, our company discussed certain
changes which were under consid-
eration with respect to the gas
rates at Dubuque, Iowa, Since that
time,. we 'have had a number of
discussions with Mr. Eugene C,
Lang, of Laramore, Douglass and
Popham, your consultants.
As outlined ~ta you in the meet-
ing of July 1st, Northern Natural
Gas Co., our suppliers of natural
gas, has petitioned the Federal
Power Commission to increase the
cost of contract demand far natural
gas 51'/z cents per MCF, or from
$2,36 to $2,87~Z, Thjs increase will
become effective during August
27, 1957, and if sustained by the
Commission; will mean an addi-
tional cost of gas to our company
for the Dubuque: Division of $30,-
900.00 annually. In addition Ito this
increase cost of gas, our labor rates
were recently increased.. approxi-
mately 7riz%, aggregating over
$12,000 annually, Steel prices were
increased effective the 1st of July
at approximately $8.00 per ton, A1-
so, other materials and supplies
used by the gas company, as well
as taxes will be increased.
Notwithstanding these increases
in our costs, in accordance with
our discussions in the City Coun•
cil of almost one year ago, our
company is now proposing certain
changes in the rates. set forth in
Schedule I. This reduction, it is
proposed; be made in the second
step of 4,000 cubic feet from $2,50
per MFC to $2.00 per MFC. No
further changes are proposed:. in
Schedule h Should ,this proposal
be approved by the City Council,
it will make a rate reductioh of
$23;000,00 to $25,000.00 annually
and will effect approximately 4000
customers. The largest decrease in
rates to a single customer will be
$24.00 per year. The amount of
such savings will vary in propor-
tion to the customer's use of gas.
Faced with this additional in-
crease in the cost of gas and other
materials, as well as the reduction
in revenue in Schedule I, our com-
pany sees no alternative buf to
change Schedule II to some ex-
tent. It is now proposed that the
following be ;the rates under Sched~
ule II:

change proposed
Next 4,000 cubic feet-$1.65 per
MFC, 2nd and 3rd' step com-
bined and increased
Next 45,000 cubic Meek-$.85 per

I would like to point out that the
change in Schedule II, if approved
by the City Council, will not re-
cover for the company the in-

creased cost of gas, labor, material,
etc,, and recover hhe reduction in
revenue which is proposed by
Schedule I, Our company can only
recover these additional costs and
the reduction in revenue by in-
creasing the load and adding addi-
tional customers to Schedulo II.
From a technical standpoint, the
Schedule II rates do not increase
the cast of gas for heating pur-
poses if the customer is using gas
for other purposes, inasmuch as
the steps above 5,000 cubic feet
are not changed.
Our company is joining with
other companies in an effort to re•
duce hhe proposed 613'a cents in-
crease being collected by Northern
Natural Gas Co,, and if they are
successful in this endeavor, be•
cause the above changes and addi•
~tional costs increased for other
items will not be recovered, our
company feels that any refund
should be retained by it.
Our preliminary estimates, based
upon 6 months actual for 1957 and
estimated for the remaining 6
months, indicates that the com-
pany, even if successful in adding
the anticipated load will make less
than a 6~Z% return on its proper-
ties, such rate of return gives no
effect ho the changed valuations
and price levels, nor any effect to
the losses experienced during the
developmental years of 1954 and
1955,
As previously. stated, these rape
matters have been discussed with
Mr, Lang, of 'Laramore, Douglass &
Popham, and Mr. Schiltz, the City
Manager, It is hoped that they
are in accord with proposals pre•
sented by our company.

the North Central Public Service
Co. to make certain adjustment in
Schedule I and Schedule II of their

Based upon operations for -the
calendar year 1956, i~t was deter-
mined that the proposed changes
in Schedule I would result in a
reduction in revenue of an esti-
mated $23,552.00 for the full year

ing the entire year, thus confirm-
ing the Company's statements rela-
tive to these changes,
Based upon operations for the
first six months of the current
year, these changes should result
in an estimated reduction of $21;
770.00 in revenue, had they been
in effect for the full twelve months
because of hhe fewer number of
customers taking gas under phis
schedule than in 1956,
Combining the second and third
steps of Schedule II into one step
whereby the firsh 4,000 cubic feet
of gas after the first 1,000 cubic
feet are ~to be charged for at the
rate of $1.65 per 1,000 cubic feet,
based upon operations for the year
1956, would result in an estimated
increase in revenue of $30,396,00,
or $6,844.00 in excess of the reduc•

Considering Schedule II changes
for the calendar year 1957, and
predicted on the first six months of
the year's operations, it is estimated
that, had they been in effect for
the full year, they would produce
an increase in revenue of $41,-

the proposed changes in Schedule

the city border effective August
27, 1957, as the Northern Natural

Expenditures for the fiscal year
beginning January 1, 1958 and end-
ing December 31, 1958 and to con•

Two, final action on both of the
above mentioned items being de-
ferred from the regular meeting of
August 5, 1957, and acting on any
other business as may properly
come before the meeting.

