City Engineer Gus Psihoyos is recommending acceptance of the public improvement
construction contract for the 2016 Delmonaco Drive Drain Tile Project, as completed by
Key City Excavating, Inc., in the final contract amount of $28,690.50, which is an 8.2%
increase from the original contract amount of$26,515.20. The increase was due to
additional backfill material, drain tile and curb and gutter replacement.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the public improvement
construction contract for the 2016 Delmonaco Drive Drain Tile Project.
BACKGROUND
The project involved the installation of drain tile at three (3) different locations along
Delmonaco Drive to collect and direct sump pump discharge to nearby storm sewer
intakes as well as install perforated drain tile to collect and drain spring water from
under the existing road.
In accordance with Iowa Code § 384.103 and § 364.12(3)(c), and Iowa Code, Section
26.14, the City solicited informal bids for the 2016 Delmonaco Drive Drain Tile Project.
The City received three (3) bids on August 11, 2016 from the following contractors:

Key City Excavating, Inc. $ 26,515.20
Connolly Construction, Inc. $ 32,586.94
Temperley Excavating $ 36,397.00
Key City Excavating, Inc. of Dubuque, Iowa, submitted the low bid in the amount of
$26,515.20.
DISCUSSION
The 2016 Delmonaco Drive Drain Tile Project was completed by Key City Excavating,
Inc., of Dubuque, Iowa, in the final contract amount of $28,690.50 which is an 8.2%
increase from the original contract amount of$26,515.20. The increase was due to
additional backfill material, drain the and curb and gutter replacement.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of $28,690.50 to Key City Excavating, Inc., for the 2016
Delmonaco Drive Drain Tile Project.

RESOLUTION NO. 3-17
ACCEPTING THE 2016 DELMONACO DR. DRAIN TILE PROJECT AND
AUTHORIZING THE PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the 2016 Delmonaco Drive
Drain Tile Project (the Project) has been completed by the Contractor, Key City
Excavating (Contractor), the City Engineer has examined the work and recommends
that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $28,690.50;
WHEREAS, the Contractor has previously been paid $27,255.97, leaving a
balance of $1,434.52; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the
Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $1,434.52 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that
he has inspected the 2016 Delmonaco Drive Drain Tile Project has been performed in
compliance with the terms of the Public Improvement Contract, and that the total cost of
the completed work is 30,125.02.
