City Manager Schiltz.
Mayor Russo staffed that this is
the regular monthly meeting of
the City Council for the purpose of
acting upon such business as may
properly come before the meeting.
Proof of publication, certified to
by the publishers, of notice of
meeting for the purpose of insti-
tuting proceedings and taking
action for the issuance of Dock
Bonds of said City in the amount
of Thirty Thousand Dollars ($30,-
000)for the purpose of paying the
cost of acquiring Mineral Lots
294, 295, 296 and 297 for muni-
cipally owned water front pur-
poses, presented and read.
No written objection filed and
no objectors present in the Council
Chamber at the time set for said
hearing. Councilman Kolb moved
that the proof of publication be
received and filed. Seconded by

RESOLUTION N0. 158-51
RESOLUTION PROPOSING A
SUPPLEMENTAL ESTIMATE OF
TAXES.
Whereas the City Council of the
City of Dubuque has been petit-
ioned by the Dock Board of said
City to issue Dock Bonds in the
amount of Thirty Thousands Dol-
lars ($30,000) for the purpose of
purchasing lands for dock pur-
poses; and
Whereas it is deemed advisable
and necessary that the City of Du-
buque, Dubuque County, Iowa pro-
vide for the purchase of land for
dock purposes, pursuant to the
general plan for the improvement
of the water front of said City, as
requested by said petition and as
permitted by Chapter 76 of the
1950 Code of Iowa, the cost where-
of to the amount of Thirty Thous-
and Dollars ($30,000) is lawfully
chargeable to and payable from
a special fund created from the
levy of special taxes as permitted
and provided by Section 384.3 of
the 1950 Code of Iowa; and
Whereas it is advisable to cer-
tify to the County Auditor and to
be caused to be collected such
special taxes as permitted and pro-
vided for by said Section 384.3 of
the 1950 Code of Iowa and to make
provision for a supplemental esti-
mate of said taxes for future
years, pursuant to the provisions
of Section 24.7 of the 1950 Code of
Iowa;
Now Therefore, Be It Resolved
By The City Council of the City
of Dubuque, Iowa, as follows:
Section 1. That a supplemental
estimate for the levy of special
taxes mentioned in the preamble
hereof for each of the years 1951
to 1960, inclusive, be made as fol•
lows:
That in pursuance of Chapter 76
of the Code of Iowa, there shall be
levied, assessed and collected a
direct annual special tax upon all
the taxable property within said
City for each of the years 1951 to
1960, inclusive, sufficient to pro•
duce net annual sums as herein•
after provided.
Section 2. Said taxes shall be
collected each year at the same
time and in the same manner and
with and in addition to all other
taxes in and far said City, and
when collected shall be converted
into a special fund.
Section 3, That this Council
meet on the 4th day of June, 1951,
at the City Hall within said City
at 7:30 o'clock P.M., at which time
and place any person subject to
such tax shall be heard in favor
of or against the same or any part
thereof.
Section 4. That the Mayor and
City Clerk are hereby directed to
give notice of said supplemental
estimate, setting forth the time
when and the place where said
hearing will be held, by publica-
tion of at least ten (10) days before
said hearing in the Telegraph•
Herald, a newspaper published
and of general circulation in said.

stantially the following form:

1951 to 1960, inclusive, on all tax-
able property in said City. Said
tax will not in any one year ex-
ceed the limit prescribed by Sec-
tion 384.3.10 of the 1950 Code of
Iowa, based on existing property

from will be used to pay the prin-
cipal and interest of bonds to be
issued for the purpose of paying
the purchase price of land to be

