Kennedy Reconstruction - Public Hearing on Assessments A public hearing has been set for May 6, 2002 to approve the schedule of preliminary assessments for the reconstruction of John F. Kennedy Road. At the April 15, 2002 public hearing on the plans and specifications, the City Council approved the elimination of the public sidewalks along both sides of John F. Kennedy from Spring Valley Road to the City limits. For consistency, the City Council should amend the schedule of assessments to eliminate the all sidewalk assessments. At the May 6, 2002 public hearing on special assessments, a 3/4 -vote of the City Council will be required to approve the amended special assessments for the project. Kennedy Reconstructibn Project, has given notice of the public hearing thereon as required by law; and Whereas, the public hearing has been held, all persons offering objections have been heard and consideration given to all objections and is pending before this Council; and Whereas, this is the time and place set as provided for the taking of action on the proposed Resolution of Necessity. Kennedy Reconstruction INTRODUCTION The enclosed resolutions authorize the special assessments for the John F. Kennedy Reconstruction Project at the Northwest Arterial. BACKGROUND Bids were received on this project by the Iowa Department of Transportation (IDOT) along with the paving bids for the Northwest Arterial. IDOT will reconstruct John F. Kennedy in the vicinity of the Northwest Arterial intersection; however, the City, in conjunction with IDOT, also included the reconstruction of Kennedy Road from the Northwest Arterial southerly to tie into the curb and gutter at Spring Valley Drive, and northerly to the City limits to complete the reconstruction and widening of Kennedy Road from Spring Valley to the northerly City limits. A portion of the northerly section will be paid for by Dubuque County since the City limits runs down the middle of Kennedy Road from the soccer complex to Barony Drive. The project will consist of the complete reconstruction of the existing base and pavement surface. The street will be 41-foot wide from back-to-curb to back-to- curb from Spring Valley to the City limits just south of Barony Drive. The pavement will be concrete with curbing. The widening of the pavement will improve traffic flow at the soccer complex and West 32na Street by allowing the construction of left-turn bays at the major intersections. The City will be responsible for the inspection of its portion of the contract. Upon completion of the contract, the City will reimburse IDOT for the City's share of the Kennedy Road improvements. The City will be responsible for the inspection of its portions of the contract. The design anticipates the construction of a 4-foot wide sidewalk, 6 foot behind the back-of-curb, and a new storm sewer system from Spring Valley Road to the City limits. Also included in the project is the installation of a 16-inch watermain along the west side of John F. Kennedy from the soccer complex to the Northwest Arterial for the construction of a future water tower along Kennedy Road. The City's portion of the work has no federal or state participation and is therefore assessable like any other reconstructed street contracted by the City. The assessable portion of the project is proposed at 12.55%. BUDGET IMPACT The estimate for the project is as follows: Construction Contract Contingency Engineering $1,027,780.67 102,778.07 169,583.80 Total Project Cost $1,300,142.54 The project will be funded as follows: Street Construction Fund Local Option Sales Tax Fund Special Assessment to Private Properties Special Assessment to City-Owned Property Special Assessment for Water Services Special Assessments for Sidewalks Water Depreciation Fund County Funding $ 521,196.51 350,290.39 112,906.37 6,719.65 8,013.91 77,819.14 40,972.07 182,224.50 Total Project Funding $1,300,142.54 The pavement project will be funded through a Fiscal Year 2002 appropriation from the Annual Street Program. The project, as outlined, will require $912,458.97 in City construction funds and $6,719.65 for assessments to the City, for a total City cost of $919,178.62. Low- to moderate-income property owners subject to street assessments will be eligible for financial assistance ranging from 20 to 100 percent of the street assessment for owner-occupied resident property, depending on family size and income level. This financial assistance program is made available through the 1% Local Option Sales Tax. The cost of the water services and sidewalks will be assessed directly to the benefited individual properties. Neither the 1% Local Option Sales Tax nor the City's special assistance to Iow- to moderate-income families is available to fund the water services or the sidewalk assessments since these are direct property owner benefits. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolutions relating to the special assessments, and to establish the date of the public hearing on the plans and specifications and the Resolution of' Necessity approving the preliminary schedule of assessments. Kennedy Reconstruction Project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the City Council deems it advisable and necessary for the public welfare to make the herein mentioned improvements, and unless property owners at the time of the final consideration of this proposed resolution have on file with the City Clerk objections to the resolution of necessity, they shall be deemed to have waived all objections pertaining to the regularity of the proceeding and the legality of using the special assessment procedure. Said improvements shall be constructed and done in accordance with the plans and specifications which have been approved by the City Council and now on file with the City Clerk. That the cost and expense of making such improvement will be assessed partially or totally against privately owned property lying with the assessment limits, and in an amount not to exceed that provided by law, and in proportion to the special benefits conferred. The portion of the cost which shall be borne by the City will be paid from the Street Construction Fund and the Watermain Construction Fund, and special assessment bonds may be issued in anticipation of deferred payments of assessments when a contract has been performed and accepted, and the proceeds thereof used to pay the contractor.
