ing upon such business as may

Whereas, proposed plans, speci-
fications plat and schedule have
been dilly prepared and approved
by the City Council of the City of
Dubuque and are now on file in the
office' of the City Clerk showing
among other things the following:
1. The boundaries of the district,
if any.
2. The streets to be improved,
3. The width of such improve-
ment,
4. Each lot proposed to be as-
sessed together with a valuation
fixed by the council
5. An estimate of the cost of the
proposed improvement.
6. In each case the amount there-
of which is estimated to be as-
sessed against each lot, far the

Be It Therefore Resolved that
the City Council on its own motion
deems it advisable and necessary
for the public welfare to make the
herein mentioned improvement,
and unless property owners at the
time of the final consideration of
this proposed resolution have on
file with the City Clerk objections
to the amount of the proposed as-
sessments, they shall be deemed to
have waived all objections thereto.
Said improvement shall be con-
structed and done in accordance
with the .plans and specifications
which have been prepared therefor
by the City Engineer which have
been approved by the City Council
and are now on file with the City
Clerk. That the cost and expense of
making. said improvement will be
assessed upon and against all prP-
vately owned property lying within
assessable distance provided by
Paw and in an amount not to exceed
the amount provided by law, prop-
erty will be assessed whether the
same abuts thereon or is adjacent
thereto according to area and in
proportion to the special benefits
conferred thereby, Labor and
equipment costs shall be paid out
of the street improvement fund,
improvement funds ar sewer funds,
or partly out of each of said funds.
Bonds shall be issued and sold in
anticipation of deferred payments
of assessments when a contract has
been performed and accepted and
the proceeds thereof used to pay
the contractor. The railway por-
tion of any street or assessment
district shall be assessed to and
paid by the railway company.

Manager be and -he is hereby di-
rected to execute a contract on

Gentlemen:
The petition of the Dubuque
Public Schools relative to the is-
suance of a restricted plumbers li-
cense to Mr, Earl Wiegand was re-
ferred to the City Manager and
Plumbing Inspector for investiga-
tion and report.
The City ordinance provides a
restricted plumbers license may be
issued to a person in Mr. Wiegand's
position who supervises the m~afn-
tenance of the public school sys-
tem.
According to our investigation,
Mr, Wiegand does supervise- a
maintenance crew and the City
Council may authorize the issuance
of a restricted plumbers license.

Upon investigation by the Elec-
trical Inspector it was determined
that a light should be installed at
this location because it is a dead
end street and the area beyond is
used by pedestrians.
I recommend that a street light
be installed at the above location.

Gentlemen;
I am attaching a copy of instruc-
tions and procedure to be inaug-
urated by the Fire Department on
June 4, 1956. These instructions
are for a dwelling inspection pro-
gram that Chief Hickson has rec-
ommended to be inaugurated in
the city.
I have given my approval of 'this .
program and ask that the City
Council give their support to it
also.
The various companies will in-
spect all dwellings in the area
that the engine company serves,
However, these inspections will
not be mandatory, and will only be
made if the resident gives their
pernussion,
During the last three years two
thirds of all fire alarms were far
dwelling fires and it is felt that if
inspections are made the fire haz-
ards will be cut down a consider-
able extent, therefore, reducing
our fire loss. In fact, from experi-
ence of other cities carrying out
this inspection, it has been proven
that the number of calls decreased
and the loss of life and property
has greatly been reduced.
We will endeavor to carry out'a
publicity program in connection
with the inspection program so
that it may receive wide public
support,

Case, stating that he received a
letter from a citizen of the City
in which a statement was made
"there is apparently no opportun•
ity to do anything drastic about
gas rates, because the company is
in a costly transition to natural
gas"; Mr,. Case pointing out that
this so-called expense stressed by
the utility at Dubuque is not a
problem with other utilities chang-

ing to natural gas and that the
business and industrial growth of
Dubuque is at a stand-still until
competitive rates with commruni•
ties in Iowa, Minnesota. and Nebras-
ka are established, presented and
read, Mayor Welu stated that some-
thing should be done relative to
having these letters stopped. City
attorney Nelson stated that Mr.
Case is a very clever writer .and
that unless he is definitely proven
to make statements that are untrue
there is not too much could be
done about it. Evidently cities like
Des Moines and Clinton have very
little good to say about Mr. Case.
The City manager read a letter
'from the Iowa Development Com-
mission which proved that Mr.
Case is in error as to Dubuque be-
ing dropped from .the list for pros-
pective industries desirous of com-
ing into the State of Iowa. In other
words Dubuque has as good a
chance as any other community in
the State for acquiring new indus-
try, Dubuque has much to offer.
industrial development, more so
now than ever before due to the
development of the lake front area.

