Zoning Advisory Commission One, 3-year term through July 1 , 2019 (Expiring term of Belmont) Applicant: Michael Belmont, 222 Dillion St This commission is subject to the State of Iowa Gender Balance Law. 7 Commissioners total; currently 4 males/2 females Title 8 Chapter 2 HUMAN RIGHTS COMMISSION Amended 7-21-15 8-2-1: COMMISSION CREATED: There is hereby created the Human Rights Commission. 8-2-2: PURPOSE: The purpose of the commission is to hold hearings, compel the production of evidence, and determine the merits of complaints alleging unfair or discriminatory practices in housing, employment, education, credit, or places of public accommodation; to investigate and study the existence, character, causes, and extent of discrimination and to attempt to eliminate discrimination by educating the public and promoting human rights in the community; and to take action in the community to promote civil and respectful behavior and to eliminate discrimination based on age, race, creed, color, sex, national origin, religion, ancestry, disability, marital status, familial status, sexual orientation, or gender identity. 8-2-3: INTERNAL ORGANIZATION AND RULES: The commission may adopt rules and regulations to govern its organizational procedures as may be necessary and which are not in conflict with this Code of Ordinances or the Iowa Code. 8-2-4: PROCEDURES FOR OPERATION: All administrative, personnel, accounting, budgetary, and procurement policies of the city govern the commission in all its operations. j 8-2-5: MEMBERSHIP: A. The commission comprises nine (9) residents of the city, appointed by the city council p from various racial, religious, cultural, and social groups within the city. B. Residents must be eighteen (18) years of age or older. C. Membership on the commission must comply with the provisions of Iowa Code §69.16A, 9 relating to gender balance. No person can be appointed or reappointed to the commission if that appointment or reappointment would cause the number of members of one gender to be greater than one-half (1/2) of the membership of the commission plus one (1). If the city has made a good faith effort to appoint a qualified person to fill a vacancy on the commission for a period of three (3) months but has been unable to make a compliant appointment, the city must utilize a fair and unbiased method of selecting the best qualified applicants. 8-2-6: OATH: Each person, upon appointment or reappointment to the commission, must execute an oath of office at the first meeting of the commission following the appointment or reappointment or at the city clerk's office any time prior to the first meeting of the commission. 8-2-7: TERMS: The term of office for commissioners is three (3) years or until such commissioner's successor is appointed and qualified. f I 3 e 8-2-8: VACANCIES: Vacancies must be filled in the same manner as original appointments. 8-2-9: OFFICERS/ORGANIZATION: The commissioners must choose annually a chairperson and vice-chairperson, each to serve a term of one (1) year. The chairperson must appoint a secretary, who need not be a member of j the commission. The commissioners must fill a vacancy among its officers for the remainder of the officer's unexpired term. 8-2-10: MEETINGS: A. Regular Meetings. The commission must meet monthly. B. Special Meetings. Special meetings may be called by the chairperson or at the written request of a majority of the commissioners. i C. Open Meetings. All meetings must be called and held in conformance with the Iowa Open Meetings Law. J D. Attendance. 1. In the event a commissioner has been absent for three (3) or more consecutive meetings of the commission, without being excused by the chairperson, such absence will be grounds for the commission to recommend to the city council that the position be h declared vacant and a replacement appointed. 2. Attendance must be entered upon the minutes of all meetings. E. Minutes. A copy of the minutes of all regular and special meetings of the commission must be filed with the city council within ten (10) working days after each meeting, or by the next regularly scheduled city council meeting, whichever is later. F. Quorum. Five (5) commissioners constitute a quorum for the transaction of business. The affirmative vote of a majority of the commissioners present and voting is necessary for the adoption of any motion or resolution. 8-2-11: COMPENSATION: p Commissioners serve without compensation, provided that they may receive reimbursement for necessary travel and other expenses while on official commission business within the limits established in the city administrative policies and budget. 8-2-12: REMOVAL: The city council may remove any commissioner for cause upon written charges and after public hearing. 