INTRODUCTION
This memorandum transmits the Final Plat of Timber-Hyrst Estates #5. A resolution and
related materials for City Council review and approval are attached. The submitted
Final Plat of Timber-Hyrst Estates #5 is a continuation of the existing subdivision that
begins at Manson Road and will, with the completion of the latest phase, complete the
development of the subdivision. The City Council reviewed and approved Phase #4 of
this subdivision at their June 16, 2014 City Council meeting.
DISCUSSION
The submitted Final Plat of Timber-Hyrst Estates#5 subdivides approximately 23 acres
into 22 single-family lots. The Final Plat includes the construction of two new public
streets, Cherry Ridge Drive and South Bend Circle. Both new streets will be built with
31 feet of paving and a 60-foot right-of-way.
The subject subdivision complies with the Unified Development Code's 40 points of
sustainability by:
1) that a portion of the subdivision utilizes the City's alternate street standard of a
27-foot wide paved street;
2) that the covenants require the planting of trees on private property;
3) that one-third of the lots are oriented for passive solar;
4) that street trees will be provided throughout the subdivision, and that the
preservation of existing trees on-site will be insured;
5) that the street lights will utilize LED lighting; and

6) that the grading and development is confined to the area of the property that was
used for agricultural purposes, preserving the wooded hillsides and steeper
sloped areas from development.
RECOMMENDATION
Staff recommends approval of the resolution for the Final Plat of Timber-Hyrst Estates
#5 as it is in compliance with the City of Dubuque Unified Development Code.

Physical Characteristics: The subject property lies west of the existing Phase #4 of

Proposed Streets and Grades: The submitted Final Plat provides for an extension of a
stub street named Cherry Ridge Court. There is also a new street to be named South
Bend Circle. The proposed grades for the extension of Cherry Ridge Court are between
1 and 1.5 percent. The grade of South Bend Circle will be between 1 and 10 percent.
Recommended Motion: Motion to approve the submitted Final Plat of Timber-Hyrst
Estates #5 as it is in compliance with City of Dubuque Subdivision Regulations.
Conformance with Comprehensive Plan: This subdivision meets the Comprehensive
Plan Land Use element Goals: 1.2, 1.5, 4.1, 4.4 and 7.2.

Impact of Request on:
Utilities: The existing portion of the subdivision is currently served by City water and
sewer mains. Both water and sewer are located at the end of Creek Wood Drive
where it ends at Phase #4 of Timber-Hyrst Estates. These mains will be extended
to serve Phase #5 of the subdivision.
Traffic Patterns: The proposed subdivision includes an extension of Cherry Ridge
Court and a new cul-de-sac to be named South Bend Circle. Both streets will be
built with 60 feet of right-of-way and 31 feet of paving and parking allowed on both
sides.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during all phases of development of
the property, and that adequate storm water management is provided as per City
requirements.
Adjacent Properties: Staff does not anticipate any significant impacts to adjacent
properties beyond additional vehicle trips on Manson Road and North Cascade
Road as the subdivision is built-out with new homes.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of Timber-Hyrst Estates #5 subdivides
approximately 130 acres into 109 buildable lots and is the fourth phase of the
subdivision. The subject property is zoned R-3, Moderate Density Multi-Family
Residential District. The subject property was annexed into the City of Dubuque in
August 2006.
The first phase of Timber-Hyrst Estates was approved in April 2006, and included the
development of 30 building lots and the construction of Creek Wood Drive and a bridge
over Catfish Creek near Creek Wood Drive's intersection with Manson Road. The
second phase of Timber-Hyrst Estates included the development of 50 building lots, the
dedication of land for a public park, construction of the public Street Heather Glen, and
extension of Creek Wood Drive. The third phase of Timber-Hyrst Estates included the
development of 34 building lots, the construction of the public street Deer Creek Ridge,
and extension of Creek Wood Drive. The fourth phase of Timber-Hyrst Estates
included 109 building lots and extension of Creek Wood Drive to North Cascade Road.
The fifth phase includes 22 building lots and construction of Cherry Ridge Court and
South Bend Circle.