RESOLUTION DIRECTING THE
ADVERTISEMENT AND SALE OF
THIRTY THOUSAND DOLLARS
DOCK BONDS.
Whereas the City Council of the
City of Dubuque, Iowa. has hereto-
fore determined it to be advisable
and necessary that land be ac-
quired for dock purposes in and
for said City and it is necessary
and for the best interest of said
City that Thirty Thousand Dollars
($30,000) Dock Bonds contemplated
to be issued to pay the purchase
price thereof, to that amount be
offered for salt at this time in the
manner required by Chapter 23 of
the 1950 Code of Iowa;
Now Therefore, be it Resolved
by the City Council of the City of
Dubuque, as follows:
Section 1, That Dock Bonds of
said City in the amount of Thirty
Thousand Dollars ($30,000) be of-
fered for sale pursuant to adver-
tisement, said bonds to be num-
bered 1 to 30 inclusive, in the
denomination of One Thousand
Dollars ($1,000) each, to be dated
May 1st, 1951, with interest pay-
able semiannually, and to mature
in numerical order, Three Thous-
and Dollars ($3,000) on May 1st,
1952 and Three Thousand Dollars
($3,000) on May 1st of each of the
years 1953 to 1961, inclusive;
Section 2. That the City Clerk
be and he is hereby authorized and
directed to publish notice of the
sale of said bonds for two (2) or
more successive weeks and on the
same day of each week, in the
Telegraph-Herald, a newspaper
published and of general circula-
tion in Dubuque County, Iowa,
such notice to state that. bids will
be received and acted upon by this
Council at a meeting to be held
at 7:30 o'clock P.M, on June 4th,
1951 and such notice to be in

receipt of open bids the bonds will
be sold to the highest bidder for
cash. Said bonds will be dated
May 1st, 1951, bear interest pay-
able semiannually, and mature in
installments of Three Thousand
Dollars ($3,000) on May 1st, 1952
and Three Thousand Dollars ($,-
000) on May 1st of each of the
years 1953 to 1961, inclusive.
These bonds will constitute
general obligation and the faith,
credit, revenues and resources and
all the real and personal property
of the City will be irrevocably
pledged for the prompt payment
thereof, both principal and interest.
All bids shall specify the rate of
interest, and, all other things
being equal, the bid of par and
accrued interest, or better, specify-
ing the lowest interest rate, will be
given preference.
Approving Op1n10n5, if desired,
will be procured at the expense
of the purchaser, the purchaser to
furnish the printed bonds, and all
bids may be so conditioned. Bid-
ders must furnish certified check
for two per .cent (2%) of the
amount of bonds bid for as guaran-
tee of good faith, this amount to
be forfeited by the successful bid-
der should he fail to take up and
pay for the bonds when ready.
The right is reserved in the City
of Dubuque to reject any and all
bids.

Whereas, proposals have been
submitted by contractors for the
furnishing of aself-propelled road
mix mixing machine to be used for
street construction and reconstruc-
tion. Specifications of the machine
are as follows: 1, The unit shall be
a single self-propelled machine
capable of mixing at least a seven
(7) foot width of street surface.
2. The power unit shall be at least
90 H. P, either gasoline or diesel.
3. The unit shall be mounted on
pneumatic tires and the rate of
travel while mixing shall vary from
75 feet to 300 feet per minute, 4.
Immediate delivery, and
Herman M. Brown Company
contractor, has submitted the
lowest bid for the furnishing of
a self-propelled road m i x i n g
machine as provided for in the
specifications; now, therefore
Be It Resolved by the City
Council of the City of Dubuque
that the contract for the above
mentioned equipment be awarded
to Herman M. Brown Company
and the Manager be and he is here-
by directed to execute a contract
on behalf of the City of Dubuque,
Be It Further Resolved that this
resolution being deemed urgent

Section 1 (1) thereof and enacting
a substitute therefor and providing
for a penalty for violation thereof.
Be It Ordained by the City Coun-
cil of tihe City of Dubuque:
Section I. That Ordinance No,
39--49 is hereby amended by re-
pealing Section 1 (1) thereof and
substituting the following therefor:
"Section 1 (1) The north side of
Seminary Street from the west line
of North Main Street to the east
line of Harold Street."
Section II. This Ordinance shall
be in force and effect ten (10) days
from and after its final passage,
adoption and publication as pro-
vided by Law.

Dubuque, Iowa.
Gentlemen:
At the City Council meeting of
March 5, 1951, the petition of
Ruth and Mae Keller requesting
that measures be taken to eliminate
storm drainage flow across their
property from the alley between
Hill and Lois Streets was referred
to the City Engineer for investiga-
tion and report.
The Engineering Department has
completed a survey and prepared
a plan to confine the drainage
from Solon Street within a con-
crete conduit extending from Solon
Street to Reeder Street. This pro-
cedure will correct the condition
complained of by the petitioners.
The pipe and manholes for the
project have been ordered and de-
livered and it is recommended that
the street department be directed
to install the drainage line as soon
as possible.

