Mayor Kintzinger read the call and stated that service thereof had been duly made and that this meet• ing is called for the purpose of con- sidering any matters presented to the. Mr, Mertes total hospital bill was in excess of $1400,00, his medi- cal expense was approximately $500,00 and he has a permaennt dis• ability. February 2, 1955 Hon, Mayor and Members of the City Council, City of Dubuque, Iowa Gentlemen: In his last communication to you regarding Radio and TV interfer- ence Mr, Schiltz indicated that we $2 Special Session, )i'ebruary 14th, 1955 were awaiting a report from NIMLO on the subject. That report has now been received and can be sum- marized as follows: There are two types of radiation that can interfere with radio and TV reception, legitimate interfer- ence and "Spurious" radiation. Legitimate interference is the inter- ference caused by a licensed radio or TV transmitter-it includes co- channel and harmonic tnterference. The FCC controls this through the licensing powers and by spacing stations geographically and on the dial. The "spurious" radiation is caused by two types of equipment. In the one there is a legitimate but "restricted" use of radio waves for purposes other than communica• tion; this includes record players, garage door openers, et cetera. In the other type the radiation is only "incidental" such as diathermy ma- chines, electric motors, lighting sys- tems and radio and TV sets them- selves, Part of this "spurious" interfer- ence is now under FCC regulation Industrial, scientific and medical equipment must now be licensed under Part 18 of the Commission's rules. The Commission is proposing to issue rules governing the rest of the restricted and incidental radia- tion. As proposed, all TV and FM receivers would require certifica- tion and the operation of any de- vice which interferes with author- ized radio services would be pro- hibited. Enforcement. Complaints are in- vestigated by the thirty-three field offices and 18 monitoring stations of the FCC. Obviously they are not enough to do the job and have been successfully supplemented in some 358 communities by television interference committees composed of amateur radio operators, TV dis• tributors, industry representatives and other interested volunteers. These committees have often been successful in amicably settling com- plaints. While the FCC welcomes local regulations governing this field it feels the investigation and detection of violations should be accomplished on the Federal level, The FCC would then submit the facts to the local officials, who would take whatever corrective ac- tion is required. January 11, 1955 To the Honorable Mayor and City Council, Dubuque, Iowa Gentlemen: I have been informed by Fire Chief, Thomas C. Hickson, of the outstanding conduct of Pipeman Raymond Ryan, while off duty the night of December 28, 1954. Because of the alertness of Pipe- man Ryan when passing the home of Louis Spielman at 601 Rhomberg Avenue, he observed flames coming from the home. He immediately in- structed an unidentified man to pull the alarm box and then proceeded into the house. He met Mr. Spiel• man and his brother on the steps and told them to get out of the building, but NIi. Spielman said his wife was in there. Pipeman Ryan told him to leave and he would get his wife. Crawling through heavy smoke, he located her and carried her out of the house to a neighbors. He then helped other firemen in extinguish- ing the fire. Pipeman Raymond Ryan is to be commended on 'his conduct and cer- tainly he reflects credit on his de- partment and other city employees. Whereas Pipeman Raymond Ryan of Engine Company No. 5, who re- sides at 535 Southern Avenue, and who was appointed to the Fire De- partment January 2, 1954, who was taking his brother and family home to 900 Rhomberg Avenue at ap- proximately 12;05 A.M, and while passing Johnson and Rhomberg Avenue noticed flames coming out of the side window of the Spielman building. He stopped the car and told an unidentified man to pull the alarm box on the corner of Johnson and Rhomberg. Pipeman Ryan then went to the rear of the building and proceeded to go up to the rear stairway to the 2nd floor apartments when he met Louie and Henry Spielman coming out. Mr, Louie Spielman informed Ryan that his wife was in there yet. Ryan told Louie Spielman to get out of the building and that he would go in and bring her out. After crawling through the heavy smoke, he located her and carried her out of the building to one of the neighbors house, Pipeman Ryan then helped the other firemen in extinguishing the fire. That Interstate Power Company, its successors, or assigns, be and it is hereby granted per- mission to construct and maintain an enclosed overhead bridge span- ning the alley between Lot 37 and Lot 164 A in the original townsite of Dubuque, upon the following terms and conditions; (a) That said structure will be constructed in accordance with the plans now on file and under the supervision and inspection of the Building Commissioner; (b) That said permission shall be subject to the continuous control of the City Council and