cll. Councilman: Kintzinger who is
a member of a State- commission
which fs studying bus- companies
all over the State; stated that there'
areaeventeen.bus companies oper-
ating;in Iowa! and not one rof them
is operating:, at a profit. He fur-
ther-.stated that'fn the State of Wis•
consin progress has' been made in
the same situation: by reducing
State taxes to bus operating com-
panies, which has proven to give
enough relief to keep the compan-
ies from operating at a loss. Mayor
Welu stated that the solution to the
problem is patronage and voiced
his hope that every labor local,
merchant's organization. and indi-
vidual should- do ail they possibly
canto promote the use of bus serv-
ice in the Citg.
Mayor Welu moved that the rules
be suspended in order to lbt any-
one. present address. the Council
on any subject they- may desire.

riod of years regarding the parking
Qf vehicles :opposite the driveways
or a :garage hT .a narrow alley or
street.
At the :present time there is no
ordinancecovering this situation.
It is recommended that a new sec-
tion be added to the Traffic Ordi-
nance as follows;
"No person sha-ll "park any ve•
hide opposite any entrance to a
~gar'age nor driveway ~on any street
or .alley twenty feet in width or
less."

Since a new business building has
been erected a't the corner of Lor-
as and Locust Street "a "problem bf
continuous parking at short periods
of time has developed.
Many people parking far long pe-
riods of time 'between 14th and 15th
on Locust make it impossible for
any one to find a place to park in
fhts area when they are doing'busi-
ness.
In order to give relief to-the park-
ing problem as it exists, I recom-
mend that parking be restricted on
the west side of Locust from Zoras
to 3'5th Street to two hours.

Gentlemen:
The petition of Mr. R. G. McNa-
mer and others relative to the nuis-
ances created by the operation of
the Allied Chemical Company, Bar-
rett Division, was referred to the
City Manager and City Solicitor for
investigation and report.
I have investigated this report
without the assistance of the City
Solicitor and find that the. Allied
Chemical Company is in the pro-
cess of making major changes in
their manufacturing plant which
will in -turn eliminate the noise dur-
ing the night time,
One of the major causes of noise
is the cutting of woad into small
chips with large rotary cutters.
This process is continuous for 24
hours at the present time, however,
by December 31st the Company
will have storage capacity avail-
able so that all of the wood cutting
can be done either during one shift
or in same cases may extend into
the second shift, and in no case la-
ter than 11:00 p,m.
In regard to the whistle blowing
which is at the present time auto-
matic and indicates a change of
shift, this will be discontinued.

These sewers will be constructed
in connection with our Sewer Treat-
ment Plant and the Catfish Creek
Interceptor Sewer.

Captain Otto Scharth of the Du-
buque Army Reserve sub-office, ad-
dressed the Council by describing
the planned building as resembling
a modern. one-stpry school type
structure to be used one or two
nights a week for instruction and
the housing of a limited number of
army vehicles and equipment. The
proposed Armory would bs use d
strictly as a training center and
that it could not be used for com-
mercial purposes of any kind, be-
cause it would be under Army con-
trol, It therefore cannot be fairly
compared to the National G u a r d
Armory, and its activities, on
Southern avenue over which th e
Federal Government has no con-
trol, The new Armory would be
built at an estimated cast of $280,-
000 and would enhance the area
and it would further prove to be of
considerable benefit to the City as
a whole. Major Kenneth L. Apel, lo-
cal company: commander address•
ed the Council by stating that Ar-
my reservists, have been. training in
Dubuque since 1948 in such places
as the Fischer Building and. now
presently in the Federal Building,
which testifies to the quiet non-
boisterous nature of the classes. Lt,
Col. Duncan. Glob, battalion com-
mander concurred in the remarks
of the former army personnel

After due consideration of the a-
bove remarks Mayor Welu moved
that the objections in the petition
be overruled and the Clerk in-
structod to send a letter of explana-
tion to the petitioners and it is the
view of the Council that we go a-

buque, Iowa, for the improvement
hereinafter described has :bee n
completed and the City Manager
has certified the completion there-
of to the City Council and the City
Council has ascertained the cost
thereof and has determined that
$107;019.40 Dollars of the cast
thereof shall be .assessed against
the property subject to assessment
therefor; and
Whereas public notice, as pro•
vided by law, has been published
by the City Clerk stating the in-
tention of the Gity Council to issue
bonds for the purpose of providing
for the payment of the assessed

3. Said bonds shall bear interest
at the rate of 5 per cent per an-
num, payable semi-annually in ac-

City of Dubuque liable in any way,

special assessment funds.

they may be payable at any time
prior to the maturity date stated
therein at the option of the City of

OBTAINING FEDERAL AID IN
THE DEVELOPMENT OF THE
DUBUQUE MUNICIPAL AIR-
PORT, UNDER FAAP PROJECT

BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA;
SECTION i. That the City of Du-
buque, Iowa, shall far the purpose
of obtaining Federal aid in the de-
velapment of the DUBUQUE MU-
NICIPAL AIRPORT, enter into a
Grant Agreement with the United
States of America by executing an
acceptance of a Grant Offer from
the Administrator of Civil Aero-
nautics, acting for the Unite d
States of America, to the City of
DUBUQUE, IOWA, and that such
Grant Offer shall be as set forth
hereinbelow under Section 4.
SECTION 2. The CITY OF DU-
BUQUE, IOWA, does hereby ratify
and adopt all statements, represen-
tations, warranties, covenants and
agreements contained in the Proj-
ect Application, which is incorpo-
rated by reference in the said
Grant Agreement.
SECTION 3, That the AIRPORT
COMMISSION OF THE CITY OF
DUBUQUE, IOWA, acting through
its officer or officers designated by
it to so act, is hereby authorized
and directed to execute the accept-
ance of said Grant Offer on behalf
of the CITY OF DUBUQUE, IOWA.

