is the regular monthly meeting of
the City Council for the purpose of
acting upon such business as may
properly come before the meeting,

of Iowa, 1950, pertaining to public
contracts and bonds, and the time
and place fixed for the hearing of
all objections. to said plans, specifi-
cations or contract for or cost of
suoh improvements, said time being
this 7th day of March, 1955, and
Whereas, the City Council met in
regular session this 7th day of
March, 1955, at 7;30 o'clock P.M, at
the Council Chambers in the City
Hall for the purpose of hearing all
interested parties and considering
any and all objections whioh have
been filed to the proposed plans,
specifications or contract for or
cost of the improvement herein de-
scribed and proposed to be made;
and
Whereas, all interested parties
have been given an opportunity to
be heard and all objections which
have been duly weighed and con-
sidered; now, therefore
Be It Resolved by the City Coun-
cil of the City of Dubuque, that all
objections which have been made
and filed to the plans, specifica-
tions, contract for or cast of said
improvement herein described and
proposed to be made, be and the
same hereby overruled and such
plans, specifications and form of
contract heretofore are hereby
adopted,
Be It Further Resolved that this
resolution containing the decision
of this Council upon all objections
which have been filed to the plans,
specifications and form of cost said
improvement be made a matter of
permanent record in connection
with said improvement.

Section 2, Said improvements
shall be constructed under contract
and in accordance with the plans
and specifications which have been
prepared therefor by the City En-
gineer and which together with the
Plat and Schedules for such im-
provements,have been approved by
the City Council and are now on
file in the office of the City Clerk.
Section 3. That the cast and ex-
pense of making said improvements
will be assesed upon and against
all privately owned property lying

within the assessable distance pro-
vided by law and in an amount not
to exceed the amount provided by
law. Property will be assessed,
whether the same abuts on any of
said portions of said street or is
adjacent thereto according to area
and in proportion to the special
benefits conferred theroby, and any
deficiency shall be paid out of the
street fund. The railway portion of
any such streets shall be assessed
against the railway company.
Section 4, That the City Council
by this resolution gives notice of
its intention to issue bonds as pro-
vided by Section 396.6 of the Code
of Iowa, 1950, for the purpose of
providing for the payment of the
assessed cost of said improvements;
said bonds to be issued in anticipa-
tion of the deferred payment of the
assessments levied therefor, and
that said bonds will be sold at pub-
lic sale in the manner provided by
law, but shall not be sold for less
than their par value with accrued
interest from date of bonds to the
time of delivery thereof.
Section 5. That unless property
owners at the time of final con-
e sideration of this resolution have
on file with the City Clerk objec-
tions to the amount of the proposed
assessment, they shall be deemed
to have waived all objections there-
to,
Section 6. For purposes of brev-
ity and reference all the foregoing
improvements shall be known as
"City of Dubuque 1955 Asphaltic
Concrete Surfacing Project Num-
ber 1."

150 calendar days after (date of
contract is sufficient) to complete
this improvement.
Be It Further Resolved that this
resolution being deemed urgent and
of immediate necessity shall be in
force and effect from and after its
passage and adoption by the City
Council.

Whereas, the City of Dubuque, in
Dubuque County, Iowa, has hereto-
fore established a municipal water
works plant and system the man-
agement and control of which is
vested in the City Council of said
City and pursuant to a resolution
finally adapted by the City Council
of said City on May 14, 1952, there
have been heretofore issued and
are now outstanding Water Reve-
nue Bends, 1952 Series, of said
City to the amount of $200,000, dat-
ed April 1, 1952, bearing interest
at the rate of two and one-half per
cent per annum and maturing
$50,000 on December 1 of each of
the years 1955 to 1958, inclusive,
and in and by said resolution the
right was reserved to the City to
from time to time authorize, issue
and deliver under specified condi•
tions additional Water Revenue
Bonds ranking on a parity with
the bands thereby authorized; and
Whereas, this Council has here-
tofore determined it advisable and
necessary that the City of Dubuque,
Iowa, improve and extend its mu-
nicipal waterworks plant and sys-
tem, the estimated cost of which
improvements and extensions ag-
gregates $1,500,000 and under the
provisions of Sections 397.9 et seq.
of the Code of Iowa, 1954, said City
is authorized to issue negotiable in-
terest bearing revenue bonds for
the purpose of defraying the cost
of such improvements and exten-
sions which bonds are to be paid
from the net earnings of such wa-
terworks plant and system; and
Whereas, a notice of the inten-
tion of this Council to take action
for the issuance of said additional

tending the meter parking zone to
include the south side of 14th.
Street between Central and White
Streets, was referred to the Police
Chief and Traffic Department for
investigation and report.
The report of the Police Depart-
ment is that the petition asked for
a short time parking particularly
between Central and White Street
on the south side of 14th Street,
Because of the fact that there is
a driveway between the alley east
of Central and White Streets, it
would only require restrictions on
the half block area between Cen-
tral and the alley.
It is believed that the bulk of
the business in this area would be
done in short periods of time and
that 12 minute meters on the south
side of 14th Street from Central to
the alley would provide the relief.

