Resolution. providing. for the is-
suance of Sewer bonds for the pur•
pose of providing for the payment
of the assessed cost of the Kauf-
mann Ave. & Asbury Road Sani-
tary Sewer and Lift Station, with
Farce Main.
Whereas the contract heretofore
entered into by the City of Du•
buque, Iowa, for the improvement
hereinafter described has been
completed and the. City Manager.
has certified the completion there-
of to the City Council and the City
Council has ascertained the cost
thereof and has. determined that
$65,616.21 Dollars of the cost
thereof shall be assessed' against
the property subject to assessment
therefor; and
Whereas public notice, as pxo-
vided by law, has been published
by the City Clerk stating the inten-
tion of the City Council to issue
bonds for the purpose of providing
for the payment of the assessed
cost of said improvement and a
public hearing has been held;. pur-
suant to such notice and all objec-
tions made thereto have been con-
sidered and determined;

3. Said bonds shall bear interest
at the rate of 5 per cent per an-
num, payable semi-annually in ac-

This Bond is one of a series of
132 bonds, 131 for $500.00 num-
bered from 543 to 673 both inclu-
sive, and. one for $116.21 numbered
674, all of like tenor and date, and
issued for the purpose of paying
the cost of constructing the Kauf-
mann Ave, and Asbury Road Sani-
tary Sewer ands Lift Station with
Force Main, as described in said
Resolution, in said City, which cost
is payable by the abutting and ad•
jacent property along said improve-
ments. and is made by law a lien
on all of said property. It is pay-
able only out of the Special As-
sessment Fund No. 1190 created by
the collection of said special tax,
and said fund can be used for no
other purpose.

that all the acts, conditions and
things required to be done, prece-
dent to .and in issuing this series
of bonds, have been done, hap-
pened, and performed, in regular
and due farm, as required by law
and said Resolution, and for the
assessment, collection and payment

faith and diligence of said City of
Dubuque are. hereby irrevocably
pledged.

the City are just about double the

stated that Mr. Case wrote to the

power rate reductions and at that
time it was very evident that Vir-
gil Case was oat very familiar with

Gentlemen:
I have had a request for the in-
stallation of street lights on Diane
Court and have had the matter in-
vestigated.
The subdivider of this subdivi-
sion failed to provide adequate
lighting which would have been a
continuation of the boulevard
lights from Victoria Place. He was
also advised as to the cost of in-
stalling boulevard lights, however,
so far he has not indicated the de-
sire to pay any share of the cost
of installing boulevard lights,
I therefore recommend that two
street lights be installed-one at
the intersection of Diane Court and
Victoria Place and the other at the
turn around,

Gentlemen:
Because of the great number of
complaints that have been received
by property owners adjacent to the
alley between Iowa and Main and
Main and Locust north of 12th
Street that they have difficulty
getting into their garages, it is rec-
ommended that these alleys be re-
stricted to parking the same as
those south of 12th Street.
There is also a serious parking
problem in the alley north of East
16th Street adjacent to the Du•
buque Packing Company and it is
recommended that parking also be
restricted in this alley;
Therefore, it is recommended
that Schedule VH of the .traffic
code be amended as follows:
"From Jones to Loras Boulevard
in the alley between Locust and
Main Streets;"
"From West 2nd Street to Loras
Boulevard in the alley between
Main and Iowa Streets;"
"From East 16th Street to its
northerly terminus in the alley
East of Maple Street; and that all
parking even commercial vehicles
be prohibited in the alley fifty
feet north of the property line of
East 16th Street.

Gentlemen:
Regarding attached petition of
George. Vincent McMahon by his
attorney E, Marshal Thomas, dated
December 27, 1955, asking rezon-
ing of the northeast and northwest
corners of Grandview Avenue and
Highway 151 (Lot 2 of 2 of Lot 5
in Mineral Lot 21 in the City of
Dubuque), the Planning and Zoning
Commission respectfully recom-
mends to your Honorable Body de-
nial of said petition,
It is a fact that the apposite
southerly corners are zoned as Lo-
cal Business, being sa occupied
when the City Zoning Regulations
first became effective. Since that
early date it has been considered
by the Planning and Zoning Com-
mission sound policy to avoid ex-
tension of said Local Business Zone
to the north of Grandview Avenue
and the Commission feels that such
policy has proven its wisdom.
This is the third petition for re-
zoning of area in question. (1st) in
1947 by Geo. McMahon which was
never carried through to City Coun-
cil (2nd) in October 22, 1952 by
Mabel Helland when the Planning
& Zoning Commission recommend-
ed denial for following reasons:
1. Many letters and petitions
against granting same.
2. "Local Business" classifica-
tion implies small shops for local
area service, Super Oil and Super
Grocery Service do not conform.
3. The development of such: a
large commercial enterprise in this
location would result in traffic and
parking situations which would
necessarily cause harm to this fine
residential area.
4. Local Business as now bound-
ed, is sufficient for immediate la
cality.
City Council approved the rec-
ommendation of the Planning and
Zoning Commission in 1952, The
Planning and Zoning Commission
feels that time also sustains these
views, for they still hold true.