the City Council reserves the right to im- pose restrictions and conditions upon the enjoyment thereof as it may deem necessary in the public interest, including the right to re- voke and rescind such permission; (c) Should such permission be rescinded or revoked Interstate Power Company shall, within one year after receipt from the City of Dubuque of written ,notice so to do, at its own expense, remove said structure; and in the event of its failure so to do, permittee author- izes the City of Dubuque to remove said structure at permittee's ex- pense, assess the cost thereof against the premises, destroy the materials, and neither permittee, nor its successors or assigns shall have any claim against said City or any of its agents for any damages resulting from the removal of said structure; Section 2. As a further considera• tion of the privileges granted here- in Interstate Power Company, its successors and assigns, assume any and all liability far damages to per- sons and property which may re- sult from the construction or main- tenance of said proposed overhead bridge. The permittee, its succes- sors or assigns, at its own expense, agrees to pay on behalf of the City of Dubuque, all sums which the City of Dubuque may become obligated to pay by reason of any claim arising out of the construc- tion or maintenance of said over- head bridge or in settlement of any such claim. Permittee further agrees to investigate and defend any such claim at its own expense, and on behalf of the City. Section 3. This Resolution shall be in full force and effect from and after its final adoption and the acceptance of the terms and conditions hereof by the permittee. Section 4, That upon the adoption of this Resolution and the accept- ance thereof by permittee, the City Clerk be and he is hereby author- ized and directed to record a certi• fied copy hereof with the County Recorder of Dubuque County, Iowa. It was determined that the new water supply available on City Is- land be developed and that an iron removal and hardness reduction plant be constructed. The need for these facilities has been presented to the City Council and an effort has been made to put it to the people of the community through the media of radio and newspaper publicity. In order that sufficient funds are available to perform this con• struction work, to have sufficient funds available for operation and maintenance and do the necessary main extension work to keep up with the growth of the city, it is necessary that a rate increase be put into effect. The rate increase ordinance that has been prepared will provide the necessary funds for this construction. I recommend that the City Coun- cil adopt these rates in order that we may proceed to provide an ade• quote water supply for the City of Dubuque. Respectfully submitted, L. J. RESOLUTION N0. 46.55 Whereas cities within the State of Iowa have been limited in their operations and the services they can render to our citizens as a re- sult of existing laws affecting mu- nicipalities within the State, Therefore, Be It Resolved by the City Council of the City of Dubuque that they request the Legislature of the State of Iowa to enact such leg- islation that will 1, Prevent undue or unwarranted interference with local government, 2. Leave to cities power to set hours of work and salaries of em- ployees to conform with the budget and their duties, 3. Provide cities with sufficient powers to enable them to satisfy the mounting demands for service that they should be entitled to render. 4, Eliminate the outmoded system of revenue by personal property and real estate taxes and use the modern system of payroll dedue• tion, dividend and sales taxes that are made in the Municipality, 5, Enact State Enabling Legisla- tion so cities and towns can par- ticipate in Federal Housing benefits and slum clearance developments, 6. Remove the battle every two years to have the Legislature enact laws approving the basic rights be- longing to cities, 7. Reapportionment of the legis• lature according to population and not area so cities and towns are truly represented. Passed, adopted and approved this 14th day of February 1955. Nays-None, Absent-Councilman Kolb. 100 Special Session, February 14th, 1955 RESOLUTION N0. 47.55 Whereas there has been intro• duced in the Iowa Legislature a Bill known as House File No. 47 changing the method of assessment and taxation of the property of electric light and power companies; and Whereas this proposed legislation has been reviewed by the City Council of the City of Dubuque and found not to be in the interest of the citizens of the city Be It Resolved 'by the City Coun- cil of the City of Dubuque that House File No, 47 will create a hardship on the taxpayers of the ,city in providing police, fire, sani• tation, sewage, and other services far the electric light facilities, on which other taxing bodies will re• eeive the taxes. The distribution of the basis of mileage will greatly decrease the city tax revenue de• rived from our electric utility com• pony and result in an increase in property taxes on other real estate, approximately 8%.