8-2-13: POWERS: The commission has the following powers, duties, and responsibilities: A. To receive, investigate, and finally determine the merits of complaints alleging unfair or discriminatory practices. a I B. To investigate and study the existence, character, causes, and extent of discrimination in public accommodations, employment, apprenticeship programs, on-the-job training programs, vocational schools, other educational institutions, and housing in the city and to attempt the elimination of such discrimination by education and conciliation. C. To hold hearings upon any complaint made against a person, an employer, an employment agency, a labor organization, or the employees or members thereof, to subpoena witnesses and compel their attendance at such hearings, to administer oaths and take the testimony of any person under oath and to compel such person, employer, employment agency, labor organization, or employees or members thereof, to produce g for examination any books and papers relating to any matter involved in such complaint. The commission will issue subpoenas for witnesses in the same manner and for the same purpose on behalf of the respondent upon the respondent's request. Such hearings may be held by the commission, by any commissioner, or by any hearing examiner appointed by the commission. If a witness either fails or refuses to obey a subpoena issued by the commission, the commission may petition the district court having jurisdiction for issuance of a subpoena and the court must, in a proper case, issue the subpoena. Refusal to obey such subpoena is subject to punishment for contempt. a D. To issue such publication and reports of investigations and research as in the judgment of the commission to promote civil and respectful behavior which tends to eliminate discrimination. N E. To prepare and transmit to the mayor and city council from time to time, but not less often than once each year, reports describing its proceedings, investigations, hearings conducted, and the outcome thereof, decisions rendered, and the other work performed by the commission. F. To make recommendations to the city council concerning discrimination. G. To cooperate, within the limits of any appropriations made for its operation, with other agencies or organizations, both public and private, whose purposes are consistent with those of this Chapter, in the planning and conducting of programs designed to eliminate discrimination or cultural and intergroup tensions. H. To adopt, publish, amend, and rescind regulations consistent with and necessary for the enforcement of this Chapter. ° I. To delegate any of its functions, duties, and powers to its staff including functions, duties, and powers with respect to investigating, conciliating, determining, certifying, reporting, or otherwise acting as to any work, business, or matter under this Title. J. To receive, administer, dispense, and account for any restricted funds that may be voluntarily contributed to the commission and any grants that may be awarded the commission for furthering the purposes of this Title. No disbursements will be made of any restricted funds without authority from the city council. 8-2-14: RECORDS TO BE PUBLIC; EXCEPTIONS: All records of the commission are public except charges, complaints, reports of investigations, statements, and other documents or records obtained in investigation of any charges. 8-2-15: CONFIDENTIALITY OF COMPLAINTS: No member of the commission or its staff will disclose the filing of a charge, the information gathered during the investigation, or the endeavors to eliminate such discriminatory or unfair practice by conference, conciliation, or persuasion unless such disclosure is made in connection with the conduct of such investigation or after the commission has held a public hearing upon a complaint filed in connection with such charge. This Section does not prevent any complainant, witness, or other person from publicizing the filing of a charge or complaint or the matter therein complained of. 8-2-16: SUBPOENAS: The commission may issue subpoenas and order discovery in aid of investigations under this Title. The Authority shall consist of all the following political subdivisions: 'i (1) The City of Dubuque; (2) Dubuque County; (3) The City of Asbury; (4) The City of Peosta; (5) The City of Centralia; (6) Dubuque Soil and Water Conservation District. j SECTION 5. BOARD OF DIRECTORS 5.1 The governing body of the Authority shall be the Board. { 5.2 Directors of the Board shall. be divided among the political subdivisions comprising the Authority and shall be appointed by the respective political { subdivision's elected legislative body. 5.3 Based upon Watershed demographics (area, population, and value) the Directors of the Board shall be appointed in the following manner: (1) The City of Dubuque: 3 Directors (2) Dubuque County: 2 Directors (3) The City of Asbury: 1 Director 1 (4) The City of Peosta: 1 Director (5) The City of Centralia: 1 Director (6) Dubuque Soil and Water Conservation District: 1 Director 5.4 The Directors shall serve staggered terms of four years. The initial Board shall determine, by lot, the initial terms to be shortened and lengthened, as necessary, to achieve staggered terms. A person appointed to fill a vacancy shall k be appointed in the same manner as the original appointment for the duration of the unexpired term. A Director is eligible for reappointment. 