Van Milligen, City Manager SUBJECT: Dubuque Industrial Center South — Verena Court Project CIP 3602160 DATE: November 1, 2016 City Engineer Gus Psihoyos is recommending acceptance of the public improvement construction contract for the Dubuque Industrial Center South, Verena Court Project, as completed by Drew Cook & Sons Excavating, Co., Inc., in the final contract amount of $204,500.24, which is a 5.6% increase from the original contract amount of $193,735.50. The increase was due to additional stone required to maintain access for the Roasting Solutions building project and for re-working sidewalk to meet ADA grades. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer SUBJECT: Dubuque Industrial Center South - Verena Court Project CIP 3602160 DATE: October 31, 2016 INTRODUCTION The enclosed resolution provides for the acceptance of the public improvement construction contract for the Dubuque Industrial Center South, Verena Court Project. BACKGROUND In Section 3.3(3) of the Development Agreement with Roasting Solutions (Developer), the City committed to construct an entrance road at the City's cost. IIW, P.C. had been contracted by the Developer to provide construction drawings for the construction of its new facility in the South Siegert Farm area of the Dubuque Industrial Center Economic Development District. As such, IIW, P.C. was in possession of many preparatory documents that were used to facilitate the design of the entrance road required by the Development Agreement. The City secured the services of IIW, P.C. to design the street improvements for Verena Court to expedite the project to meet the developer's project schedule. This project provided for construction of a cul-de-sac to serve the Verena Street Coffee development and future development in the Dubuque Industrial Center South off of Seippel Road. The project included 9" PCC pavement, 5' wide sidewalk, curb and gutter and storm sewer. The project also included a streetlight to illuminate the cul-de-sac. DISCUSSION The Dubuque Industrial Center South, Verena Court Project was completed by Drew Cook & Sons Excavating, Co. Inc., of Dubuque, Iowa, in the final contract amount of $204,500.24 which is a 5.6 % increase from the original contract amount of $193,735.50. The increase was due to additional stone required to maintain access for the Roasting Solutions building project and for re-working sidewalk to meet ADA grades. RECOMMENDATION I recommend that the City Council accept the improvements and authorize the payment of the contract amount of $204,500.24 to Drew Cook & Sons Excavating, Co. Inc. for the Dubuque Industrial Center South, Verena Court Project. Prepared By: Jon Dienst, P.E. cc: Jenny Larson, Budget Director Maurice Jones, Economic Development Director Jill Connors, Economic Development Project Coordinator 2 RESOLUTION NO. 367-16 ACCEPTING THE DUBUQUE INDUSTRIAL CENTER SOUTH — VERENA COURT PROJECT AND AUTHORIZING THE PAYMENT TO THE CONTRACTOR WHEREAS, the public improvement contract for the Dubuque Industrial Center South, Verena Court Project (the Project) has been completed by the Contractor, McDermott Excavating (Contractor), the City Engineer has examined the work and recommends that the Project be accepted; and WHEREAS, the final contract amount for the Project is $204,500.24; WHEREAS, the Contractor has previously been paid $194,275.23, leaving a balance of $10,225.01; and WHEREAS, the City Council finds that the recommendation of the City Engineer should be accepted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the City Engineer is approved and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor the balance of the retainage of $10,225.01 as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.