Gentlemen:
At the City Council meeting of
March 28, 1951, the communication
of Frank Specht, 95 Valley Street,
concerning surface drainage from
the bluff overlooking his property
was referred to the City Engineer
for investigation and report.
The writer has investigated the
condition from both the top and
bottom of the bluff and respect-
fully submits the following report:
(1) The surface drainage com-
plained of appears to originate

along the vertical face of the bluff
since there is no evidence that
any topographical changes have
been made on the upper level in
recent years which would divert
natural flow or direct additional
surface water toward the com•
plainant's property.
(2) There are no practical cor-
rective measures which the City
can take since the surface drainage
originates on private property and
must necessarily he solved by the
property owners concerned.

Gentlemen:
At the meeting of the Play-
ground and Recreation Commis-
sion held Thursday, May 3, 1951,
a discussion was had on the subject
of better ways and means of pro-
viding asupervised recreational
program for the girls of our city,
At the conclusion of this dicus-
sion the following action was
unanimously adopted:
"That a letter be sent to the
City Council asking that they
rescind their action of July 27,
1950, at which time the third floor
of the Armory building was
closed to public use, that the said
Armory building after approval by
the Chief of the Fire Department
and the Building Commissioner,
may be used by the Recreational
Department for promoting super-
vised recreational activities ex-
clusively for the girls of Dubuque"
That a need exists for a girls
recreational center cannot be
denied, however the facilities to
provide such a program are very
limited. The only available space
is on the third floor of the fire
headquarters building, Ninth and
Iowa Streets. Conversation with
Fire Chief Hickson has revealed
his department is not opposed to
the use of this space by the Re-
creation Department, if thought is
given to the type of activities to
be sponsored, and reasonable clos-
ing hour is established, The mem-
bers of the Recreation Commission
are in full agreement with the
thoughts of Chief Hickson since
care and judgment must be ex-
ercised in administering a pro-
gram of this nature.
Question has been raised as to
the condition of the building from
the standpoint of safety. A study
of the structure indicated no prob-
lem exists since one hundred to
two hundred girls could easily be
accomodated without danger.
Your honorable body is respect-
fully petitioned to give this matter
your attention since it is the feel-
ing of the Recreation Commission
that it will be in the best interests
of the girls of the city and be for
the betterment of the community.

Gentlemen:
On March 5, 1951, a claim of
Betty Wiezorek of 2744 Elm Street,
Dubuque, Iowa was referred to this
office for investigation and report.
Investigation was duly made and
it appears that the claim is based
upon a defective catch basin at the
corner of 30th and Jackson Streets,
and that Claimant sustained her
damage by driving her car into
said basin.
From a review of the premises
it is concluded that no negligence
could be attributed to the City in
the maintenance of said catch
basin and it is therefore respect-
fully recommended that said claim
be denied,

Gentlemen:
On Apri15,1951, a judgment was
obtained against the City of Du-
bupue in the case of Nettie Bohler
vs. City of Dubuque, for $1,000.00.
The property owner, Freda Far-
. guar has consented to contribute
toward the payment of said judge-
-' ment the sum of $250.00. In this
~~ ~ connection please be advised that
a notice in compliance with Section
420,46 of the 1950 Code of Iowa
was served upon the said Freda
Farquar, as owner of the said
property involved herein. She is a
non-resident of Iowa, maintaining
her residence in Randolph, Wis-
consin. Being anon-resident and
having transferred her interest in
said property upon receipt of said
notice, process upon her under

said notice would be ineffectual.
It was therefore considered advis-
able to accept her contribution of
$250.00, and thus the final amount
which the City will pay on said
judgment is reduced by $250.00.
It is therefore respectfully re-
commended that the Auditor be
instructed to draw a warrant in
favor of Kenline, Roedell, Hoffman
and Reynolds and Nettie Bohler in
the sum of $750.00 to be delivered
to her upon the execution of a
proper release.
In contributing $250.00, the
property owner demands a proper
release to be executed and de-
livered to her which release will
exonerate her from the payment
of any further sums as a result of
this action. Such release is hereto
attached for proper execution.
In conjunction with the judge-
ment hereinabove referred to,
there is also a judgment for costs
against the City in the sum of
$60.65 which judgement should
likewise be paid. It is therefore
respectfully recommended that the
Auditor be instructed to draw a
warrant in favor of Val. Kies, Clerk
in the sum of $60.65 in payment of
said costs.
Paul Becker, Weatherman, was
subpeoned as a witness on behalf
of the City, but since he did not
testify, his witness fee was not in-
cluded in the costs above referred
to. This witness should be paid for
his appearance and his fee to-
gether with his milage is in the
sum of $7.20 and the Auditor
should be instructed to issue a
warrant in his favor for said
amount.

