stated that this is the regular
monthly meeting of the City Coun•
cil called for the purpose of act-
ing upon such business as may
properly come before the meet-
ing.

and City Council,
Dubuque, Iowa
Gentlemen:
Inspection service furnished by
the City such as restaurant, build-
ing, electrical and plumbing are
supported by the fees charged for
permits, In the case of milk in•
spection, no fee is charged in Du•
buque far this service. This is
not the case in other cities per-
forming alike service.
In order to properly inspect the
255 farms and 7 dairies plus the
laboratory work necessary to test
milk and milk products, it will
be necessary to hire a fieldman.
This person would do the neces-
sary farm work and help in the
laboratory.
The cost of inspecting milk for
Dubuque and. the milk shipped
out of Dubuque should be borne
by the suppliers of milk. The
charge should be sufficient to cov-
er only the cost of inspection and
testing, and from the volume of
milk delivered to Dubuque dairies,
would amount to (,02c) per 100
pounds of milk.
I recommend that the milk or-
dinance No. 7.41 be amended to
provide an inspection fee of (.02c)
per 100 pounds of milk or milk
products sold, delivered, or
brought into the City during the
preceding month,

tion, extending an invitation to

16th to 20th, 1956, presented and
read. Mayor Welu moved that the
City Manager participate at the
City's expense, Seconded by Coun-

Gentlemen;
The petition of Henry Reed rela-
tive to the opening of the street
in the 2900 block of Brunswick
between Groveland and Goethe
Streets was referred to the Coun-
cil to view the grounds.
After viewing the grounds the
Council directed a survey be made
and grades set to determine the
amount of grading .necessary to
open the street, This has been
done and with a 26 foot street,
walls are required on the low side
of the street.
The estimated cost of grading
and constructing retaining walls
to support the street amounts to
$10,078.00. Curb and gutter esti-
mated cost is $3,539,80 and surfac-
ing amounts to $2,898.00. None of
these assessments could be levied
against property an tho west side
of the street as they would receive
no benefits.
In my opinion the paving of this
street is impractical and the cost
excessive for the benefits derived.
Most of the homes constructed
along this section of Brunswick
Street were built knowing that it
would not be practical to open the
street. If an additional ten feet

along the alley were to be dedi-
cated for street purposes the pres-
ent alley could be widened and
thereby make parking available on
one side.
I recommend that the petition be
denied far the above listed rea-
sons.

Mr. Leonard Smith of 1433 Wash-
ington Street, the. owner of prop-
erty on the corner of 12th & Elm
streets addressed the Council ob-
jecting to the restricted parking
area on 12th street from Elm street
to. the railroad tracks. Evidently
this matter was considered before
and nothing had been done about
it, It was suggested that the traf-
fic department review the area
again in the hope that some relief
could be given the area as it is
beginning to effect the rental of
the building owned by Mr, Smith.
Mayor Welu moved that the matter
be referred to the traffic depart-
ment for investigation and report.

tract for the furnishing, installing
and adjusting of an Air Condition-
ing System for the City Hall, City
of Dubuque, Iowa, have been ap-
proved by the City Council of the
City of Dubuque and public notice
given as provided by Chapter 23
of the Code of Iowa, 1950, pertain-
ing to public contracts and bonds,
and the time and place fixed for
the hearing of all objections to
said plans, specifications or con-
tract for or cost of such improve-
ments, said time being this 18th
d'ay of June, 1956; and
Whereas, the City Council met
in special session this 18th day of
June, 1956 at 7:30 o'clock P.M. at
the Council Chambers in the City
Hall for the purpose of hearing
all interested parties and consider-
ing any and all objections which
have been filed to the proposed
plans, specffications or contract
for or cost of the improvement
herein described and proposed to
be made; and
Whereas, all interested parties
have been given an opportunity

in the office of the City Cleric
showing among other things the

proposed improvement, stating the
same for each different type of
construction and kind of material
to be used,
Furnishing, installing and ad•
justing an Air Conditioning System
for the City Hall, City of Dubuque,
Dubuque, Iowa.
Be It Therefore Resolved that
the City Council on its awn motion
deems it advisable and necessary
for the public welfare to make the
herein mentioned improvement,
and unless property owners at the
time of the final consideration of
this proposed resolution have on

to the amount of the proposed im-
provement they shall be deemed to
have waived all objections thereto.
Said improvements shall be con-

expense of making said improve-
ment shall be paid out of the gen-
eral fund.