Gentlemen: After carefully re-
viewing the Budget Estimate for
1958 with your honorable body and
considering each budget item; also
considering the services now pro-
vided by the City and the welfare
of all city employees, it was the
unanimous decision of the Council
that the budget was carefully pre-
pared and all items were necessary
for the efficient operation of the
City.
Because the total increase in
taxes of all local taxing bodies has
caused objection to the city budget,
certain items of capital expendi•
tures can be deferred for one year
or to a later date. These items ins
elude reduction in the General
Fund of $40,000,00 for part of the
cost of a city garage to house city
equipment; Street Fund of $40,000:
00 for part of the cost of engineer-
ing and property acquisition for
the 14th Street and Fengler Street
overpass; Sanitation Fund of $25,-
000.00 for part of the cast of cover-
ing the 14th Street sewer; Muni•
cipal Enterprise-Dock Commisisoh
of $4,000,00 for the city's portion
of rehabilitation of the Shot Tower
and the Municipal Enterprise-Air•
port Commisison of $9,050,00 for
part of the cost of a new hanger.
These items add up to a total of
$118,050.00 which more than off-
sets the tax increase because we
would have had a normal valuation
increase in 1956 through new con-
struction to more than offset the
difference of $10,683.79 between
the published budget estimate and
the proposed changes,
There should be an increase in
the budget of all additions to the
Pension Funds of $15,353.50 and
to the Debt Service Fund of $25,-
950.00 or a total of $41,303.00.
These additions however have been
absorbed in the proposed changes.
These proposed changes will re-
duce the tax millage from 35.624
mills for 1957 to 30.150 mills for
1958, or a reduction of 15:4%.
I recommend that the decision
of the Council be confirmed to
defer the capital improvement ex•
penditures and delete them in the
amounts listed from the 1958 Bud•
get,

Gentlemen; After the Council
Meeting adjourned on Monday, Au-
gust 5th, your City Manager, Mr.
L, J. Schiltz advised me the Coun-
cil had further discussions relative
to the gas rates in the City of Du-
buque. Mr. Schiltz stated that the
Council had requested him to con•
fer with representatives of North
Central Public Service Co, and to
suggest modifications in the com~
pony's proposals.
Briefly stated, these proposals
were to proceed with the reduc-
tion in Schedule 1, as presented to
the City Council; but for Schedule
2 proposals be made to reflect only
the increase that would result from
the application of the escalator
clause in the rate ordinance. It was
also suggested that the sales pro-
motion expenses be reduced to off-
set the additional expenses for
gas cost, labor, material, taxes, etc.

After the conference with Mr.
Schiltz, Mayor Dove had further
discussions with respect to the same
question, at which times the effect
of the increase in Schedule 2 on
the load building program of the
company was reviewed, After
the discussion with both Mr.
Schiltz and Mr, Dove it was stated
that the matter would be presented
to the Management of North Cen•
tral Public Service Co., and the re•
salts transmitted to the City Coun•
cil.
We have considered the pros
posals made and do not believe it
would be to the best interests of
our Company and its customers in
the City of Dubuque to altar our
proposals. In this connection, we
would like to 'point out that the
sales promotion expenses includes
not only the advertising but the
entire cost of our heating depart-
ment, their salaries, rental, taxes,
etc. Therefore, if the Company were
to eliminate all of its advertising,
which apparently some feel could
be done, the savings would be less
than 40% of the total sales promo-