V of Ordinance 33-49 be amended

During the last three years the
accident rate at the intersection of
15th and Iowa Streets .has been
quite bad. All of the collisions have
been right angle collisions. It is be-
lieved that the main reason for the
many number of collisions of traf-
fic in both directions is due to vis-
ability,
It is recommended that Section U
of Schedu]e H be amended by strik-
ing the semicolon at the end of
the present section and adding
thereto; "and from the north line
of Loras Boulevard to the south
line of West 17th Street,"
This will make Iowa Street a
through street.

Gentlemen:
At the request of Fire Chief
Hickson, a study was made of the
traffic conditions on Jackson Street
between 8th and 11th Streets.
The following is the reconunen-
dation of the Police Chief after a
thorough study by the traffic de-
partment, and I concur in this rec-
ommendation.
Presently about 30 to 37 vehicles
park along the curb on both sides
of Jackson Street in this vicinity.
Jackson Street is slightly over 40
feet wide. The area has been under
observation for sometime and there
are comparatively no periods dur-
ing which boxcars are not parked
on the rails in the approximate cen-
ter of Jackson Street. The outside
width of box-cars usually parked
on the rails is about 10 feet 4
inches. This does not include pro•
tuberances such as door handles.
The motor vehicles are about 6 feet
in width.
With vehicles parked on both
sides of Jackson Street and a box-
car on the rails, a total of about
221/s feet of the street width is
taken up. This means that there is
less than 9 feet of roadway avail-
able for traffic between the parked
cars and the standing boxcars.
This is a maximum of space as less
space is available when the ve•
hicles are not parked tight against

sufficient for normal traffic with
;passenger cars under slippery con-
ditions. It is definitely not suf-
ficient space far trucks or fire ve-
hicles,
If parking were restricted on
both sides of Jackson Street from
8th Avenue to the end of the rail
only 37 vehicles would be affected,
These appear to be about evenly di-
vided between Farley and Loetsch-
er and the Carr Adams Collier
Company. It is true that the restric-
tion of vehicle parking on the west
side of Jaekson Street would not
open any additional room for mov
ing traffic because this side of
Jackson Street is usually blocked
by conveyors or wagons loading or
unloading lumber, But it must be
remembered that the factories on
both sides of Jackson Street would
be considered highly flammable
along with their contents therefore
making it highly important that
fire fighting equipment get to the
fire as soon as possible, Even with
conveyors in place, it would be
possible for fire fighting equip-
ment to get along side the build-
ings from one end or the other.
Several sideswiping accidents oc-
cur in this locality every year be-
cause of the narrowness of the
roadway.
Therefore it is recommended
that Schedule VI of Ordinance 33.49
be amended by adding thereto a
section as follows: "Both sides of
Jackson Street from 8th Avenue to
a point 140 feet south of the south
curb of East 11th Street"

Gentlemen;
I am attaching herewith a Resolu•
tion for your consideration in re-
gard to the exemption of city tran-
sit systems from the payment of
State Motor Vehicle Fuel Tax.
Motor bus operations in all cities
in the state of Iowa have been car-
ried on at a considerable loss dur-
ing the past few years due to the
increase in the number of people
using their own vehicles.
The Bills introduced in the Leg-
islature to exempt transit com-
panies from paying this tax would
in my opinion benefit those com-
munities that need a transit sys-
tem,
There have been bills introduced
in the Legislature authorizing cities
to operate transit systems, and I
feel that this operation should be
private and not public.
The amount of money saved by
not paying tax is not a great
amount, however, could be a con-
tributing factor in continuing pri-
vate transit systems in Dubuque.

