Whereas the city Manager has

he has negotiated with the owner
of said real estate and has been
unable to arrive at a mutually sat-

Now Therefore, Be It Resolved
by the City Council of the City of
Dubuque, Iowa;
Section 1. That it is hereby de-
termined that the public interests
and necessity require the acquisi-
tion of the above described real
estate by the City of Dubuque,
Iowa, and that municipal recrea-
tion facilities, including a swim-
ming pool, be established thereon;
Section 2. That the City Solici-
tor be and ho is hereby instructed
and directed to .institute condemn
nation proceedings under the pro•
visions of Chapter 472 of the 1950
Code of Iowa in the. name of the
City of Dubuque to acquire the
above described real estate for the
City of Dubuque and determine
the damages resulting from such

light conditions on this street and
also others in the vicinity amd
recommend that lights be installed
at the following locations:
1. Intersection of Nebraska. and
M;ePaland.
2. On McPoland between Ne-
braska and Pennsylvania.
3. At the intersection of Wis-
consin and Marmora.
4. Intersection of Fairfax amd
Marmora,
5. On Fairfax Street midway be-
tween Marmora and Pennsylvania,
6, On Hickson Avenue, two
lights between Lenox and Pennsyl-
vania,
Z On Drexel between Illinois
and Pennsylvania,
I also recommend that three
street lights be plas;ed on East
16th Street between Sycamore and
the present city land fill oast of
Marsh Street.
These lights will be placed at
the direction of the city electrical
inspector.

that the north side of University

limited parking zone at all times

and Chief of Police for investiga-
tion and report.
The petition; asked for thirty
minute parking restriction. How-
ever, it is believed that it would
not be necessary ho restrict park-
ing to this extent. Parking should
be restricted, but. it is felt that
if the long timle parker is re-
moved, sufficient space wauid_be
available for short time porkers,
It is recommended that a two
hour parking zone be established
in this area and that Section 2 of

557-53, adopting final assessment

scribing terms of payment there-
of and directing the City Clerk to
certify the final schedule and to
publish notice for bhe construction
of a cast iron water main for the
1953 Water Main Project No. 1
of the City of Dubuque; and
Whereas said Resolution directed
the City Glerk to certify bhe final
schedule of assessments for said
improvement to the County Auda•
for of Dubuque County, Iowa, and
to publish notice thereof by publi-
cation in bhe Telegraph Herald
newspaper once each week for two
consecutive weeks, the first pub-
lication of which should. be not
more than fifbeen days from the
date of filing of the final schedule;
and
Whereas through clerical over-
sight said notice was published but
once;
Now Therefore Be It Resolved By
The City Council of the City of
Dubuque,
Section 1. That the assessment
schedule for said improvement as
determined by said Resolution No.
557-53 is hereby confirmed.and the
City Clerk is hereby directed to file
anew schedules of assessments to
'the County Auditor of Dubuque
County, Iowa, and -to publish no-
tice of such filing. by publication
in the Telegraph Herald onto each
week for two consecutive weeks,
the first publication of which shall
be not more than fifteen days from
the date of the filing of the final
schedule;
Section 2. That the filing of such
schedule anew shall not constitute
an additional assessment against
the property set out therein but
solely and only for the purpose of
establishing the time for appeal
from said assessments, as provided
in Section 31.2 of Chapter 156 of
the Laws of the 54th G.A., as
amended.
Section 3. That any person or
corporation having interest in the
property listed in said schedules
shall have the right to appeal
from bhe amount of such assess-
ment at any time up to twenty (20)
days after the final publication of
such notice by petition to bhe Dis-
trict Court of Dubuque County,
Iowa, but such appeal shall go only
to the amount of that assessment.