WHEREAS, the Sponsor has
submitted to the Administrator a
Project Application dated March
29, 1950 for a grant of Federal
funds for a project for development
of the Dubuque Municipal Airport
(herein called the "Airport"), to-

ect Application, as approved by
the Administrator, is hereby incor-
posted herein and made a part
hereof; and
WHEREAS, the Administrator
has approved a project for devel-
opment of the Airport (herein call-
ed the "Project") consisting of the
following described airport devel-
opment:
"Construct concrete apron (ap-
proximately 3570 sq, yds,); install
apron lighting system; obstruction
removal; and relocate school-
house." (This work is in addition
to that included in Projects Num-
bered 9-13.020.801; 9-13-020.902, 9-
13.020-203, 9.13.02D-304, 9.13.020505
and 9-13.020-0606).
all as more particularly described
in the property map and plans and
specifications incorporated in the
said Project Application;
NOW THEREFORE, pursuant to
and for the purposes of 'carrying
out the provisions of the Federal
Airport Act '60 Stat, 170; Pub.
Law 377, 79th Congress), and in
consideration of (a) the Sponsor's
adoption and ratification of the
representations and assurances
contained in said Project Applica-
tion, and its acceptance of this Of-
fei•, as Hereinafter provided; and
(b) the benefits to accrue to the
United States and the public from
the accomplishment of the Projcet
and the operation and maintenance
of the Airport, as herein provided,
THE ADMINISTRATOR, FOR
AND ON BEHALF OF THE UNIT-
ED STATES, HEREBY OFFERS
AND AGREES to pay, as the Unit-
ed States' share of costs incurred
in accomplishing the project 50 per
centum of all allowable project
costs, subject to the following
terms and conditions:
1, The maximum obligation of
the TTnited States payable Uhder
this Offer shall be $25,030.
2. The Sponsor shall
(a) begin accomplishment of
the Project within a reasonable
time after acceptance of this
Offer, and
{b) carry out and complete the
Project in accordance with the
terms of this Offer, and the Fed-
eral Airport Aot and the Regu-
lations promulgated thereunder
by the Administrator in effect
on the date of this Offer, which
Aet and Regulations are incor-
porated herein and made a part
hereof, and
(c) carry out and complete the
Project in accordance with the
plans and specifications a n d
property map incorporated
herein as they may be revised
or modified with the approval
of the Administrator or his duly
authorized representatives.
3. The Sponsor shall operate and
maintain the Airport as provided
in the Project Application incorpo~
rated herein.
4. The maximum amounts of
building space whfch the Sponsor
shall be obligated to furnish civil
agencies of the United States for
the purposes and on the terms and
conditions stated in Paragraph 9
of Part III of the Project Applfea-
tion is :set forth in the attached
Schedule of Maximum Rent Free
Space Requirements, which is iu-
corporated herein and made a part
hereof.
5. Any misrepresentation or
omission of a material fact by the
Sponsor concerning the Project or
the Sponsor's authority or ability
to carry out the obligations assum-
ed by the Sponsor in accepting this
Offer shall terminate the obliga-
tion of the tTnited States, and it is
understood and agreed by the Spon-
sor in accepting this Offer that if a
material fact has been misrepre-
sented or omitted by the `Sponsor,
the Administrator on behalf of the
United States may recover all
grant payments made,
6, The Administrator reserves
the right to amend or withdraw
this Offer at any time prior to its
acceptance by the Sponsor.
7, This Offer shall expire and.
the United States shall not be obli-
gated to pay any of the allowable
costs of the Project unless this Of-
fer has been accepted by the Spon-
sor within 60 days from the above
date of Offer or such longer time
as may be prescribed by the Ad-
mnistorator in writing.
8. The Sponsor hereby covenants
and agrees that it Will not permit
or suffer any structure or object,

except such structures as are ne-
cessary as aids to air navigation,
nor will it permit or suffer any use
or activity which would attract or
bring together an assembly of per-
sons, on any land lying within a
zone 1-,000 feet wide and extending
outwardly 2,700 feet from the end
of each runway, to the extent that
the sponsor now holds or may
hereafter acquire ownership or
such other rights as will legally
permit it to carry out its obliga-
tions under this covenant.
9. It is understood between the
parties hereto that any reference
herein or in the Project Applica-
tions shall mean the plans and
specifications approved by Archie
W. League, Chief, Airports Divi-
sion, Region 3, Civil Aeronautics
Administration, on August 7, 1956,
The Sponsor's acceptance of this
Offer and ratification and adoption
of the Project Application incorpo-
rated herein shall be evidenced by
execution of this instrument by
the Sponsor, as hereinafter provid-
ed, and said Offer and acceptance
shall comprise a Grant Agreement,
as provided by the Federal Airport
Act, constituting the obligations
and rights of the United States
and the Sponsor with respect to
the accomplishment of the Project
and the operation and maintenance
of the Airport. Such Grant Agree-
ment shall become effective upon
the Sponsor's acceptance of this
Offer and shall remain in full force
and effect throughout the useful
life of the facilities developed un-
der the Project but in any event
not to exceed twenty years from
the date of said acceptance.