communication of Mr, Case be re-
ferred to the Council for further
.study and report and a copy of
the letter be sent to the firm of
Laramore and Douglass, consult-

easterly end of Decorah St. re-
quested to be vacated by the City
in petition of Mrs. Marie Lange
and Frank Lange, the Planning &
Zoning Commission finds no ma-
terial change since recommending,
to City Council May 12, 1950 that
the street might be vacated and
sold as it has no outlet to the east;
the Planning & Zoning Commission
now reaffirms its previous findings
and recommends vacation of same,
However, this 50 foot right-of-way
has value to City in line with ad-
joining lots, and City should not
deed same to adjoining owners ex-
cept at a fair price.

ney, addressed the Council in be-
half of the Bird Chevrolet Com-
pany, owners of one of the proper-

street parking, stressing the fact
that the Council must decide as to
the necessity of acquiring this
property, bearing in mind that
their action is not subject to judi-
cial review. The acquisition of the
proposed lot, occupied by the Bird
Chevrolet Company, would provide
for the off-street parking of ap-
proximately thirty vehicles. Ap-
proximately half of the proposed
space is already being used by the
Bird Chevrolet Company in the
operation of their business, as a
parking medium, in the occupation
of customer's cars, demonstrator
cars, employee's cars, wreck jobs
in and out for repairs, all of which'
is essentially vital to their success-
ful operation for profit, Looking
at it from that angle the City is
not in a position to gain very much ,
parking space by acquiring the
Bird Chevrolet Company property,
realizing also that the purpose of'i
taking the property would be to,
help solve the parking problem
and then turn it back for the same
purpose to the extent of approxi-
mately fifty per cent. Mr. Reynolds
questioned whether a city off-
street parking lot would serve as
many people as anticipated and
why the Bird Chevrolet Company
should be penalized for having the.
foresight to obtain this land for'
private parking. Dick Henschel,',
owner of an apartment at 4th &'

the Council telling them to forget
the minor complaints, realizing
that those were the arguments two
years ago when they wanted the
Cooper property and it could have
been purchased for less at that
time. Mr. John Wieser addressed
the Council questioning the wis-
dom of acquiring more parking
space. He asked the City Manager
haw martiy meters in the City at
the present time and he was told
that the City is now operating 1673
meters, He also seemed to be of
the opinion that the more build-
ings you tear down the more peo•
ple you drive out of the City, and
far the present at least there. are
plenty of parking spaces available.
Pete Stonskas addressed the Coun-
cil relative to acquiring the now
unoccupied Glover building.'. for
a ramp parking site. The'City Man-
ager explained to Mr, Stonskas that
a building such as the Glover build-
ing would not be suitable for a
ramp parking site because of its
construction.
Councilman Kintzinger was of
the opinion that the Council should
proceed with the acquisition of all
parking lots proposed, which lots
.are those recommended by the
parking consultants, in order that
the best interests.. of the .City. be
served, bearing in mind the future
parking needs in the. contemplated
growth of the City and also if the
Tats are not acquired, as proposed,
it may effect the contemplated
bond issue, The lots under consid-
eration at the present time are
within certain bounds,. which is
very essential for the approval of
the Traffic Consultants, which ap-
proval must be given and shown
before a bond issue can be floated.

that the title to the properties nec-
essary for off-street parking pur-
poses, being considered at the pres-
ent time, be acquired only on those
lots that would not necessitate go-
ing into condemnation proceedings

I have discussed the matter with
her attorney and she has agreed
to accept one hundred and fifty
dollars in full settlement.
I recommend that this settle-
ment be approved and that the

shall not sell, or offer for sale, any

Mayor Welu read the call and
stated that service thereof h a d
been duly made and that this meet-
ing is called for the purpose of dis-
cussing and explaining the present
established gas rates and acting
upon such other business as may
properly come before a regular
meeting of the City Council.
Mr. Eugene Lang of the rate con-
sulting firm of Laramore & Doug-
lass was presented by Mayo r
Welu. Mr. Lang began his remarks
by stating that the present rates
are the. result of study made by
the firm of Laramore & Douglass
in a report dated May 3, 1955, His
firm knows something about the
theory of rate making and h a s
helped !the various City councils
since 1937. The theory of rate mak-
ing is based on the cost to serve
a particular community. Various
items must be considered such as
amount of property used; amount
distributed by the local gas cam-
pony; cost of operation, etc. Bring-
ing natural gas into the City by
North Central entailed consider-
able. work and cost, Much work
had to be done to the old distribu-
tionsystem, Conversion of burners
has proven to be a great expense

