Firnstahl, City Clerk Crenna Brumwell, City Attorney DATE: December 21, 2016 SUBJECT: Staggering of Terms for the Resilient Community Advisory Commission INTRODUCTION The City Attorney's Office and the City Clerk's Office are requesting approval of an amendment to the Code of Ordinances related to the Resilient Community Advisory Commission (RCAC) to provide for the staggering of member terms for the initial appointments and future recruitment. BACKGROUND The City Council adopted Ordinance 32-16 on July 1, 2016 which created the nine- member Resilient Community Advisory Commission. Membership is drawn from a combination of at-large residents and cross-representatives from a specified list of current City boards and commissions. The Ordinance provided that all nine, 3-year terms expire on July 1 , 2019. DISCUSSION Most city-created boards and commissions have staggered terms to prevent all terms from coming due at the same time and allowing the board/commission to maintain a quorum and continuously conduct business. Several of the City's boards/commissions have cross-representation provisions wherein a member of one board/commission is selected to serve as its representative on another board/commission. Cross representatives are chosen for the position and submitted to the City Council for approval. In these cases, the term of the cross representative remains that of the initial board/commission to which they were appointed. This prevents a member from continuing as a cross representative when the term on their "root" board/commission has ended. Member recruitment and the tracking of term expirations by the City Clerk's Office is also simplified and is less confusing for members. ACTION REQUESTED It is respectfully requested that the City Council approve the amendment allowing for the staggering of the at-large member term dates for the initial appointments and providing for cross-representative member term dates as stated in the proposed ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Section 2-6-7 of the City of Dubuque Code of Ordinances is hereby amended to read as follows: 2-6-7: TERMS: The initial terms shall be as follows: A. Three (3) cross representative members appointed until the expiration of their terms on the cross represented board or commission. Following the initial terms, the term of office for commissioners is three (3) years or until such commissioner's successor is appointed and qualified. The terms of the cross representatives appointed from the Arts & Culture Advisory Commission, Catfish Creek Watershed Management Authority, Community Development Advisory Commission, Historic Preservation Commission, Housing Commission, Human Rights Commission, Long Range Planning Advisory Commission, Parks & Recreation Advisory Commission, Transit Advisory Commission, and/or Zoning Advisory Commission must coincide with their terms on the Resilient Community Advisory Commission.
