SUBJECT: Final Plat of Timber Ridge Estates

INTRODUCTION
This memorandum transmits the Final Plat of Timber Ridge Estates, a resolution, and
related materials for City Council review and approval. The submitted Final Plat of
Timber Ridge Estates is a new subdivision located on the north side Derby Grange
Road in Dubuque County. The City and County of Dubuque are jointly reviewing this
Final Plat as it is within two miles of the city's corporate limits. The City Council
approved the preliminary plat for this subdivision on September 19, 2016.
DISCUSSION
The submitted Final Plat of Timber Ridge Estates creates 17 new single-family building
lots and constructs two new private streets to be named Forest Glen Court and Timber
Court. Both private streets will be built with a 22-foot paving width rather than the
County standard of 26-foot paving width. The smaller paving width reduces the amount
of permeable surface and 22-foot is still adequate to serve the 17 building lots.
The proposed new Forest Glen Court will access John F. Kennedy Road and complies
with SUDAS standards for sight visibility. The applicant's engineer has provided the
necessary documentation to the City Engineering Department, which has confirmed that
the new access will meet SUDAS standards.
The subject subdivision complies with the Unified Development Code's 40 points of
sustainability through a mixture of development tools.
1) 22-foot wide private street— 5 points.
2) Solar oriented lots— 30 points.
3) Compliance with the Dubuque County's Erosion and Sediment Control and storm
water management manual — 10 points.

The submitted subdivision does provide sufficient easements to allow for the future
extensions of City water and sewer to the individual building lots. This ensures that the
City will not need to acquire individual easements from future property owners at such
time as City utilities are extended to serve the subdivision. The City Council is also
being requested to approve a pre-annexation agreement for the same property as a
separate item.
RECOMMENDATION
Staff recommends approval of the resolution for the Final Plat of Timber Ridge Estates
subject to allowing 22-foot paving width for Forest Glen Court and Timber Court, and
waiving Sections 11-20 Water Supply, 11-21 Sanitary Sewer, 11-23 Obligation to Install
Improvements, and 11-24 Improvement Guarantees. The submitted Final Plat is in all
other respects in compliance with the Unified Development Code.

Conformance with Comprehensive Plan: This subdivision meets the Comprehensive
Plan Land Use Element Goal 1.2, 1.5, 1.8, 4.3, and 10.2.
Impact of Request on:
Utilities: The proposed Timber Ridge Estates Subdivision will utilize individual
septic systems for each building lot and will have shared wells within the
subdivision for water service.
Traffic Patterns: Access to the proposed subdivision will be off of John F. Kennedy
Road. Based on 2013? IDOT vehicle counts, there were 1,420? average daily trips
on this portion of John F. Kennedy Road's intersection with John F. Kennedy Road.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided there is compliance with the Dubuque County Erosion and Sediment
Control Manual.
Adjacent Properties: Staff anticipates the most noticeable impacts to adjacent
properties will be a change in the visual nature of this property with a change from
open space to residential housing, and an increase in vehicle trips on John F.
Kennedy Road. Staff estimates that the 17 new building lots, when fully built out
with single-family homes, will generate approximately 170 average daily trips.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of Timber Ridge Estates is located on the north
side of John F. Kennedy Road. The proposed subdivision will include 17 new single-
family building lots and the construction of two private streets. The subject subdivision
is jointly reviewed by both the City and County of Dubuque as it is within two miles of
the city of Dubuque's corporate limits.
The Final Plat of Timber Ridge Estates encompasses 17.5 acres. Access to this
proposed subdivision will be from a new private street to be named Forest Glen Court.
In addition, another street to be named Timber Court will create a T intersection with
cul-de-sacs at either end. The applicant's engineer has provided documentation that
the proposed intersection with John F. Kennedy Road will comply with SUDAS
standards for sight visibility.
The proposed private streets within Timber Ridge Estates Subdivision will be built with
22 foot of paving within a 66-foot right-of-way easement. Both private streets will be
built with concrete.

Planning Services Department has reviewed the proposed Final Plat for compliance
with the City's sustainability requirements. The submitted Final Plat of Timber Ridge
Estates proposed the following sustainable subdivision development tools.
Proposed Sustainable Development Tools:
1) Solar oriented lots — 30 points.
2) The two proposed private roadways will be built to 22-foot wide reducing
storm water runoff— 5 points
3) Compliance with Dubuque County stormwater management ordinance —
10 points.
TOTAL: 45 points
Planning staff is willing to allow the 10 points for compliance with the County
stormwater management. The County Ordinance requires that the first 1.25 inches of
rain be infiltrated on site. This requirement is more stringent than current City
requirements.
The developers of the proposed subdivision were required to sign a pre-annexation
agreement with the City. This agreement stipulates that when the City proposes to
annex the property, the property owners, existing and/or future, will agree to the
annexation. In return, the City portion of property taxes will be discounted on a sliding
scale for 10 years. The pre-annexation agreement was signed by the developers and
approved by the City Council at the March 2, 2015 meeting.
The proposed subdivision also provides sufficient easements to extend water and
sewer into the subdivision without the need of acquiring individual easements from each
property owner in the future.
Planning staff recommends the City Council approve the submitted Final Plat of Timber
Ridge Estates subject to allowing 22-foot of paving width for Forest Glen Court and
Timber Court, and waiving Sections 11-20 Water Supply, 11-21 Sanitary Sewer, 11-23
Obligation to Install Improvements, and 11-24 Improvement Guarantees.

RESOLUTION APPROVING THE FINAL PLAT OF TIMBER RIDGE ESTATES IN
DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Timber Ridge
Estates, and
Whereas, said Final Plat provides for a 22 -foot pavement width for Forest Glen
Court and Timber Court, where 26 -foot paving width for a private street is required by
Section 11-15 of Title 16 of the City of Dubuque Code of Ordinances, Unified Development
Code; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and has its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-15 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow two 22 -foot wide paved private
streets.
Section 2. That the City Council hereby waives Sections 11-20 Water Supply, 11-
21, Sanitary Sewer, 11-23 Obligation to Install Improvements, and 11-24 Improvement
Guarantees.
Section 3. That the Final Plat of Timber Ridge Estates is hereby approved and
the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
Final Plat of Derby Grange Acres

City of Dubuque, Iowa, upon said final plat, provided the owners of said property herein
named, execute their written acceptance hereto attached agreeing:
a) To construct private street improvements in accordance with improvement
plans approved by Dubuque County and certified upon completion by a
professional engineer licensed by the State of Iowa.
b) To maintain the private street improvements constructed as part of Timber
Ridge Estates until such time as a homeowners association is formed and is
responsible for maintenance of the same.
Section 5. That in the event Timber Ridge Estates, LLC fails to execute the
acceptance within 180 days after the date of this Resolution, the provisions hereof shall be
null and void and the approval of the plat shall not be effective.