5.5 The Board may provide procedures for the removal of a Director who fails to attend three consecutive regular meetings of the board. If a Director is so removed, a successor shall be appointed for the duration of the unexpired term of the removed Director in the same manner as the original appointment. The appointing body may at any time remove a Director appointed by it for misfeasance, nonfeasance, or malfeasance in office. 5.6 The Board shall adopt bylaws and shall elect one Director as chairperson and one Director as vice chairperson, each for a term of two years, and shall appoint a secretary who need not be a Director. It shall be the duty of the 3 chairperson to appoint a Director to keep minutes at all meetings. 5.7 The Board shall comply with Open Meeting Law. 5.8 A majority of the membership of the Board shall constitute a quorum for the purpose of holding a meeting of the Board, The affirmative vote of a majority of a quorum shall be necessary for any action taken by an Authority unless the Authority's bylaws specify those particular actions of the Authority requiring a greater number of affirmative votes. A vacancy in the membership of the Board shall not impair the rights of a quorum to exercise all the rights and perform all the duties of the Authority. 5.9 Directors shall serve without compensation from the Board, but this shall not prevent a governmental unit from providing compensation for its Director for serving on the board, if such compensation is authorized by such governmental unit and by law, Board funds may be used to reimburse a Director for expenses incurred in Board business and authorized by the Board. 5.10 The Board shall meet quarterly and/or as deemed necessary to set goals, and to review current and potential developments, grant opportunities, past accomplishments and future challenges, 5.11 The Board shall hold an Annual Review meeting each December to review accomplishments, challenges, and the associated fee schedule. 5A2 Apolitical jurisdiction which has chosen not to join the Authority, join in the future upon approval of the Board. SECTION 6. POWERS OF THE BOARD. The.Board may: 6.1 Assess the flood risks in the watershed. 6.2 Assess the water quality in the watershed. 6,3 Assess options for reducing flood risk and improving water quality in the watershed. 6.4 Monitor federal flood risk planning and activities. 6.5 Educate residents of the watershed area regarding water quality and flood risks. 6.6 Allocate moneys made available to the authority for purposes of water quality and flood mitigation, 6.7 Make and enter into contracts and agreements and execute all instruments necessary or incidental to the performance of the duties of the authority. A watershed management authority shall not acquire property by eminent domain. 6.8 Employ such persons as it deems necessary to accomplish its duties and powers. Any employee may be on a full-time, part-time, or consulting basis as the Board determines and shall be considered Board staff. fj 6.9 Contract for space and for material and supplies to carry on its activities. 6.10 Cooperate or contract with the State of Iowa or any subdivision thereof or federal agency or private or public organization to accomplish the purposes for which it is organized. 6.11 In cooperation with the Dubuque Soil and Water Conservation District, appoint or administer a procedure to develop and complete a Watershed management plan for all of Catfish Creek, 6.12 Act as an advisory development review committee, for all political subdivisions, for all or any land disturbing and/or hydrologic alternations to the Watershed. 6.13 Provide any member with technical data or any other information of which the board has knowledge; which will assist the political subdivision in preparing land use classifications, urban Best Management Practices (BMPs), or Watershed management plans. 6.14 Establish and maintain devices for acquiring and recording hydrological and water quality data within the Watershed. 6.15 Establish a Technical Advisory Committee (TAC) comprised of staff from each Member. The TAC may be used to assist with grant applications, review of development approvals or procedures, or technical evaluations 'of capital projects. SECTION 7. ADMINISTRATION. Administration of the Authority will be co- coordinated by the Dubuque Soil and Water Conservation District's Urban Conservationist and a member of the City of Dubuque's Engineering staff as appointed by the City Manager until the Board determines under Section —that another method is more appropriate or viable. SECTION 8. COMMUNICATIONS. Each party shall designate an individual as the primary contact. Such designation shall be in writing, and any change in designation shall also be in writing. SECTION 9. DURATION; WITHDRAWAL OF MEMBER 9.1 This Agreement shall take effect upon execution by the parties as required by law, filing with the secretary of state and recording with the county recorder. This Agreement shall be in effect perpetually until terminated by agreement of all of the parties. 9.2 A party may withdraw from the Authority at any time by providing the other parties sixty (60) days notice of intent to withdraw. 