for the City Hall, City of Dubuque,
Dubuque, Iowa pursuant to Resolu-
tion No. 144-56 and notice to bid•
ders published in a newspaper pub-
lished in said City on June 1,
1956.
Whereas, said sealed proposals
were opened and read on 10;00 a.m.
June 18, 1956, and it has been de-
termined that the bid of Rafoth
Furnace and Sheet Metal Works of
Dubuque, Iowa in the amount of
$6,446.00 was the lowest bid for the
furnishing of all labor and mater-
ials and performing the work as
provided for in the plans and spe-
cifications; now therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque that the
contract for the above mentioned
improvement be awarded to Rafoth
Furnace -and Sheet Metal Works
and the Manager be and he is here-
by directed to execute a contract
on behalf of the City of Dubuque
for the complete performance of
said work,
Be it further resolved, that upon
the signing of said contract and
the approval of the contractors
bond the City Treasurer is authoriz-
ed and instructed to return tho bid
deposits of the unsuccessful bid-
ders.

Be it resolved by the City Coun-
cil of the City of Dubuque that pur-
suant to a resolution of necessity
No. 133.56 which was duly passed
by this Council, for the Furnishing,
installing and adjusting an air con-
ditioning system for the City Hall,
City of Dubuque, Iowa be and the
same hereby ordered and con-
structed by this Council upon its
own motion and with ar without
the petition of property owners. All
the work shall be constructed in
accordance with the plans and spe-
cifications heretofore _adopted and
now on file in the office of the City
Clerk.
Be it further resolved that the
cost and expense of the said im-
provement be paid for out of the
general fund of the city,
Be it further resolved that the
City Clerk be and he is hereby or-
dered and directed to advertise for
proposals for the construction of
the various improvements herein
provided for in the manner provid-
ed by law, the said improvements
shall be completed on or before 30

tract.

resolution being deemed urgent

Communication of Dubuque Jer-
rold Cable Corporation advising the
Council that as of Monday June 4,
1956, every amplifier in the entire
Dubuque Jerrold system is present-
ly being served by Interstate Pow-
er Company from Dubuque gener-
ators in order to assure better TV
reception which was formerly in-
terrupted at various times due to
power failures, power for which
formerly came through REA at
Cedar Rapids, Iowa, presented and
read.
Mayor Welu expressed apprecia-
tion at receiving this information
and moved that the communca-
tion be received and filed. Secon-
ed by Councilman Schueller.

A meeting was held by officials
of the Dubuque Packing Company
and the city to discuss the treat•
ment of the Packing Company sani-
tary sewage and industrial waste.
An agreement has been reached
by the Dubuque Packing Compahy
to give the city their sewage for
treatment in the city treatment
plant. Formal agreements will be
based on actual construction casts
and the volume of wastes and will
be negotiated,
I recommend that the City Coun-
cil authorize our consulting engi-
neer to proceed with final plans to
include the Dubuque Packing
Company wastes, Also that the City
Solicitor and City Manager pro-
ceed with negotiations on the serv-
ice charges to treat the waste from
the Packing Company.

A group of citizens, consisting of
Ambrose Herkes, Phil Powers, Leo
Wagner, Mrs. John Thompson,
Mrs. Viola Von Fumetti, and Mrs,
R. V, Hansel addressed the Coun-
cil relative to the grade of Asbury
Road, Complaints centered around
the lowering of the street level and
the possible need for storm sewers,
Others complained as to the steep-
ness of their driveways while oth-
ers. complained of the steep em-
bankments in front of their homes
caused by the lower grade, Mrs,
Leo Wagner was concerned as to
lower street grade in front of his
place being fearful of water lines
taming too close to the surface
which would cause possible freeze

ups in the winter. City Manager
Schiltz explained that the grade is
now established on Asbury Raad
and that the City cannot change
the grade now withoutencounter-
ing amass of difficulty, such as
having new hearings, breaking of
present. contracts waivers of dam-
ages from all property owners
concerned and the possibility of
several law suits, Several grades
were tried on Asbury Road and
the o'ne presently .established was
decided upon because it proved to
be the best for the most people
concerned, The City had to meet
the county's grade of Asbury Road
and start from there and the proj-
ect was figured the most econom-
ical way possible;
