this is the regular monthly meeting
of tho City Council for the purpose
of acting upon such business as
may properly come before the
mooting.
Councilman Wharton moved that
the rules be suspended for the
purpose oY allowing any one pres-
ent in the Council Chamber, who
wishes to do so, to address the
Council. Seconded by Councilman

1949 were anticipated or provided
for in the petition submitted in
August, 1948, and in view of the
showing made with reference to
other income, we now supplement
our recommendation on Page 3 Af
our report dated February 9, 1949
to the effect:
That the Company's petition aY
August 8, 1948 for revision of gas
rates be accepted and an allowance
be made for $12,000 additional
revenue in the rate schedule, and
that the basic fuel clause as out•
lined in the application of the same
date be embodied in the rate
ordinance, presorted and read.

OF EMERGENCY FUND.
RESOLUTION N0. 68.49
WHEREAS, there now is in the
hands of the treasurer of City of
Dubuque, Dubuque County Iowa,
~, the sum of ;;28,142.44 credited to
the Emergency Fund thereof; and
1VHEREAS, an emergency has
arisen which requires the eapend-
iture of $28,142.44, said emergency
" being of the following character;
The increased cost of necessary
goods and services that moat be
paid out of the Consolidated Fund;
and
~, WHEREAS, the revenue in the
Consolidated Fund is insufficient
to meet its estimated actual and
necessary expenses for the current
fiscal year and the emergency re-
ferred to;
THEREFORE, BE IT RESOLV-
ED by the City Council of the
City of Dubuque, Dubuque County,
Iowa, that $28,142.44 of the funds
In the Emergency. Fund be trans-
ferred permanently to the Consol-
idated Fund of said municipality;
subject to the approval of the
State Comptroller, to be expended
in accordance with the provisions
of Section 24.6 tlf the 1946 code,

The City Auditor of said munici-
pality, upon receipt of approval by
the State Comptroller, fa directed
to correct his books accordingly

An Ordinance amending and chang-
ing the Zoning Map of the City of
Dubugque as provided by Ordinance
No. 3-34, designated "Zoning Ordi-

as to change certain property here-
inafter described from "Two Family
Residence Classification" to "Multi-
ple Residence Classification".
Whereas, it is deemed advisable
by the City Council of the City of
Dubuque to amend the Zoning Ordi-
nance and change the Zoning Map
of the City oY Dubuque so as to
change certain described property
from "Two Family Residence District"
recommended by the Dubuque Plan-
ning and Zoning Commission.
And, Whereas, Notice of such pro-
posed change has been published as
provided by law and an opportunity
afforded to any and all interested
parties and citizens to object thereto
at a public meeting held at 7:30 P.M.,

ern Railroad tracks to Marshal]

Sec. 1. That Farley &Loetscher
Manufacturing Company, a corpora-
tion organized under the laws of the
State of Iowa, with its principal place
o[ business in the City of Dubuque,
Iowa, tta successors and assigns, be
and are hereby authorized to install
and maintain four underground stor-
age tanks on the west side oP Jack-
son Street, south of existing under-
ground storage tanks at the south-
west corner of Jackson and Ninth
Streets in the City of Dubuque, Iowa,
and to attach and maintain pipes
and equipment in connection there-
with, all in accord with plans now
on file in the office of the City Clerk
of the City o4 Dubuque, Iowa. Any
sidewalks or streets torn up in con-
nection therewith are to be replaced
at the cost of Farley & Loetscher
Manufacturing Company., in substan-
tially the same condition as they
esiated before the improvement.

constructed under the direction and
supervision of the City Manager and
Building Commissioner.

deemed urgent and of immediate ne-
cessity shall become effective upon

Delton E. Winters for $1,000.00 for
injuries suffered to Sheryl Lynn
Winters because of injuries receiv
ed by his fiv~year old daughter
on or about December 4, 1948 in
a car that was driven by Delton E.
Winters which ran into and coliid-
ed with a barricade on Windsor
Avenue where a sewer was con-
structed, which was referred to me
far investigation and report. I
found that the said claimant was
arrested and the complaint filed
aga'.nst him in police court for
speeding. That upon trial he was
convicted and paid a fine of $10
and costs; that the car skided
forty-three feet before striking the
barricade, hitting the barricade and
an air compressor which was being
used in the construction of the
sewer; that the barricade had
been put up the night before and
that flares had been lit in front
oT said barricade in the street,
that the flares had been knocked
over, and oil was spilt on the street.
It is my opinion that complainant
is guilty of contributory negligence.
Said Delton E. Winters Piled a
claim for $425.30 damages to his
automobile which was sustained
at the same time and place.
I recommend that both of the
above claims be denied.