tion expense. Were it to curtail its
sales promotion expenses, as sug-
gested, only a limited portion of
the additional expense which would
be. incurred by it would be re-
covered.
We assure you that, notwith-
standing the Council's interest in
the load building accomplishments
of the Company and your consult-
ants views on the question, no one
is more vitally interested in the
load building program than the
Management of our Company. The
effect of this increase has been
studied far a period of several
months, and bill studies have been
made to determine the effect. It is
the Management's feeling. that the
proposals made on Monday, August
5th, are necessary and aprpopriate.
We hesitate to labor the situation
but believe it necessary to again
point. out that the increased cost,
which the Company. will sustain
during the next 12 months, will not
be offset by the proposed increase
in Schedule 2. It is the Manages
ment's belief that teven if the load
building program estimated by the
Company is successful, the addi-
tional costs'will not be recovered
until the end of 1958. Please re-
member these additional costs not
recovered are in adidtion to the
loss in revenue the Company will
sustain by the reduction of the
rates in Schedule 1.
Our Management was somewhat
disappointed that the proposals
made to the City Council, regard-
ing the proposed rate changes,
were not approved. These pros
posals, we assure you, were the re-
suIt of, considerable studies on the
part of our staff and several dis-
cussions with Mr, Eugene Lang of
Laramore, Douglas, and Popham
Inc., your rate consultants. At no
time during our discusisons with
Mr, Lang did he state that the pro-
posals to change the rates in Sched-
ule 2 would have serious effect on
the load building program. It was
stated that, undoubtedly,' if the
cost increased substantially the
tendency would be to retard cons
cersion to natural gas. However, it
was pointed out that other fuel
costs-were increasing in price, and
the entire fuel situation would
necessarily have to be considered
before determining the full effect
on the proposed change in Sched-
ule 2,
It should also be pointed out that
Mr, Lang's studies showed that the
Company was not earning a fair
return in 1956,. and that the six
months actual to June 30-plus six
months estimated to December 31,
indicated the Company would not
make a fair return for the present
year.
It is realized that Councilman,
Charles A, Kintzinger, was not press
ent during the Council Meeting of
August 5th, and that the other
council members felt that it would
be appropriate to defer action one
week .at which time the entire
council would be available. It is
hoped that this will materialize on
Monday, August 12th, and that the
Council will approve our proposals
which the Company believes to be
eminently fair.
As previously stated, there is
considerable work to be done on
the rate schedules and the timing
must be such as to avoid the pos-
sibility of making retroactive
changes in the rates approved by
the Council. It is therefore impera-
tive that this matter be given the
attention by the Council at the
earliest possible moment.

Labor Congress introduced a rep-
resentative committee of labor who
put some pointed questions rela•
tive to the proposed gas rate
changes. The average minimum
rate over the country is slightly
less than $1.15. The present Du-
buque minimum is in the top; 15%

SECTION 6. METER SERVICE..
No person, firm or corporation sup-
plying. gas shalt install any meter or
meters upon a customer's. premise for
the purpose of measuring gas to be

period of six (0) months preceding
date of installation upon a customer's

The accident experiences at this
intersection compares favorably
with the number of accidents ex-
perienced at many other open in-
tersections throughout the city,
A preliminary study of pedes-
trian and vehicle volume indicates
that no type of traffic control, sign
or signal is warranted, A study of
the accidents that have occurred in
the past 2~Z years indicates that in
almost every case one or more of
the drivers is a resident of the im-
mediate area and should normally
be expected to be aware of the
dangers inherent at the inter-
section,
Past experiences has indicated
that the erection of stop signs is not
the answer or solution of the acci•
dents experienced at this intersea
tion. It has been shown in the past
that stop signs erected at such loca-
tions tend to lull those who use
the intersection most frequently in-
to afalse sense of security.

An investigation by the Police
Department of the accident experi-
enced at 28th and White Streets in-
dicates that so far in 1957 there
have been three accidents at this
intersection. One of these accidents
resulted in personal injury of two
people,
A further check of the records
indicates that there were two prop-
erty damage accidents at this inter-
section in 1956 and also in 1955,
signs erected at such an intersec-
tion with low vehicle and pedes-
trian volume leads people to adopt
an attitude of disrespect for stop
signs in general, While the stranger
who -may be traversing such an in-
tersection will almost always use
caution, It is found that those most
familiar with the intersection,
through increasing familiarity with
- the pecularities of the area, tend to
adopt unsafe practices while trav-
ersing these areas.
It is recommended that no con-
- trol signs or signals be erected at
the intersection of 28th and White
Streets.

