Gentlemen:
The letter addressed to the City
Manager requesting that the City
Council vacate an easement
through Lots 320 and 321 of Wood-
lawn Park Subdivision has been
investigated by the Engineering
Department,
There is no needy for this ease-
ment as the storm water drains in
the gutter to a catch basin at Green
and Avoca Street, thereby eliminat-
ing any possibility of the need for
the a-bove easement, At the time
the easement was granted the prop-
erty adjacent to the street was low
and necessitated a storm sewer
across the street and through the
above lots.
I recommend that the easement
be vacated and that proper pro-
ceedings be prepared.

REPORT OF DUE000E DOCK
COMMISSION FOR 1955
To the Honorable City Council
City Manager
Board of Dock Commissioners
Dear Sirs:
Much has transpired during 1955
on the Inland Waterways. The Na-
tional picture shows that in 1955
water born commerce made its
greatest contribution to expansion
of the Midwest economy. On the
Mississippi River alone barge ton-
nage in 1955 increased by 5% over
1954 Tonnage of 84,404,000 in spite
of low water conditions which pre-
vailed through out the last half
of the year.
Upper Mississippi River move-
ment by barge shows an increase
of several hundred thousand tons
ahead of 1954. Predictions far
1956 are that continued growth of
water way transportation will pre-
vaih Ship yards are busy produc-
ing the necessary equipment,
barges, tow boats, etc, for common
and private carriers.
During 1955 we handled with
our own equipment:
10 Barges of Sulphur, 19,251 net
tons; 2 Part loads sisal, 279 net
tons, Total 19,530 net tons.
A concerted effort will be made
to solicit new tonnage that can be
handled over our own dock.
The tonnage of our industries on
which wharfage has been paid to
the Dock Board is as follows;
Interstate Power Company, 103;
438 Tons; Sinclair Refining Com-
pany, 73,885 Tans; Inland Molasses
Company, 40,000 Tons,
We handled same 610 cars as a
whole on our rail tracks in 1955,
of this amount we switched sul-
phur and other movements of 246
cars by use of our own Trackmo-
bile, A track use charge applies
on approximately 364 cars,
During 1955 our wharf barge
was sold for $26,500. An inventory
was taken as of January 1, 1956,
showing all equipment, tools, sup-
plies, All old items of obsolete na-
ture and unusable equipment such
as 3 heavy motors, steel ware-
house loading plates, adding ma-
chine, typewriters were sold, Also
much old scrap iron found laying
around on the premises. Efforts
are being made to sell part of the
pallets on hand which we do not
need, and most all of the remain-
ing 4 wheel trucks used when the
escalator was in use years ago,
During 1955 our good friend
John Kerper, Lang associated with
development of Water Terminals
and barge transportation and well
known throughout the Mississippi
Valley had to resign on account
of illness. All who have known him
sincerely hope that he will regain
his health so that he will see the
fruits of his unselfish application
of time, labor and efforts on water-
way development these many past
years.
This past year we .dredged the
lower end of the New Lake Peosta
Channel and deposited approxi-
mately 60,000 cu, yd. of material
on that part of the island south-
erly of East 12th Street and which
we refer to as Area "A". We have
approximately 40 acres of land
pumped up on this area and we
expect to complete the balance
before not too long a time,. We
have made arrangements with the
Interstate Power Co,, to raise the
electric wires over the Seventh
Street Channel and this should be
completed in the third quarter of
1956. We are now making arrange-
ments to remove the stone dam at
the foot of 8th Street so our dredge
can get in the proposed harbor
back of the Gas Company property.
At the time of shutting down the
dredge in the fall of 1955 we were
cleaning out some sediment which
had accumulated in .the 7th Street
Channel.
This past year we have filled
in around the River Terminal to
make room for the Inland Molasses
Co., and we expect to fill in the
entire area this year and extend
the Dodge Street Storm Sewer out
in line with the bridge pier and old
escalator pier, We also expect to
fill in around the walls at the site
of the old Federal Barge Line tanks
just north of Railroad Ave., pro-
viding proper material is available.
These are all potential industrial
sites, At Eagle Point we have been
plagued by the sinking of a boat
in front of the Anchor Inn and we
have decided to wait no longer
than this spring for its removal
or we will do the work tiurselves
and put a lien on the property re-
sponsible for same.

