City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the FY16 Sewershed 5 Sanitary Sewer Manhole Project, as completed by
McDermott Excavating, in the final contract amount of $45,076.41, which was a
decrease of $3,147.59 from the original contract amount of $48,224.00.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
FY16 Sewershed 5 Sanitary Sewer Manhole Project.
BACKGROUND
The original scope of the project included the replacement of(3) manholes and the
rehabilitation of thirteen (13) manholes in Sewershed 5.
McDermott Excavating of Dubuque, Iowa was the successful bidder and was awarded a
contract in the amount of $48,224.00
DISCUSSION
The project was designed, inspected, and managed by City engineering staff and the
project was completed on time.
The completed project, including base contract line items additions and deletions, totals
$45,076.41 which was a decrease of$3,147.59 from the original contract amount.
BUDGET IMPACT
Resolution No. 121-16 authorizing the FY16 Sewershed 5 Sanitary Sewer Manhole
Project showed an estimated project cost including construction, contingency, and
engineering of$38,043.61. The City received a competitive bid 37.49% higher than the
original engineer's estimate, the contractor completed all design and inspection with
City staff, the projected costs and the actual costs as follows:

RECOMMENDATION
I respectfully request City Council accept the improvement in the final amount of
$45,076.41 to McDermott Excavating. of Dubuque, Iowa for the FY16 Sewershed 5
Sanitary Sewer Manhole Project by adoption of the attached resolution.

RESOLUTION NO. 428-16
ACCEPTING THE THE FY16 SEWERSHED 5 SANITARY SEWER MANHOLE
PROJECT
WHEREAS, the public improvement contract for the FY16 Sewershed 5 Sanitary
Sewer Manhole Project, (the Project) has been completed by the Contractor,
McDermott Excavating (Contractor), the City Engineer has examined the work and
recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $45,076.41;
WHEREAS, the Contractor has previously been paid $42,822.59, leaving a
balance of $2,253.82; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the
Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $2,253.82 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that
he has inspected the FY16 Sewershed 5 Sanitary Sewer Manhole Project, and that
said Project has been performed in compliance with the terms of the Public
Improvement Contract, and that the total cost of the completed work is $48,231.76.