Vehicle Fuel Taxes.
Whereas, there has been intro-
duced in the Iowa State Legisla-
ture Senate File 59 and companion
House File 206, which exempts city
transit bus systems from payment
of the State Vehicle Motor Fuel
Tax, and
Whereas, our local transit com-
pony has been operating their sys-
tem at a loss because of a decrease
in riders, and may effect the serv-
ice rendered by them in the future,
and
Whereas, it is essential to the fu-
ture welfare and continued growth
of our city that the present transit
service be maintained, and
Whereas, less than 5% of the ve-
hicles of our local transit service
travel over State or Federal High-
ways in the city, and
Whereas, a comparatively small
percentage of the State Motor Fuel
Tax now paid by our local transit
system is returned to the city for
the building and upkeep of streets
over which local transit service is
provided, and
Whereas, unless tax relief meas-
ures are enacted many transit com-
panies will no longer be able to
provide adequate service and many
cities may in the near future be
without this essential transit serv-
ice, and
Whereas, the Mayor and City
Council's position in this matter
should be expressed to the legis-
lature.

to the special benefits conferred
thereby, and any deficiency shall be
paid out of the street fund. The
railway portion of any such streets
shall be assessed against the rail-
way company.
Section 4. That the City Council
by this resolution gives notice of
its intention to~ issue bonds as pro-
vided by Section 396.6 of the Code
of Iowa, 1954, for the purpose of
providing for the payment of the
assessed cost of said improvement:
said bonds to be issued in antici-
pation of the deferred payment of
the assessments levied therefor, and
thaq said bonds will be sold at
public sale in the manner provided
by law, but shall not be sold for
less than their par value with ae•
trued interest from date of bonds to
the time of delivery thereof.
Section 5, That unless property
owners at the time of final con
sideration of this resolution have
on file with the City Clerk objec-
tions to the amount of the proposed
assessment, they shall be deemed
to have waived all objections

Section 1, That the owners of
all propenty abutting on said im-
provement are hereby required to
make connections from the Sewer,
Water and Gas mains to ,the curb
line of said property prior to Aprll
16,1955;
Section 2, That the City Clerk is
hereby authorized and directed to
serve a written notice on such
abutting property owners in ac-
cordance with Ordinance No. 128,
ordering compliance with this
Resolution;
Section 3, That in the event any
such property owner shall fail or
refuse to make such .connection
within the time set ou't in this
Resolution, then the City Manager
shall proceed to have said connec•
tion made upon a contract made
and entered into for that purpose
and upon completion, report said

$7500 for injuries sustained from a
fall on a sidewalk July 16th, 1953.
I have investigated the claim and
discussed bhe matter with her at-
torneys and find that this lady was
hospitalized for approximately five
weeks as bhe result of a secondary
prepatellar bursitis and incurred
medical expense in the amount of
$464.
There is some question of the lia-
bility of the City for this injury
and for this .reason we have en-
tered into a settlement agreement
in the amount of three hundred
dollars.
I recommend that this settlement
be approved and the Auditor in-
structed to issue a warrant in the
amount of $300 payable to Agnes
Bowman and J. Edward Whelan,
her attorney and deliver the same
upon receipt of a properly executed
release,

According to our present zoning
ordinance this location is not zoned
for business and therefore would
have to be rezoned to comply with

Gentlemen: At a meeting of the
Planning and Zoning Commission
held March 10,1955, the petition of
Roy Ayers, 1633 Hickson Avenue,
requesting rezoning of certain lots
at Pennsylvania Avenue atld Green
Street to local Business District
was considered. Mr, Ayers was
present at this meeting and stated
he wished to establish a store sell•
ing confections, etc., on property
owned by a Mr, Baumhover, The
petition as presented did not con-
tainthe owner or the agent's name,
the agent had called the Building
Department and asked who was pe-
titioning for this property and he
indicated no desire to have it re-
zoned, Mr. Ayers said he had first
chance to buy thisproperty ap-
parently from Mr. Baum'hover. The
procedure of rezoning by proper
petition was explained to Mr. Ayers
and he indicated he would present
a petition signed by the property
owner,
No action was taken on this pe-
tition because the owner or agents
name did not appear on same.
The Planning and Zoning Com-
mission has been and is now study-
ing,the rapidly developing area and
s will present to the Council in the
near future severallocations that
would be desirable Local Business
Districts.

the purchase of said Water Reve-
nue Bonds, 1955 Series, as adver-
tised, upon terms of par and ac-
crued interest plus a premium of
$0,400.00 is bhe hig7rest and best
bid received and that said bonds
bearing interest at the rate of two
and three-eighths per cent (23/a%)
per annum be and the same are
hereby awarded to said Paine, Web-
ber, Jackson & Cirtis et al.
Section 2. That the form of
agreement of sale of said bonds to
Faine, Webber, Jackson & Curtis
et al, be and the same is hereby
approved, and the Mayor and City
Clerk are hereby authorized to ex-
ecute said agreement for and on
behalf of the City of Dubuque,
Iowa, and to affix the corporate
seal of said City thereto.