.The roof at the Terminal B'uld•
ing has been repaired and the
walls of the building which needed
repointing were taken care of by
contract,
The Inland Molasses Co, plans
call for greater activity during
1956 and have been asked to con-
struct their own unloading dock
to relieve congestion. when barges
of sulphur and molasses arrive at
the same time,
The terminal Office has been
completely renovated and a new
heating plant installed, etc, mak-
ing it habitable as a place of busi-
ness.
The crowning event of 1955
occcurred when the citizens of
Dubuque showed their confidence
in the men who run the City Coun-
cil, the City Manager, Dock Com-
mission, the Chamber of Commerce
and other civic groups by voting
favorably on a $2,000,000 Bond Is-
sue for the improvement of City
owned Island which is to provide-
areas for industrial sites and a
boat harbor for recreational pur-
poses. Area "B" has already been
platted by the Dock Board and con-
tracts let to LaCrosse Dredging
Co., who started dredging last fall.
A new Channel named the Lake
Peosta Channel has been started
and runs between Area "B" and
"C" through to tike Mississippi Riw
er, This arterial waterway will.
provide industrial sites with appor-
tunities for barge movement of
commodities received and pro-
duced. The City Water Depart-
ment has sunk new wells assuring
a plentiful supply of water which
is a very important factor in Indus-
trial development. The boat har-
bor is under construction. Area
"B" the first objective will have
rail. and truck facilities so that
coordinated rail-truck-barge trans-
portation is available, The Dack
Board look forward to a busy year
in furthering the industrial life
of the City.

The Iowa State Highway Com-
mission has submitted resolutions
to be acted upon by the city coun-
cil approving the plans for im•
provement of U. S, Highway No.
61 and U.S. Highway No, 151 with-
in the city and U.S, Highway No. 20
and U. S. Highway No. 52 at the
Julien Dubuque Bridge approach,
Because Federal and State funds
are being used for the construc-

tion of these improvements, cer-
tain conditions are required of
the city such as access control, re-
stricted parking, removal of water
hydrants, and payment for the
cost of lateral storm sewer con-
struction.
Referring to Project U-305(6),
the bridge approach, access con-
trol is required on Bluff Street to
the bridge and on Locust Street
from Jones Street south to a point
729.0 feet south of Dodge. Street.
Parking will be prohibited on
Dodge Street from Bluff to the
bridge and on Locust Street a dis-
tance of approximately 200 feet
on each side of the Dodge Street
intersection. A storm sewer 648
feet in length will be constructed
on Locust Street which cost. accord-
ing to Highway Commission policy
must be paid for from city funds.
Referring to Project U-17(5) the
relocation and construction of U,S.
No. 61 and U.S. No, 151 from the
south corporation line to a point
729.U feet south of Dodge Street
on Locust Street. Parking will be
prohibited on the entire project,
access control is required on the
entire project. Storm sewer co-n-
struction necessary for lateral
drainage will be paid for from city
funds,
The Iowa Highway Commission
has agreed to construct a sanitary
sewer to connect existing homes
on Julien Dubuque Drive, that will
have their septic tanks eliminated.
The plans for this sewer system
should be approved by bhe City of
Dubuque and the Iowa State Board
of Health before the city acccepts
the sewer far maintenance. Provi-
sion should be made in the design
area uur~n or me new nlgnway.
Before approval of the resolu•
tions ,the meaning of access con•
trol should be understood. Access
to the street will be limited to
that as it exists at the present, such
an existing driveways, streets, al-

6. Upon completion of the proj-
ect, the Council agrees that-

nature shall be prohibited for a
distance of 35' from the back of
sidewalk line of remaining inter-
secting street approaches. A single
line of parallel parking on each
side will be permitted on the re•

time that traffic demands more
than three (3) traffic lanes,

Gentlemen:
At your direction I have inves-
tigatedthe claim of Albert M, Matz,
600 Sutter street, and find that he
fell December 12, 1955 an a defec-
tive sidewalk and sustained a frac-
tured kneecap. The defect was dis-
covered ashort time before the
accident, but could not be repaired
during the .freezing weather,
Mr. Matz has sustained substan-
tial loss of time and incurred sub-
stantial medical expense, I have
discussed the matter with his at-
torney, who has agreed to a set-
tlement of $932,10.
I recommend that this settle•
ment be approved and that the
City Auditor be instructed' to issue
a warrant in the amount of $932.10,
payable to Albert M, Matz and John
K, Chalmers, his attorney, and do-
liver the same upon receipt of a
properly executed release.

The Commission members be-
lieve it inadvisable to amend the
ordinance to include an alley as a
coasting area, which belief is like-
wise held by the Police Depart-,
ment. After considering, however,
the need to keep pace with the in-
crease in residential areas and the
general expansion of our city, the
following motion was adopted;
That a recommendation be made
to the members of the City Council,.
requesting that City Ordinance
5-52, Section 1, first sentence, be
amended to read; "That the City.
Manager is hereby authorized to
designate portions of not more
than 20 streets within the City of
Dubuque as coasting areas during,
the months of November, Decem-
ber, January, February and March
of each year."
This change would increase the
coasting areas from fifteen to twen-
ty streets and meets with the ap-
proval of the Police Department,

