City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the 2016 Asphalt Overlay Access Ramp Project Two, as completed by Midwest
Concrete, in the final contract amount of $93,898.90, which is 19.3% over the contract
amount of$78,696.00. The cost increase was caused by the following additional work:
• Additional defective curb and gutter replacement,
• Removal and relocation of two pedestrian ramps to create a safer crossing,
• Two intake adjustments,
• An additional pedestrian ramp installation, and
• Soil stabilization and rock.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolutions provide for the acceptance of the construction contract for the
2016 Asphalt Overlay Access Ramp Project Two.
BACKGROUND
The project replaced twenty six non-compliant pedestrian access ramps with thirty four
directional pedestrian access ramps as per Public Right of Way Accessibilities
Guidelines (PROWAG) specifications in conjunction with the Public Works Asphalt
Overlay Program and involved the intersections of:
• Pennsylvania Avenue and Lenox Street, southwest and southeast corners.
• Pennsylvania Avenue and Illinois Avenue, southwest and southeast corners.
• Pennsylvania Avenue and Enid Street, southeast corner.
• Pennsylvania Avenue and Alpha Avenue, southwest and southeast corners.
• Pennsylvania Avenue and Ohio Avenue, southwest and southeast corners
removed and relocated.
• Pennsylvania Avenue and Drexel Avenue, southwest and southeast corners.
• Drexel Avenue and Illinois Avenue, northwest corner.
• Illinois Avenue and Ohio Avenue, northeast and northwest corners.
• Enid Street and Illinois Avenue, relocation at the northeast and new ramp at the
northwest corner.
• Key Way Drive and Southway, northwest and northeast corners.
• Key Way Drive and Delmonaco Drive northwest and northeast corners.
• Delmonaco Drive and Venture Court, southeast corner.
• Delmonaco Drive and Dana Drive, southeast corner, double directional at the
southwest corner and mid-block crossing on north side of Dana Drive.
• Southway and Dana Drive, southeast and northeast corners.
In accordance with Iowa Code § 384.103 and § 364.12(3)(c), and Iowa Code, Section
26.14, the City solicited informal bids for the 2016 Asphalt Overlay Access Ramp
Project Two. The sole bid from Midwest Concrete Inc. was 5.83% over the Engineer's
estimate of $74,361.00

DISCUSSION
The Asphalt Overlay Access Ramps Project Two was completed by Midwest Concrete
Inc. of Peosta, Iowa in the final contract amount of$93,898.90, 19.3% over the contract
amount of$78,696.00. Additional work was required including:
• Additional defective curb and gutter replacement
• Removal and relocation of two pedestrian ramps to create a safer crossing
• Two intake adjustments
• An additional pedestrian ramp installation
• Soil stabilization and rock
Not including the cost of the extra curb & gutter, the average cost per ramp was
$3,185.34.

REQUESTED ACTION
The City Council is requested to adopt the attached resolutions accepting the
improvements and establish the final contract amount for the 2016 Asphalt Overlay
Access Ramp Project Two in the amount of $93,898.91.

RESOLUTION NO. 425-16
ACCEPTING THE 2016 ASPHALT OVERLAY ACCESS RAMPS PROJECT TWO
AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the 2016 Asphalt Overlay Access
Ramps Project Two (the Project) has been completed and the City Engineer has
examined the work and filed a certificate stating that the Project has been completed
according to the terms of the Public Improvement Contract and that the City Engineer
recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Curb Ramp Program appropriations for the contract amount of $93,898.90 Tess any
retained percentage provided for therein as provided in Iowa Code chapter 573, and to
pay such retainage only in accordance with the provisions of Iowa Code chapter 573.