plant improvements, office equip-

ment trucks etc. North Central
Pub 1 i c spent in excess of
$926,000,00 in 1954 to change over
its distribution system for natural
gas. Mr, Lang was_of the opinion
that the reason the present g a s
rates are high was the result, at
i least to same extent, to a mistake
in judgment by the predecessor
company. The former Key C i t y
Gas Company contracted for ten
million cubic feet of gas per day
which was beyond even the maxi-
mum requirements. When the con-
tract was made they were using
about one and one-half million cu-
bic feet per day. The fact that.
natural gas has a greater number
o£ heat units further increases the
ratio twenty to one and a half.
North Central Public made appli-
cation to have the cubic feet re-
duced from ten million to five mil-
lion cubic feet per day, shortly aft-
er they took over the former gas.

March 1955, about four months aft-
er natural gas was brought into
Dubuque, but the granting of the
petition was first realized in No-
vember which resulted in some
measure of stabilization of rates,
Henry Arnold, 920 W. 5th Street,
stated that he thought it was un-.
fair to use items of trucks, etc. in
considering rate charges, further
stating that other companies in
the same field have the same ex-
pense. Mr. Lang stated that North
Central Public lost $47,823.00 in the
year 1954. He did admit that the
rate increase on house heating and
commercial use amounted to 12.2
per cent,
Mr. George Kaufmann of 1111
Lincoln Avenue announced that a
group of men from the Trades &
Labor were present and that Mr.
Roland White would act as spokes-
man for the group. Mr, White'
questioned Mr. Lang from an in-
quiry into gas rates by the Des
Moines city council last year.
White pointed out that Dubuque
was second high among twelve
cities using gas from the. same
pipeline supplier. He wondered if
the rate base was caused to be so
high because of the fact that the-
Donovan interests and the North
Central Public Service company,
being the same investors, did the
construction warlc here, He could
not understand why we should pay
rates based in any part on profits
which went to the same persons,..
Mr. Lang stated that there was a .
price instability existant at the
time North Central Public too k
aver. They did not know from.
month to month what gas would
cost them at the City gate, It is
therefore unfair to compare rates
here with rates in other commun-
ities, Neighboring communities are
selling gas cheaper because they
have had natural. gas for many
}ears and also many of them buy
their gas from different suppliers

Public was paying Northern Nat-
ural for gas, Mr, Lang explained
that North Central Public m u s t
pay 2,71 for every thousand cubic
feet of gas for which it has con-
tracted, plus 22.1 cents for each
thousand cubic feet brought in.
This would figure out to an average
cost of forty four cents per thou-
sand cubic feet by paying $13,5DD.OD
as the base cast of five million cu•
bic feet and $13,260.00 on two mil-
lion cubic feet actually used in a
month's period,
Mr, Ray Lange of Adair street
made the query why pay for five
million feet per day whether it is
used or not. City Solicitor Nelson
stated that he is of the opinion
that the Key City Gas Company
asked for the large amount of gas
believing that it could be decreas-
ed later, However the amount was
granted by the federal P o w e r
Commission and Northern Natural
Gas held the Key City Company
to its original estimate, Mr, Kisting
of 1880 Garfield avenue, a s k e d
about storage facilities far un-used
gas, Mr. Spurrier of the gas com-
pany informed him that they have
geologists employed in the. hope of
finding an area that is capped by''
rock that. would make a suitable'
and adequate storage cave,.
Mr, Frank Gonser of 1860 Heeb
street made inquiry as to the cave'
at the old Union Park as to its
availability for storage purposes.
He was advised that the geologists
explored the area and found that
the cave ,was' not adequate and,
that it was not of the proper struc-
ture to hold gas.
Mr, Tom Harris of McCormick'
street inquired as to the establish-
ment of service for firms locating
in the new City Island Industrial
Development when completed.
Mr, Spurrier replied that North
Central Public will be able to keep
up with possibly large industrial
demands as the City Island proj-
ect developer:

Davenport showing that one thou-
sand cubic feet cost $1.65 for cook-
ing or water heating whereas in
Dubuque it would cost $3,00 per
thousand cubic feet; home heaters
would pay 55 cents per thousand
cubic feet for amounts in excess of
five thousand cubic feet per month
whereas in Dubuque it would cost
85 cents .per thousand cubic feet,
Mayor Welu stated that a review
of gas rates for the City will be
forthcoming in July,