.its intention to issue bonds as pros
vided by Section 396.6 of the Code
of Iowa, 1950, for the punpose of
providing for the payment of the
assessed cost of said improvements;
said bonds to be issued in antici-
potion of the deferred payment. of
the assessments levied therefor,
and that said bonds will be sold at
public sale in the manner provided
by law, but shall not be sold for
less than their par value with ac-
crued interest from date of bonds
to the time of delivery thereof.
Section 5. That unless property
owners at the time of final con-
sideration of this resolution have
an file with the City Clerk ob-
jections to the amount of the pro-
posed assessment, they shall be
deemed to have waived all objec•

In negotiating for the property
on 8th and Iowa Streets, I considr
erect also the location on 8th and.
Central Avenue, however, the 8th
and Central location is definitely
not suitable according to informa-
tion received from the consultants
regarding various locations, This
rules out the 8th and Central lot
as it will be necessary to have the
recommendation of our consultant
in our Bond Brochure.
I recommend the approval by the
City Council of the options already
executed and some definite com-
mittment on acquisition of other
property for additional lots.

handicapped by this parking due
to use of the street for deliveries
and for pedestrians.
I recommend that parking be
prohibited on both silos of Cam-
pus. Lane from Auburn to Algona
and that the proper ordinance be
prepared,

You will note that it was nec-
essary to publish it this year as a

separate pamphlet because it has
become too thick to insert in the
back cover.
On referring to the table of con-
tents, you will also note that all
but one chapter has been amended
ands most chapters have been sub-
stantially changed. I therefore sug-
gest that you consider the need
for publishing a new Code of Or-
dinances at the close of this year,
The original volume and the sup-
plements have been provided as a
public service. The annual cost of
the supplements is approximately
$400, The cost of a new Code would
be about $4,000.
Although there was considerable
demand voiced for the compilation
of the ordinances in 1951, the small
demand for the books, or even the
free supplements, indicates that
few people have any use for them,
I therefore suggest that you also
consider discontinuing the service
completely.
A final debermination should be
made before the next budget hear-
ing.

Gentlemen:
I have received a letter signed by
nine of the thirteen paint suppliers
who requested an opportunity to
bid on our traffic zone paint, critiz-
ing the method of purchasing paint,
Standard practice of purchasing
materials for use by the city has
been followed with the award be•
ing given to the lowest and best
bidder which was $108,00 below the
next low bidder.
I am aware that with everything
else equal, local vendors should be
given any business provided they
supply a product of equal value
at the same or a lower cost than
non resident bidders.. Many pur-
chases are made on supplying small
quantities of material without com-
petitive bids and resulting in a
distribution of business on a local
basis, however, on large con-
tracts it certainly would be detri-
mental to practically everyone in
the city to favor one local sup-
plier by giving him a premium for
his products, Actually this proced-
ure would be illegal. in mast in-
stances where bids are requested.
An order has been placed for
our 1956 requirements with the
Diamond Paint Company for sup-
plying the paint through their lo-
cal dealer the Leo Bly Company.
They were the lowest and best bid-
der at a saving to the city of
$1os.oa.
In the future I will continue to
purchase equipment, materials and
supplies from local suppliers when
they are low bidders, thereby fol-
lowing aprocedure that is in the
best interests of the great majority
of citizens.

During the past years we have
been heating the asphalt for use by
the city street department with
equipment that is being leased
from the Milwaukee Railroad.
The length of time that is taken
to heat a car of asphalt with this
equipment is too long and results
in an additional expense far our
asphalt work, We have been ne-
gotiating with the Milwaukee Rail-
road to install new equipment
Which would cut down the cost
more than one~half and will great-
ly increase the efficiency of rour
operation,
I recommend that the City Coun-
cil authorize the City Manager to
sign the attached agreement for a
rental of the equipment not to ex-
ceed $800.00 per year.

Section 3. That the cost and ex-
pense of making said improve-
ments will be assessed upon and
against all privately owned prop-
erty lying within the assessable
distance provided by law and in
an amount not to exceed the
amount provided by law. Property
will be assessed, whether the same
abuts on any of said portions of
said street or is adjacent thereto
according to area and in proportion
to the special benefits conferred
thereby, and any deficiency shall
be paid out of the street fund. The
railway portion of any such streets
shall be assessed against the rail-
way. company,
Section 4, That the City Council
by this resolution gives notice of
its intention to issue bonds as pro-
vided by Section 396.6 of the Code
of Iowa, 1950, for the purpose of
providing for the payment of the
assessed cost of said improvements;
said bonds to be issued in anticipa-
tion of the deferred payment of the
assessments levied therefor, and
that said bonds will be sold at pub-
ic sale in the manner provided by
daw, but shall not be sold for less
than their par value with accrued
+nterest from date of bonds to the
time of delivery thereof.
Section 5, That unless property
owners at the time of final consid-
eration of this resolution have on
file with the City Clerk objections
to the amount of the proposed as-
sessment, they shall be deemed to
have waived all objections thereto.
Section 6. For purposes of Brev-
ity and Reference all the fore•
going improvements shall be known
as "City of Dubuque 1956 Concrete
Curb and Gutter Project Number
