is the regular monthly meeting of
the City Council for the purpose of
acting upon such business as may
properly come before the meeting.

cember 6, 1954, at 7:30 P.M., for
the purpose of amending the cur-
rent City of Dubuque budget
adopted January 4, 1954, by de-
creasing and increasing expendi-
tures for the following reasons and
in the following funds: For the
general welfare of the City of Du-
buque:
General Fund from $231,948.50 to
$200,948.50.
Public Safety Fund from $585,965:
60 to $555,265.60.
Street Fund from $298,121.00 to
$347,900.00.
Utilities-Street Lighting Fund
from $52,016.00 to $55,350,00.
Recreation--General Fund from
$43,404.00 to $49,000.00.
Utilities -Water Works-General

The increase in expenditures set

creased receipts and cash balances

No. 1-59 are hereby allocated and
appropriated for payment of necessary

the fiscal year beginning January
1, 1955, and ending December 31,
1955.
This distribution is based on the
budget approved by the City Coun-
cil for levying taxes for 1955 and
has been discussed with the de•
partment heads so that they will
know the limits of their expendi-
tures.
I recommend this distribution
as outlined to the Council for adop-
tion as a basis for making expendi-
tures in 1955.

Whereas the contract heretofore
entered into by the City of Du•
buque, Iowa, for the improvement
hereinafter described has been
completed and the City Manager
has certified the completion there-
of to the City Council and the City
Council has ascertained the cost
thereof and has determined that
$3,738,08 Dollars of the cost there-
of shall be assessed against the
property subject to assessment
therefor; and
Whereas public notice, as pro-
vided by law, has been published
by the City Clerk stating the in-
tention of the City Council to is-
sue bonds for the purpose of pro-
viding for the payment of the as-
sessed cost of said improvement
and a public hearing has been
held, pursuant to such notice and
all objections made thereto have
been considered and determined;
Now Therefore Be It Resolved
by the City Council of the City of

Whereas the contract heretofore
entered into by the City of Du-
buque, Iowa, for the improvement
hereinafter described has been
completed and the City Manager
has certified the completion there-
of to the City Council and the City
Council has ascertained the cost
thereof and has determined that
$2,957.80 of the cost thereof shall
be assessed against the property
subject to assessment therefor;
and
Whereas public notice, as pro-
vided by law, has been published
by the City Clerk stating the in•
tention of the City Council to issue
bonds for the purpose of providing
for the payment of the assessed
cost of the improvement and a
public hearing has been held, pur-
suant to such notice and all ob-
jections made thereto have been
considered and determined;

one for $257.80 numbered 9631, all
of like tenor and date, and issued
for the purpose of improving Pres-
cott Street with asphaltic macadam
surfacing as described in said
Resolution, in said City, which cost
is payable by the abutting and
adjacent property along said im-
provements and is made by law a
lien on all of said property. It is
payable only out of the Special As-
sessment Fund No. 1167 created by
the collection of said special tax,
and said fund can be used for no
other purpose.
it is hereby certified and recited
that all the acts, conditions and
things required to be done, pre-
cedent to and in issuing this series
of bonds, have been done, hap-
pened, and performed, in regular
and due form, as required by law
and said Resolution, and for the
assessment, collection and payment
hereon of special tax, the full faith
and diligence of said City of Du-
buque are hereby irrevocably
pledged.

for the purpose of improving Rider
Street with asphaltic macadam
surfacing as described in said Res-
olution, in said City, which cost
is payable by tihe abutting and ad-
jacent property along said im-
provements and is made by law a
lien on all of said property. It is
payable only out of the Special As-
sessment Fund No. 1166 created by
fihe collection of said special tax,
and said fund can be used far no
other purpose.
It is hereby certified and recited
that all the acts, conditions and
things required to be done, prece•
dent to and in issuing Phis series
of bonds, have been dune, hnp•
pened, and performed, in regular
and due form, as required by law
and said Resolution, and for the
assessment, collection and pay-
ment hereon of said special tax,

ter to you in which he advised you
that several beer permit holders
had been arrested and that upon
their arrest it was found that they
had violated the beer law on prev-