9.3 A governmental subdivision which has withdrawn from the Authority may re Join upon written request to the Board. SECTION 10. PARTNERSHIP OR JOINT VENTURE. The parties to this Agreement acknowledge that this is an independent venture of the parties and that none of the parties is a partner or joint venturer with any other party. The parties have no duties or responsibilities to each other, financial or otherwise, except as described herein. SECTION 11. ENTIRE AGREEMENT. 11.1 This Agreement contains the entire agreement and integrates all of the terms and conditions contained in and incidental to such agreement and supersedes all prior negotiations and communications concerning this agreement, oral or written, between the parties, their agents, employees and representatives. No modifications or waiver of any provision in this Agreement shall be valid unless in writing and signed by all of the parties. If, for any reason, any provisions of this Agreement shall be inoperative, the validity and affect of the other provisions shall not be affected thereby. jJ 11.2 If any provisions of this Agreement is found to be invalid by any court, administrative agency, or tribunal of competent jurisdiction, the invalidity of any such provision shall not affect the validity of the remaining provisions hereof. 11.3 This Agreement shall be binding upon and inure to the benefit of the parties and their respective successors and assigns. The parties agree that none of the parties shall have the right to assign their rights and obligations hereunder to any party without prior written consent of the other parties. Such consent shall not be unreasonably withheld. SECTION 12. GOVERNING LAW. This Agreement shall be governed by and interpreted under the laws of the State of Iowa. SECTION 13. PROHIBITION ON TAXATION. The Authority shall have no authority to levy any tax. 6 SECTION 14. AMENDMENTS. This Agreement may be amended at any time by the parties. All amendments shall be in writing, signed by all of the parties, and filed in an electronic format with the Iowa Secretary of State as required by Iowa Code section 28E.8 (2011). SECTION 16. FILING AND RECORDING. Franchise Term The proposed franchise term is fifteen (15) years. The franchise would be for the delivery of cable services and would be nonexclusive. i 2. Broadcast Basic Tier y While the size, contents, and pricing of a basic cable service package cannot be a formal term of the agreement, Mediacom has represented to the City that it will begin to offer a limited "broadcast basic" package with 21 channels. By federal law, these must include the broadcast TV stations and the local PEG (Public, Educational and Government) access channels. 3. Senior Citizen Discount !I Mediacom will maintain the current ten percent (10%) Senior Citizen discount on the 72-channel Family Cable tier, which is currently priced at $45.50 for most subscribers, $40.95 for seniors. There will be no discount on the price of the limited "broadcast basic" package. A subscriber(head of household) who reaches the age of 65 and submits an application to Mediacom with proof of age and proof of at least one other utility in their name at that address will qualify for the Senior Citizen discount. 4. Technology Updating Fund j To keep the cable system as technologically current as possible, Mediacom will contribute $300,000 per year in years one through twelve of the franchise, (totaling $3.6 million), to an Updating Fund. This money l can only be spent by joint agreement of the City and Mediacom. i 5. System Upgrade Within twenty-four (24) months of the signing of the agreement, Mediacom will upgrade the electronics in their Dubuque cable system to increase the total bandwidth (capacity)from the current 750 MHz to 860 MHz. Mediacom would expend all or part of the first four years of contributions to the Updating Fund (above) on this upgrade. l U 1 I� I q I� I�I l w 6. Annexation Consistent with the City's obligation to extend utilities, Mediacom would have up to three years to provide cable television services throughout an !o annexed area. li 7. Digital vs. Analog While this issue will be subject to significant FCC regulation; Mediacom will be permitted to convert digital signals to analog to avoid making old analog television.sets obsolete. They will also strive to pass digital and high-definition (HDTV) signals to the greatest extent possible to accommodate new television receivers designed for these signals. Eventually, the entire television signal spectrum will evolve to digital technology. 8. Institutional Fiber Network(I-Net) Within the first 18 months of the agreement, Mediacom will construct a new "dark fiber" Institutional Network. The term, "dark fiber" means that a users, not Mediacom, provide and operate the end devices to light the fiber. Separate from the subscriber network, this I-Net will interconnect 77 h government, educational and not-for-profit facilities in Dubuque. The City will be able to use the I-Net for any non-commercial purpose. Hospitals and medical facility use of the I-Net will be restricted to community emergency situations, and all other not-for-profit facilities, including educational institutions, will be subject to restrictions on their use of the I- Net for communications outside the network. �1 The City will possess an indefeasible right to use the fiber optic plant dedicated to the ]-Net, and will also have the option to purchase the 1-Net from Mediacom on terms stipulated in the franchise agreement. i 9. ICN Links Mediacom will continue to maintain and operate all existing links to the Iowa Communications Network (ICN) at no charge, and the new fiber I-Net �. may be interconnected with the ICN, consistent with I-Net use requirements. 