The subject property can be served b City water and sanitary sewer mains through

extension of the mains from the current terminus of Creek Wood Drive. Storm water
control/detention has been reviewed in detail as part of the improvement plans provided
as part of Phase #4. The development of the subdivision also preserves much of the
wooded hillsides and minimizes the percentage of land disturbed to encourage the
infiltration of storm water. The subdivision is in compliance with the City's storm water
policies and regulations.
The proposed extension of Cherry Ridge Court and South Bend Circle will be built with
a 60-foot right-of-way and 31 feet of paving measured from back-of-curb to back-of-
curb, with parking allowed on both sides. Typically, a residential cul-de-sac street has
only 50 feet of right-of-way. The developer is proposing a 60-foot right-of-way to allow
for a greater parkway width.
Timber-Hyrst Estates #5 is subject to the UDC's 40 points of sustainability
requirements. The 40 points have been achieved through the following:
1. One-third of lots are oriented for passive solar = 10 pts.
2. 27-foot wide street = 5 points.
3. Covenants require planting of trees for each lot = 5 pts.
4. Street trees will be planted = 5 pts.
5. Preservation of existing trees = 5 pts.
6. LED street lights = 5 pts.
7. Disturbed area limited = 5 pts.
TOTAL: 40 pts.
Planning staff recommends that the City Council approve the submitted Final Plat of
Timber-Hyrst Estates #5 as it is in compliance with the City of Dubuque Subdivision
Regulations.

RESOLUTION APPROVING THE FINAL PLAT OF TIMBER-HYRST ESTATES #5 IN
THE CITY OF DUBUQUE, IOWA
Whereas, North Cascade Road Developers, LLC, as owners, have filed with the
City Clerk the Final Plat of Timber-Hyrst Estates #5 in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears streets to be known as Cherry Ridge
Court (Lot 0) and South Bend Circle (Lot P), together with certain public utility, access,
storm sewer, storm drainage, sanitary sewer and water main easements, which North
Cascade Road Developers, LLC by said final plat have dedicated to the public forever;
and
Whereas, said Final Plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it, except that no streets or
public utilities have yet been constructed or installed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Cherry Ridge Court (Lot 0) and South Bend
Circle (Lot P), together with the easements for public utilities, access, storm sewer,
storm drainage, sanitary sewer and water main, as they appear upon said final plat, be
and the same are hereby accepted.
Section 2. That the Final Plat of Timber-Hyrst Estates #5 is hereby approved
and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa upon said Final Plat, provided the North Cascade
Road Developers, LLC execute their written acceptance hereto attached agreeing:

(a) To reduce Cherry Ridge Court (Lot 0) and South Bend Circle (Lot P) to
grade and construct longitudinal sub -drain, concrete curb and gutter, with
asphaltic concrete pavement, or Portland Cement concrete pavement with
integral curb, all in accordance with the City of Dubuque standard
specifications, all in a manner acceptable to the City Engineer, in
conformance with construction improvement plans approved by the City
Engineer, and inspected and approved by the City Engineer.
(b) To install sanitary sewer main and sewer service laterals into each
individual lot, water main and water service laterals into each individual
lot, storm sewers and catch basins, boulevard street lighting, fiber optic
conduit and vaults, and erosion control devices all in accordance with the
City of Dubuque standard specifications, all in a manner acceptable to the
City Engineer, and in accordance with construction improvement plans
approved by the City Engineer, and inspected and approved by the City
Engineer.
(c) To construct accessible sidewalk ramps at the intersection of South Bend
Circle and Cherry Ridge Court in accordance with the City of Dubuque
standard specifications, all in a manner acceptable to the City Engineer,
and in accordance with construction improvement plans approved by the
City Engineer, and inspected and approved by the City Engineer.
(d) To construct the improvements outlined in (a) and (b) and (c) within two
(2) years from the date of acceptance of this resolution, at the sole
expense of North Cascade Road Developers, LLC, or future owner;
(e) To maintain the improvements outlined in (a) and (b) and (c), for a period
of two (2) years from the date of the acceptance of those improvements
by the City Council of the City of Dubuque, Iowa, at the sole expense of
North Cascade Road Developers, LLC, or future owner;
(f)
To provide security for the performance of the foregoing conditions
specified in this Section in such form and with such sureties as may be
acceptable to the City -Manager of the City -of Dubuque; Iowa.
Section 3. Sidewalk installation shall be the responsibility of each lot owner
abutting the public rights-of-way, including lots with multiple frontages, as required by
City Code Chapter 10-1-2 (Sidewalk Installation and Repair) and 16-11-16 (Sidewalks).
Section 4. That the planting of street trees shall be coordinated with the City
Forester. Trees planted within the street right-of-way must be chosen and planted by
the City of Dubuque Leisure Services Department at the developer's expense.