On March 9, 1951, the claim of
John Schadler of 505 East 4th St.,
Dubuque, Iowa, was referred to
this office for investigation and
report. From an investigation of
this claim, it appears that Mr.
Schadler sustained damages to his
automobile when he dropped into
a hole in front of 1819 Bennett
Street, This hole is the result of
improperly filled excavation in the
street. The damages claimed are
$8.00.
It is therefore respectfully re-
commended that said claim be
paid and that the Auditor be in-
structed to draw a warrant in favor
of the said John Schadler in
the sum of $8.00 to be delivered
to him upon the execution of a
proper release.

Gentlemen:
On April 18, 1951, the claim of
Eldon Adams was referred to
this office for investigation and
report. The investigation discloses
that the car operated and owned
by Eldon Adams was damaged
when it struck a deep depression in
the street at the intersection of
Merchants Lane and Gold Street.
The damage to the car was in the
sum of $11.88.
The investigation further dis-
closed that a hole of sizable pro-
portion did exist at that intersec-
tion and the same was neither
lighted nor barracaded. It is there-
fore respectfully recommended that
the same be paid and that the
Auditor be instructed to draw a
warrant in favor of Eldon Adams
in the sum of $11.88 to be delivered
to him upon the execution of a
proper release.

vestigation and report.
After due investigation it ap-
pears that a hole did exist in the
street and that the same was
neither barracaded nor lighted. It
is therefore respectfully recom-
mended that said claim be allowed
and that the Auditor be instructed

AGREEMENT
This agreement made and en•
tered into by and between City of
Dubuque, Iowa, a Municipal cor•
poration, hereinafter referred to as
the City, and Carl F. Bartels and
Paul McMahan, a partnership doing
business in the City of Dubuque,
Iowa, hereinafter referred to as
the Engineers,
Witnesseth:
Whereas, the City contemplates
the dredging of a sewer channel,
from the outlet of the present Bee
Branch Sewer northwesterly, north-
erly and northeasterly to the Mis•
sissippi River near Eagle Point a
distance of approximately 9,700
feet together with the construction
of a bridge over said sewer op-
posite East Fourteenth Street,
known as the Lake Peosta Sewer
Project; and,
Whereas, the City Manager of
the City has been authorized to
contract for the services of a
competent and qualified engineer-
ing firm to assist the City Engi-
neer in the collection of engineer-
ing data and preparation of plans
and supervision of the work; and,
Whereas, the Engineers have
represented themselves as compe-
tent and qualified to perform said
services and have offered to per-
form the same for the compensa-
tion herein agreed upon;
Now, Therefore, it is agreed:
1. All engineering data and
plans, surveys and maps hereto-
fore prepared by the Engineers
for the Dock Board of the City of
Dubuque shall become the prop-
erty of the City upon the execu-
tion of this agreement.
2. The Engineers agree, at their
own expense, to make all further
surveys, soundings, test borings,
and other investigation necessary
to the preparation of plans, speci-
fications and contract documents
for the execution of said Lake
Peosta Sewer Project.
3. The Engineers agree, at their
own expense to prepare all sur-
veys, general and detailed plans
and specifications and detailed
estimates necessary for said dredg-
ing and bridge construction, and
to furnish the City with 15 copies
of said plans, specifications and
estimates, together with forms for
proposals, advertisement of con-
struction contracts, construction
contracts, and bonds.
4. The Engineers shall at their
own expense prepare all necessary
maps and sketches and assemble
any other necessary engineering
information incidental to obtain-
ing from the State or Federal
Governments or any other regula-
tory bodies any permits or licenses
that may be necessary to the pros-
ecution of the work.
5. When the City is ready to
advertise for bids for the pro-
posed construction work, the Engi-
neers shall assist the City in in-
teresting experienced and qualified
contractors in bidding on the work,
shall assist the City in canvassing
contract bids and in investigating
the qualifications of bidders, and
shall assist the City in awarding
construction contracts.
6. The Engineers shall furnish
proper full time supervision and
inspection of all construction work
by competent and experienced
personnel and make all tests, bor-
ings and soundings necessary to
proper supervision and inspection
of the work.