You referred the letter to me to
ascertain the details of the prior
convictions. I wrote to the Attor•
ney General for further informa-
tion and received the attached
reply.
A letter to Mr. Nebergall was no
more illuminating and a search of
the District Court records dis-

Gentlemen: Because of his being
out of the city, Mr. Schiltz, has di-
rected me to submit to you the en-
closed correspondence and recom-
714 Regular Session, December 6th, 1954
mendations regarding the change
in the City regulations regarding
Brucellosis Eradication.
Under our present law the pro-
ducer may follow either plan A or
plan B for herd health.
Under Plan A, if a reactor cow
is discovered during the annual in-
spection it must be destroyed im-
mediately and the entire herd re-
inspected at the end of thirty days.
Under Plan B, if a reactor is dis-
covered it may be retained and
disposed of when the producer can
do so without loss.
The proposed amendment would
eliminate Plan B. It has been re-
quested by Brookside Dairy and
Dubuque Cooperative Marketing
Assn, as shown by the attached let•
ters and it has been endorsed by
over 80% of the milk producers in
the area.
I have been authorized to advise
you that the City Manager concurs
in my recommendation and that the
amendment be enacted.

The execution of these contracts
by the City Manager have been
previously authorized by Council
action.

ment far: the construction of the
1954 Water Main Project No. 1.
Whereas, the City Engineer has
filed his certificate with the City
Clerk, stating that he has inspected
the above improvement, that the
same has been performed in com-
pliance with the terms of the con-
tract, and that the total cost of the
work is $41,367.43,
Now Therefore Be It Resolved by
the City Council of the City of
Dubuque, Iowa:
Section 1. That the work of Lar•
son Construction Company in com-
pleting said improvement is hereby
accepted and the City Auditor in-
strutted to issue warrants payable
to said contractor in the total sum
$41,224,84 with interest thereon at
the rate of 5% per annum from
date hereof and drawn upon the
Water Works General fund or any
other fund available for such im-
provement.
Section 2. That the total cost of
said improvement is hereby deter-
mined to be $41,367.43 and it is
further determined that $21,624.75
of such cost shall be paid from the
Water Works General fund and
$19,742,68 of such cost shall be as•
sessed against private property
within the assessment district.

Schedule of Assessments;
Now Therefore Be Tt Resolved
By the City Council of the City of
Dubuque, Iowa:
Section 1. That the assessments
as set forth in said schedule are
hereby confirmed and adopted and
that a special tax be and is hereby
levied on the several lots, and
parts of lots, and parcels of real
estate for the amounts set opposite
each lot or parcel of real estate all
as shown in said schedule.
Section 2. That each of said as-
sessments in excess of $25.00 is
hereby divided into ten equal an•
nual installments, the first of
which shall be due and payable
on January 1, 1956 and the suc-
ceeding annual installments shall
become respectively due and pay
able on the first day of January an-
nually thereafter.
Section 3. That all unpaid install~
menu shall bear interest at the
rate of 5% per annum from De•
cember 6, 1954 and shall be due
and payable in the manner provid-
ed by law, provided however, any
taxpayer may pay his total assess-
ment in full without interest with-
in 30 days from the date that the
City Clerk certifies the schedule
of assessments to the County Audi-
tor as hereinafter provided,
Section 4. That the City Clerk is
hereby directed to certify the En•
gineer's Final Schedule of Assess-
ments to the County Auditor of
Dubuque County, Iowa, and to pub-
lish notice thereof by publication
in the Telegraph Herald newspa-
per, once each week for two con-
secutive weeks, the first publica•
tion of which shall be not more
then fifteen days from the date of
the filing of the final schedule
with the County Auditor,