Section 5. That the final acceptance of all public improvements shall only
occur upon certification of the City Engineer to the City Council that all public
improvements have been completed in accordance with the approved improvement
plans and City standard specifications and accepted by City Council Resolution.
Section 6. That in the event North Cascade Road Developers, LLC fails to
execute the acceptance and furnish the guarantees provided hereof within 180 days
after the date of this Resolution, the provisions hereof shall be null and void and the
acceptance of the dedication and approval of the plat shall not be effective.

RESOLUTION NO. 435-16
RESOLUTION APPROVING THE FINAL PLAT OF TIMBER-HYRST ESTATES #5 IN
THE CITY OF DUBUQUE, IOWA
Whereas, North Cascade Road Developers, LLC, as owners, have filed with the
City Clerk the Final Plat of Timber-Hyrst Estates #5 in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears streets to be known as Cherry Ridge
Court (Lot 0) and South Bend Circle (Lot P), together with certain public utility, access,
storm sewer, storm drainage, sanitary sewer and water main easements, which North
Cascade Road Developers, LLC by said final plat have dedicated to the public forever;
and
Whereas, said Final Plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it, except that no streets or
public utilities have yet been constructed or installed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Cherry Ridge Court (Lot 0) and South Bend
Circle (Lot P), together with the easements for public utilities, access, storm sewer,
storm drainage, sanitary sewer and water main, as they appear upon said final plat, be
and the same are hereby accepted.
Section 2. That the Final Plat of Timber-Hyrst Estates #5 is hereby approved
and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa upon said Final Plat, provided the North Cascade
Road Developers, LLC execute their written acceptance hereto attached agreeing:

(a) To reduce Cherry Ridge Court (Lot 0) and South Bend Circle (Lot P) to
grade and construct longitudinal sub -drain, concrete curb and gutter, with
asphaltic concrete pavement, or Portland Cement concrete pavement with
integral curb, all in accordance with the City of Dubuque standard
specifications, all in a manner acceptable to the City Engineer, in
conformance with construction improvement plans approved by the City
Engineer, and inspected and approved by the City Engineer.
(b) To install sanitary sewer main and sewer service laterals into each
individual lot, water main and water service laterals into each individual
lot, storm sewers and catch basins, boulevard street lighting, fiber optic
conduit and vaults, and erosion control devices all in accordance with the
City of Dubuque standard specifications, all in a manner acceptable to the
City Engineer, and in accordance with construction improvement plans
approved by the City Engineer, and inspected and approved by the City
Engineer.
(c) To construct accessible sidewalk ramps at the intersection of South Bend
Circle and Cherry Ridge Court in accordance with the City of Dubuque
standard specifications, all in a manner acceptable to the City Engineer,
and in accordance with construction improvement plans approved by the
City Engineer, and inspected and approved by the City Engineer.
(d) To construct the improvements outlined in (a) and (b) and (c) within two
(2) years from the date of acceptance of this resolution, at the sole
expense of North Cascade Road Developers, LLC, or future owner;
(e) To maintain the improvements outlined in (a) and (b) and (c), for a period
of two (2) years from the date of the acceptance of those improvements
by the City Council of the City of Dubuque, Iowa, at the sole expense of
North Cascade Road Developers, LLC, or future owner;
(f)
To provide security for the performance of the foregoing conditions
specified in this Section in such form and with such sureties as may be
acceptable to the City--Managerof--he City-of-Dubuque;-lowa.
Section 3. Sidewalk installation shall be the responsibility of each lot owner
abutting the public rights-of-way, including lots with multiple frontages, as required by
City Code Chapter 10-1-2 (Sidewalk Installation and Repair) and 16-11-16 (Sidewalks).
Section 4. That the planting of street trees shall be coordinated with the City
Forester. Trees planted within the street right-of-way must be chosen and planted by
the City of Dubuque Leisure Services Department at the developer's expense.

Section 5. That the final acceptance of all public improvements shall only
occur upon certification of the City Engineer to the City Council that all public
improvements have been completed in accordance with the approved improvement
plans and City standard specifications and accepted by City Council Resolution.
Section 6. That in the event North Cascade Road Developers, LLC fails to
execute the acceptance and furnish the guarantees provided hereof within 180 days
after the date of this Resolution, the provisions hereof shall be null and void and the
acceptance of the dedication and approval of the plat shall not be effective.