7. During the progress of con-
struction the Engineers shall pre-
pare monthly reports to the City
Manager of the City reporting the
progress of the work and estimat-
ing the amount of work completed.
Such reports shall be submitted to
the City Manager not later than
the 10th day of the calendar month
immediately following the month
in which the work was accomp•
lished.
8. Upon completion of the work
the Engineers shall make a final
inspection and make their recom-
mendation to the City Manager as
to wheather the City should accept
the work.
9. Upon completion of the work
the Engineers shall furnish to the
City one complete set of as-built
final construction drawings.
10. The Engineers shall receive
as full compensation for said serv-
ices, the following:
(a) Upon complete performance
of the services provided for in
paragraphs 1, 2, 3 and 4 so far as
the same shall apply to the dredg-
ing of said channel the City agrees
to pay the Engineers 1% of the
estimated cost of said dredging.
(b) Upon complete performance
of the services provided for in par-
agraphs 1, 2, 3 and 4 so far as the
same shall apply to the construc-
tion of said bridge, the City agrees
to pay the Engineers 3% of the
estimated cost of said bridge.
(c) During the construction of
said channel the City agrees to
pay the Engineers 3% of the con-
struction cost of the work done
during the previous month pay-
able upon receipt of the progress
reports and estimates provided for
in paragraph 7 hereof.
(d) During the construction of
said bridge, the City agrees to pay
the Engineers 2% of the construc-
tion cost of the work done during
the previous month payable upon
receipt of the progress reports and
estimates provided for in papa-
graph 7 hereof.
(e) Upon complete performance
of the services provided in para-
praphs 1 to 9 inclusive so far as
the same shall apply to the con-
struction of the sewer channel,
the total amount which shall be
paid by the City to the Engineers
will be four percent (4%) of the
construction costs. All payments
made for any service performed
under this contract including
monthly payments, based on work
done during construction, shall be
considered part of this payment.
(f) Upon complete performance
of the services provided in para-
graphs 1 to 9 inclusive so far as
the same shall apply to the con-
construction of the bridge, the
total amount which shall be paid
by the City to the Engineers will
be five percent (5%) of the con-
struction costs. All payments made
for any service performed under
this contract including monthy
payments based on construction
work done, shall be considered
part of this payment.
11. It is understood and
agreed that all plans, specifications
and construction shall be subject
to the approval of the City Man-
ager who may delegate such power
to the City Engineer.
12. This contract shall not be
assigned without the written con-
sent of the City and the same shall
be binding upon the Engineers and
their heirs or devisees but in the
event of the dissolution of said
partnership the City shall have the
option to terminate this contract
forthwith.
13, In the event the Engineers
shall after demand upon them in
writing default in the performance
of any of the terms and conditions
of this contract, the City shall, at
its option, have the right to declare
all rights under this contract
terminated but the failure of the
City to exercise said option in the
event of any default shall not con-
stitute awaiver of its rights under
this paragraph 13.