Gentlemen; The petition of a
group of citizens with reference to
the extension of one-way traffic sys-
tem on White and Central Avenue
was referred to the City Manager
and Police Chief for investigation.
Before considering the possibility
of extending Central Avenue and
White Street in a northerly direc-
tion as one-way streets, there are
.several things that must be con-
sidered. One of the primary reasons
for adopting one-way plans for the
movement of traffic is for the more
efficient movement of vehicular
traffic, This consideration comes in-
to being when the present street
system begins to show signs of high
congestion and extreme saturation
by vehicular and pedestrian traffic.
When evidence of such a situa-
tion comes to light there must be
a thorough investigation in order to
determine whether or not the pres-
ent system is -being used in the
most advantageous manner.
Although recent volume surveys
have not been made on Central
Avenue or White Street north of
22nd Street, it is the opinion of the
Traffic Department that the satura-
tion point has not been reached and
the congestion pattern does not
warrant the extension of these
streets as one-way streets.
Central Avenue north of 22nd is
carrying a heavy load of traffic
throughout 'the entire. day but has
not reached a point where conges-
tion is a common occurence. It is
found that congestion does exist in
the vicinity of 22nd Street during
the peak traffic hours from 3:30
P. M, to 5;15 P. M., but traffic
moves at a .normal rate of speed
:during all other hours of the .day.

In order to establish White Street
and Central Avenue north of 22nd
Street as one-way .streets, it would
be necessary to consider the expen•
diture of approximately $35,000.00
for the erection of necessary signs,
the installation of school crossing
signals and traffic lights. Also the
improvement of the intersection of
24th and White and the intersection
of 22nd and White,
Another consideration that would
have to be taken in mind is that
of extending the primary road sys-
tem over these streets. Thia change
would have to receive the approval
of he .State Highway Commission.
From the experience of the Traf-
fic Division of the Police Depart-
ment, Central Avenue is not being
used to the extent to warrant such
a change at the present time, Since
the time of the adoption of the one-
way street plan in the area south
of 22nd Street, the congestion or
accident picture for the area north
of 2Znd has not measurably
changed. There is no noticeable in-
crease in the number of accidents
involving vehicles or pedestrians,
nor is there any noticeable increase
in the total estimated property
loss.
It is our opinion that the minor
congestion that now exists on Cen-
tral Avenue .during the peak traffic
hours can be eliminated by more
efficient use of the traffic control
system now in place at 22nd and
Central.

ence C. Fay requesting the exten-
sion of the city water main to his
lot at the city limits on -the 'Rock-

There is an existing 8" water
main within 600 feet of the city
limits which eventually will serve
about six residences, This main
could be extended at an estimated
cost of $4,000.00. It has never been
the policy of the City to extend a
main this far for one person and
because of the cost, I feel we should
not do so atthis time.
We have insufficient 8" pipe on
hand to make this extension even
though approval were given.
Mr. Fay could connect to the end
of the water line on Blackhawk
Drive and run a service line along
an easement to the highway and
then to his lot.

the use of city water from hydrants
awned by the Brunswick Industrial

The hydrants are privately owned
but are supplied water through city
mains. Water from these mains is
connected to the sprinkling system
thronghout the Brunswick build-
ings, The hydrants could not be
used by anyone other than the Du-
buque Fire Department if and when
there is a fire in the Brunswick
Block or vicinity,
If a fire threatened any building
under our protection our depart-
ment would take the proper action
to place the fire under control.
There is also proper action for
these people to take if they desire
the city services that residents of
Dubuque support through city tax•
es. I therefore recommend denial

city water main at Jackson Street
at a point half-way between Garnet
and Ruby Streets was referred to

I have had the Water Department
investigate this request and find
that both properties are located
outside the city limits. There is a
six-inch water main on Jackson
Street to which they could connect
a one-inch service line to their
properties.
It is recommended that approval
be given to connect to the water
main on Jackson Street provided
that the service line is constructed
by the property owners and is lo-
cated two feet north of the south
property line and also that they pay
$2:00 per front foot of the lot or
lots of the property they own. Fur-
ther provided that all work be done
under supervision and according to
the rules and regulations of the
City Water Department.

an additional 1" tap into the 6"
water main located on Jackson
Street provided they pay $2.00 per

or a total distance of 138 feet,
It is the recommendation of the
Water Department that the new
one-inch tap can be connected to
the existing main and would pro-
vide 140 gallons per minute which
would be a sufficient supply for
their needs during an emergency.

Creek Sanitary Sewer has been
completed with the exception of a
small quantity of pipe which will
connect the Plymouth Street Lift
Station to the sewer, It is impos-
sible for the contractor to install
this length of pipe until the Cat-
fish Creek Lift station and sewer is
in operation. A'sufficient amount

has been retained by the City of
Dubuque from the contractor's
payment for complete insurance
of installing this final footage of
pipe.
I therefore recommend that Bid
Section No. 4 of the Catfish Creek
Sanitary Sewer constructed by Mc-
Donnell Excavating Service be ac-
cepted with the reservation that
the above mentioned connection
will be made as soon as possible.