10. Business Fiber Optic Infrastructure and Services B In addition to existing Mediacom fiber optic facilities, as the I-Net is constructed, at least 6 additional new optical fibers will be installed along its route for Mediacom to use in delivering commercial networking services to business and industry. Mediacom will extend fiber in the right-of-way to the curb within six months of a signed agreement by any business for a large bandwidth service requiring fiber, at no additional cost to the w 4 i' i� business. The monthly charge for the particular communication service w will be negotiated between that business and Mediacom. h 11. Industrial Parks In addition to any existing Mediacom fiber and the new business fibers to be installed along with the I-Net, Mediacom will extend designated fiber links to Dubuque Technology Park and Dubuque Industrial Center West within two years of the agreement. h 12. Free Service To Certain Facilities Ij Upon request of the City, Mediacom will provide one activated cable service drop and Basic Cable Service to each school and each facility j owned or leased by the City at no charge. Each institution may further Ij distribute the service within the facility at its own expense for uses consistent with the institution's mission. i r Also, Mediacom will provide one 200-ft. (maximum) drop and maintain one connection for Internet access to one computer terminal in each school or library within the franchise area at no charge. Any additional costs will be borne by the school or library for a time and materials charge. 13. Trenching i When either the City or Mediacom is trenching in the public right-of-way, the other party would have the right to install its own conduit at the same r time. However, if the City ever establishes a municipal communications utility that competes with Mediacom, the City would have to reimburse Mediacom on a pro-rata basis for its portion of the trenching costs for any cable the City previously installed in Mediacom trenches. 14. Importing Broadcast Television Signals All broadcast television station signals will be imported into the Dubuque system by optical fiber, resolving a 50-year-old reception problem. t d 15. Universal Service I I, Mediacom is required to extend residential-type cable service to all businesses and residences within the City. i 16. TDD/TTY 9 i Mediacom will direct hearing-impaired callers to Answer Iowa, a state- wide service, for assistance. The company will clearly advertise the availability of the Answer-Iowa service. i e i i y i 17. Emergency Alert Unless preempted by the Federal Emergency Alert System, the City would continue to have the ability to issue local alerts, subject to regulation by the FCC. 18. Franchise Fee i Mediacom will pay a franchise fee of five percent (5%)of gross revenues on cable services. If any action of law expands the base upon which franchise fees may be collected, Mediacom will automatically expand its computation and payment of franchise fees in Dubuque accordingly. it Mediacom will continue to treat the franchise fee on subscriber monthly bills as a cost recovered from within the rates for services, and will not list j the franchise fee as an additional charge in the manner they list sales G taxes. 19. PEG (Public, Educational, Government)Access Channels Mediacom will continue to provide on its subscriber network two public access television channels, one shared educational access channel, and one government access channel, as is currently offered. In addition, Mediacom will provide a second educational access channel dedicated to 24-hour, 7-day programming by the Dubuque Community Schools. On or before December 31, 2006, Mediacom will also make PEG Access programming available to digital subscribers through its Video On Demand service. If the board, commission, committee, or council is composed of an even number of members, not more than one—half of the membership shall be of one gender. If there are multiple appointing authorities for a board, commission, committee, or council, they shall consult each other to avoid a violation of this section. 2. All appointive boards, commissions, committees, and councils of a political subdivision of the state that are established by the Code, if not otherwise provided by law, shall be gender balanced as provided by subsection 1 unless the political subdivision has made a good faith effort to appoint a qualified person to fill a vacancy on a board, commission, committee, or council in compliance with subsection 1 for a period of three months but has been unable to make a compliant appointment. In complying with the requirements of this subsection, political subdivisions shall utilize a fair and unbiased method of selecting the best qualified applicants.
