Van Milligen, City Manager SUBJECT: Siegert Annexation Request— Set for Public Hearing DATE: December 9, 2016 Planning Services Manager Laura Carstens recommends the City Council set a public hearing for January 17, 2017, on the voluntary annexation request of William and Janet Siegert for five acres of property they own located between Old Highway Road and US Highway 20/Dodge Street. This annexation request is submitted concurrently with an application to rezone the property. The annexation will be subject to final approval of the State of Iowa's City Development Board because the property is considered to be in an urbanized area and lies within two miles of the City of Asbury. Van Milligen, City Manager FROM: Laura Carstens, Planning Services Manager SUBJECT: Siegert Annexation Request—Set for Public Hearing DATE: December 6, 2016 INTRODUCTION This memorandum transmits a 100% voluntary annexation request for City Council to set for public hearing. The request is being filed by William and Janet Siegert for approximately five acres of property, concurrent with rezoning. The resolution, maps, and other supporting documentation is enclosed. DISCUSSION The annexation territory is located between Old Highway Road and US Highway 20/Dodge Street. The property is primarily farmland and contains a 50'W x 90' L steel utility building and three steel grain bins. The Siegerts are in the process of replatting the property and are concurrently applying to rezone the property to C-3 General Commercial. The five-acre annexation territory includes 0.48 acres of County right-of-way to the abutting centerline of Old Highway Road, in accordance with Iowa Code. By Iowa Code, the annexation will be subject to final approval of the State of Iowa's City Development Board because the property is considered to be in an urbanized area and lies within two miles of the City of Asbury. RECOMMENDATION Staff recommends the City Council approve the resolution to set the public hearing on the City annexation request for January 17, 2017. This date will provide adequate time to complete the notifications, certified mailings, and newspaper publication required by Iowa Code as well as the rezoning public hearing before the Zoning Advisory Commission. Whereas, the City of Dubuque has the capacity to provide substantial municipal services to the annexation territory; and Whereas, the annexation is in the public interest. Resolution No. 434-16 Page 2 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: A public hearing will be held on the 17th day of January, 2017, at 6:00 p.m. in the Historic Federal Building Council Chambers (second floor), 350 West 6th Street, Dubuque, Iowa, at which time interested persons may appear and be heard for or against the proposed annexation, and the City Clerk be and is hereby directed to cause the attached notice of the time and place of such hearing to be published in a newspaper having general circulation in the City of Dubuque, Iowa, which notice shall be published not Tess than ten days prior to the date of such hearing.