Dear Sir:
As per your request I have made
an investigation of the various
problems of Mr. Nick Grommersch,
340 Sabula Street, Dubuque, Iowa,
and submit the following:
1. Occupation of Public Property:
Putnam .Street is a short street
crossing Muscatine and extending
west of Muscatine one`half block
and abuts the Grommersch prop-
erty. It is low, not traversable and
for many years was used as a catch-
all for dumping. The appearance
generally was decidedly unsavory.
During the last three years two
people, namely Paul Hirsch, 2755
Muscatine Street, and William
Vyverberg, 2765 Muscatine Street,
built attractive homes, one on each
side of Putnam Street.
They were very dissatisfied with
this unwholesome condition and
proceeded to clean up the street.
They have done a good job,
leveled part of it and it now is in
keeping with the homes. Hirsch
desired to erect a garage but the
condition of the street as to grade
made it inadvisable to erect the
garage to the rear of his house.
The Street Commissioner, City
Engineer and myself talked to
Hirsch and he asked if he could
put the garage temporarily on the
street until it could be filled and
the rear of his lot made accessible
from the street. This seemed to be
a reasonable arrangement and
Hirsch placed a temporary stru~-
ure on the street approximately
eighty feet from Muscatine Street
and he is perfectly willing at any
time to move it off. However, it
is of no harm to anyone.
These people are maintaiinng
the street in a clean and orderly
manner and until such a time as
the street is acually to be used for
something, it seems unfair to re-
move said garage. Vyverberg also
erected a decorative fence part
way in the street; this also is
known to all parties interested
and both Vyverberg and Hirsch are
to be commended, not only for the
homes they have built but also for
the work of cleaning up the street
of their own volition.
Therefore, any action by the
City upon the request of Mr. Grom•
mersch would only serve to cause
ill feeling among all the neighbors
in this area and certainly would
not be •to the public interest.

1. Opening of the Public Alley
Adjacent to the Above Properties.
This alley lies parallel to the
Grommersch property and dead
ends approximately fifty feet from
Sabula Street, and extends south-
erly to Gay Street. Only two people
at the southerly end use this alley
and it is in its natural state for
ninety eight per cent of its length,
and I believe that if a plat and
schedule were prepared to pro-
pose to open and improve this alley
no one, not even the petitioner,
would want it completed.
3. The Keeping of Dags.
To the rear of 2811 Muscatine
Street is a small garage erected
about twenty years ago. The
building was built on the Sabula
Street line and is right adjacent
to the Grommersch property. The
owner of this building has three
dogs on the premises, two of these
are hunting dogs and they are kept
in an enclosure and not allowed to
run. The other dog is evidently a
pet and is allowed to roam the
yard.
These dogs do bark because
they barked when we approached
the pen. I don't believe we can do
anything about this because the
dogs are kept in an enclosure and
the fenced area is clean.
This, I believe, completes the
points in question and I hope will
give you a clear understanding of
this problem.

Gentlemen:
I would like to submit the fol•
lowing report on the procedures
that can be followed for street im•
provement work by special assess-
ment. The City Council can deter-
mine the type of surface needed
such as concrete paving, sheet as•
phalt paving and bituminous con•
Crete paving, and after the proper
procedure is followed for hearings,
plat and schedules, advertising for
bids and letting of the contract,
the cost is assessed against the
property.
You will note that in this type
of pavement it is necessary that
the work be advertised and let by
contract. It is possible for the city
to assess the cost of oiling and
gravelling the street against the
benefitted property and the city,
at their own expense, can construct
the street, furnishing the labor and
equipment.
On those streets where curb
and gutter projects have already
been approved, I would recommend
that this last referred to procedure
be followed and I would recom-
mend to the Council that the
proper measures be taken for oil•
ing and gravelling the following
streets:
Fairway Drive from the west
property line of St. Ambrose
Street to the east property line of
Bunker Hill Road.
Finley Street from the south
property line of Delhi Street to
the north property line of West
Street.
St. Joseph Street from the west
property line of Fremont Avenue
to the east property line of Stet-
more Street.
McLenan Street from the north
property line of Tressa Street to
the south property line of Mt.
Loretta Avenue.
Tressa Street from the west
property line of McLenan Street
to a point 191 feet east.

Gentlemen:
The operation of the city park-
ing lots by using parking meters
necessitates the Council approving
the immediate purchase of meters
because the time of delivery
should correspond as nearly as
possible with the completion of
the paving of the lots.
There are two types of parking
lot meters available for delivery
within thirty to sixty days, one for
the manual operated meter we
have for street parking that is
converted to a parking lot meter.
The other meter is the automatic
type which has been used satis-
factorily by a number of cities in
Iowa. The experience of the city
in the operation of manual
operated parking meters has
created problems such as jamming
of the meter that could be cor-
rected by using the automatic
type. Other cities I have contacted
which operate both types of meters
have not experienced pilfering of
the automatic type.
I recommend that the automatic
type meter be used on the parking
lots and that the City Manager be
authorized to enter into an agree-
ment to purchase the type of meter
found best suited for our purpose,
and that the meters be paid for
out of 50% of the receipts from
the meters installed on the park-
ing lots.