restricting parking, parking meters,
when installed and properly operated,
shall show legal parking upon and after
the deposit of United States coins in
accordance with the following schedule:
1-In Parking Meter District A such
meters shall show legal parking for
6 minutes upon the deposit of each
one cent coin, or 30 minutes upon
the deposit of one five cent coin,
but not more than a total of 30
minutes at any one time;
2-In Parking Meter District B such
meters shall show legal parking for
12 minutes upon the deposit of each
one cent coin, or 60 minutes upon
the deposit of one five cent coin,
but not more than a total of 60
minutes at any one time;
3-In Parking Meter District C such
meters shall show legal parking for
12 minutes upon the deposit of each
one cent coin, 60 minutes upon the
deposit of each five cent coin, or
120 minutes upon the deposit of
one ten cent coin, but not more
than a total of 120 minutes at any
one time;
4-in Parking Meter District D such
meters shall show legal parking
for 18 minutes upon the deposit of
each one cent coin, 90 minutes upon
the deposit of each five cent coin,
3 hours upon the deposit of each
ten cent coin, or 7t/z hours upon the
deposit of a twenty-five cent coin."
Section 3-That Section 8 of Ordi-
nance No. 7.47 be and the same is here-
by repealed and the fonowing enacted
in lieu thereof:
"Section 8-Between the hours of
9 A.M, and 6 P.M., Sundays and public
Holidays as defined in Ordinance No.
33.49 excepted, regardless of whether
the parking meter shows legal park-
ing, no vehicle shall be parked in a
parking meter zone for longer than
the following periods of time, within
the following Parking Meter Districts:
Not longer than 30 minutes in Parking
Meter District A;
Not longer than one hour in Parking
Meter District B;
Not longer than two hours in Parking
Meter District C:'
Section 4.-That Section 9 of Ordi•
nonce No. 7-47 be and the same is
hereby repealed and the following en-
acted in lieu thereof;
"Section 9-It shall be unlawful to
deposit, or cause to be deposited, in
any parking meter any slug, device or
metallic substitute for a United States
coin,"
Section S-That Section 16.6 of Ordi•
nonce No, 3.49 be and the same is here-
by repealed and the following enacted
in lieu thereof:
"Section 16.6--Between the hours of
9 A.M, and 6 P.M, of any day, Sundays
and Holidays excepted, no vehicle shall
be parked within a parking meter zone,
as defined in Ordinance No. 7.47, in
any space adjacent to which a parking
meter has been installed, while such
meter is showing a signal indicating
that such space is illegally used, for a
longer period than is necessary to ac•

I have examined the claim of

dale, Dubuque, Iowa, for damages
resulting when his car skidded on
the ice on Cooper street and find
no basis for a claim against the
City, inasmuch as there is no bur•

The claim of Joe G. Nelson as
parent and next friend of Elizabeth
Ann Nelson, was referred to this
office for investigation and report,
This claim arises out of an inci-
dent which occurred August 16,
1955, in which Elizabeth Ann Nel-
son, age 8, fell off the bluff at
Eagle Point Park.
On investigation I find that the
injuries were not as grievous as
one would expect from such a fall,
but that she and her father have
sustained substantial medical ex-
penses and the girl will have some
permanent facial scarring,
I have discussed this claim with
Mr. Robert Kenline, attorney for
the claimant, and he has agreed
to accept $500 in full settlement.
In view of the recent decision
of Floret' vs, City of Burlington, in
which the Supreme Court sustained
liability on quite similar facts, I
recommend that the settlement be
approved and that the Auditor be
instructed to issue a warrant in
the amount of $500, payable to
Joe G, Nelson, parent and guard-
ian of Elizabeth Ann Nelson, and
deliver the same upon receipt of
a properly executed release.