me for investigation and report,
the law applicable to this .case is
found in Norman v. City of Char-
iton, 201 Iowa at page 272, which
is as follows:
"The construction and mainten-
ance by a municipal corporation of
a public park constitute the exer-
cise of a governmental function,
and therefore the municipality is
not liable for damages consequent
on the negligence of its own em-
ployees employed on such construc-
tion and maintenance."
I recommend that this claim be
denied.

which Act and Regulations are
incorporated herein and made a

(c) carry out and complete
the Project in accordance with

rovised or modified with the

3. The SAOnaor shall operate
and maintain the Airport as pro-

4. Any misrepresentation or omis-
aion of a material fact by the
Sponsor concerning the Project or
the Sponsor's authority or ability

ed by the Sponsor in accepting
this Offer shall terminate the
obligation of the United States,
and it is understood and agreed
by the Sponsor in accepting this
Offer that if a material .fact has
been misrepresented or omitted by
the Sponsor, the Administrator on
behalf of the United States may
recover all grant payments made.
5. The Administrator reserves
the right to amend or withdraw
this. Offer at any time prior to
its acceptance by the Sponsor.
6. This Offer shall expire and
tho United States shall not be
obligated to pay any of the allow-
able costs of the Project unless
this Offer has been accepted by
the Sponsor within 60 days from
the above date of Offer or such
Im:ger time as may be proscribed
by the Administrator in writing.
The Sponsor's acceptance of this
Offer and ratification and adoption
of the Project Application incor-
porated herein shall be evidenced
by execution of this instrument
by the Sponsor, as hereinafter pro-
vided, and said offer and accept-
ance shall comprise a Grant Agree-
ment as provided by the Federal
Airport Act, constituting the obli-
gations and rights of the U. S. and
the Sponsor with respect to the
accomplishment of the Project and
the oporation and maintenance of

shall. become effective upon the

effect throughout the useful life of

slipped on some dangerous ice on
the sidewalk in front o f t h e
Haudenshield Funeral Home at
1258 Main Street, fell and sustained
injuries to her back which required
medical care and attention and
hospitalization, The actual eapen•
sea run somewhere in the neighbor-
hood of $75.00. After consultation
with her, she has agreed to accept
$75.00 in Yuli payment of her claim.
I recommend that her claim be
allowed in the sum of $75.00, that
a warrant be issued to her for that
amount, and delivered to her upon
delivery to the City of a release
properly executed by her.

the Citq of Dubuque far the fiscal
year beginning April 1, 1949 and
ending March 31, 1950 has been
drlly prepared by the City Manager
and submitted to this Council for
approval; and
WHEREAS, this Council has
examined the detailed distribution
of the proposed expenditures,
wherein estimates of the expenses
of the departments and purposes
are shown, including the estimates
fol• which the consolidated tax
levy and all other levies heretofore
made, receipts Prom moneys and
credits and miscellaneous sources
are to be used, and said distribu-
tion shows all of the proposed
eapenditures far the ensuing fiscal
year; NOW THEREFORE,

Section 2. General Miscellaneous Revenues. Gen-
eral miscellaneous revenues which are collected during,
the fiscal year shall be allocated to the funds and pur-
poses as provided for herein and shall be used for the
payment of the expenses of ouch funds and purposes
in the sums herein shown.
Section 3. Surplus. Any surplus not epectfically
allocated for a .definite purpose in the budget and
which may exist in either the Consolidated Fund or
the miscellaneous revenues account shall be and thel
same is hereby appropriated and set apart to be ap-.
plied as contingencies arise or may be used foi such;
proper purposes as the Council may determine upon,

fund for the purpose of meeting deticienetes in any.
such fund arising from any cause; provided, however,
that no such transfer shall be made except upon writ-
ten approval of the State Comptroller and then only
when such approval is unanimously requested by the
City Council.
Section 6. Delinquent Tax Collections. Delinquent
prior years' tax collections shall be allocated to the'
respective funds entitled to the same when and as the
same are received by the City Treasurer.
Section b. Distribution. That the distribution and
