City Engineer Gus Psihoyos is recommending acceptance of the public improvement
construction contract for the FY16 Sewershed 5, 7, 11 and 12 Manhole Project, as
completed by Visu-sewer Inc., in the final contract amount of $76,712.55, which is a
1.75% increase from the original contract amount of$69,267.50 due to increased
quantities of grout used.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the public improvement
construction contract for the FY16 Sewershed 5, 7, 11 & 12 Manhole Project
BACKGROUND
The City of Dubuque, Iowa is under a Consent Decree according to Case
2:11-cv-01001-EJM, United States of America and the State of Iowa v. the City of
Dubuque, IA (N.D. Iowa), Civil Action Number 2008V00041, DOJ Case Number
90-5-1-1-09339 effective June 27, 2011. The City is required to submit Corrective Action
plans for each of the Sanitary Sewersheds identified in the Consent Decree. The FY16
budget appropriated funds for sanitary sewer rehabilitative improvements in the
Consent Decree Correction Action Plans for Sewershed 5, 7, 11 and 12.
The FY16 Sewershed 5, 7, 11 & 12 Manhole Project was determined from flow
monitoring and smoke testing activities completed by engineering staff in Sewersheds
5, 7, 11 and 12; in addition to those sewers identified during Public Works maintenance
activities such as cleaning, televising, and following up on customer issues. The project
involved the replacement, repair, of sanitary sewer manholes at various locations.
DISCUSSION
The FY16 Sewershed 5, 7, 11 & 12 Manhole Project was completed by Visu-sewer Inc.,
of Pewaukee, Wisconsin, in the final contract amount of$76,712.55 which is a 1.75%
increase from the original contract amount of$69,267.50. The increase was due to
increased quantities of grout used.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of $76,712.55 to Visu-sewer Inc., for the FY16 Sewershed 5, 7,
11 & 12 Manhole Project.

The summary of project costs for the FY16 Sewershed 5, 7, 11 & 12 Manhole Project is
as follows:

RESOLUTION NO. 431-16
ACCEPTING THE FY16 SEWERSHED 5, 7, 11 & 12 MANHOLE PROJECT AND
AUTHORIZING THE PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the FY16 Sewershed 5, 7, 11 &
12 Manhole Project (the Project) has been completed by the Contractor, Visu-Sewer
Inc. (Contractor), the City Engineer has examined the work and recommends that the
Project be accepted; and
WHEREAS, the final contract amount for the Project is $76,712.55;
WHEREAS, the Contractor has previously been paid $72,876.92, leaving a
balance of $3,835.63; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the
Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $3,835.63 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