No, 33-49, known as the Traffic Code,
by adding a new Section 15.14.1 there-
to prohibiting the placing of handbills
in or upon motor vehicles,
Be It Ordained by the City Oouneil
of the City of Dubuque:
Section 1.-That Ordinance No. 33-49,
known as the Traffic Code be and the
same is hereby amended by adding a
ne~v Section 15.14.1 thereto as follows:
"Section 15.14,1-It shall be unlawful
far any person to distribute, deposit,
place, throw, scatter or cast any com-
mercial or nen•commereial handbill in
or upon any automobile or other vehi•
cle. The provisions of this section shall
not be deemed to prohibit the handing,
transmitting m• distributing of any
non-commercial handbill to the owner
or other occupant of any automobile or
other vehicle, who is willing to accept
the same."
Section 2. This Ordinance shall be in
full force and effect from and after
its final passage, adoption and publi-
cation as by law provided,

Mr. Ed Bradfield of 537 W, 8th
St, inquired why the appraisal of
lots in the 9th street extension
area stopped short of his property
and Felt that the price of $1500.00
offered by the City for his prop-
erty and buildings was too low,
Mr. Bradfield also stated that the
price offered is 25 cents less per
square foot than his neighbors.
City Manager Schiltz explained
that the main difference is in the
value of the buildings compared
to the others. Mr. Bradfield thought
$2250,00 would be a fair price for
his property. Mr, Bradfield was
asked by City Manager Schiltz if
he would accept an appraisal fig-
ure on his property. Mr. Bradfield
stated that he would accept an ap-
praisal figure if done by a group
of impartial appraisers, City Man-
ager Schiltz informed Mr. Brad-
field that the City pays the ap•
praisal board but has no voice in
the men selected.
Mr, Dale Launspach, 2154 Morn•
ingview Road, manager of the Du-
buque Laundry ~ Dry Cleaners of
461 Eighth street said that the rear
of the Laundry property is used
for loading trucks and wondered if
the lower end of Robinson street
would remain open where the
Ninth street extension will replace
Robinson street part way up the
hill, City Manager Schiltz stated
that lower Robinson street in all
probability would be vacated and
could be sold to the best interest
of the City.
Communication of Bernard N,
Heinz voicing his objections to the
appraisal and condemnation pro•
ceedings recommended for prop-
erty owned by him fronting on Rob-
inson street which the City plans
to buy in order to continue the 9th
street extension project, presented
and read. Councilman Schueller
moved the City Manager be in-
structed to negotiate further with
Mr. Heinz in the hope of reaching
agreement on a fair price rather
than go through condemnation pro-
ceedings on this particular piece of
property, Seconded by Councilman
Kintzinger. Carried by the follow-

the City Manager to try to negoti-
ate with Mr, Nagle on the 6 month
option basis which is a require-
ment on the purchase of land the

half of his petition relative to the
installation of water and sewer on
Kane street, he being mostly con•
cerned as to the cost, He was as-
sured that the engineering depart-
ment would be able to give them a
cost figure on the project.

manager of the Universal Electric
Co, of 409 Iowa street made in-
quiry as to the elimination of park-
ing on one side of Fourth street
east of Main. City Manager Schiltz
informed Mr. Brinkmoeller that
the parking survey recommended
that parleing be eliminated on both
sides of Fourth street in order to
keep traffic moving, Rather than
do this however the City comps
mised with the engineers of the
parking survey to eliminate park-
ing on one side only for the time
being. City Manager Schiltz also
stated that with meters installed
an the other side of Fourth street,
the parking turnover will be bet-
tsr than with non-metered parking
on both sides.

and Eileen Holz of 2251 Waodlawn
Street relative to the change of
the natural flow of water, which
they claim has ..cut a ditch through
their yard, and also the complaint
with reference to damages caused
by the dynamite blast by Schueller
and Company while constructing a
sanitary sewer, was referred to the
City Manager for investigation and
report,
I am attaching a copy of a letter
regarding the alleged damages to
the Holz foundation in which the
insurance company's attorney de-
nies liability for the damage,
In regard to the natural flaw of
water through their yard, I have
instructed the City Engineer to
work out the details with the Holz's
for the construction of a storm
sewer through their property.

and widening the alley running
from Loras Boulevard north to the
end of the alley between Alta Vista

grounds.
The City Council upon viewing
the grounds decided that it would
be in the best interests of the city
and adjoining property owners to
grade this alley and widen it to
the established grade during 1956.
I recommend that the decision
of the Council be confirmed.
